WHEREAS, an Qrdinance, Council File No. 90- �QS'� � granting permission to the
Merrill Corporation, at 1505 Energy Park Drive, Saint Paul, Minnesota, to construct,
operate, and maintain a copper telephone cable within a two inch conduit, under and
across the Decourcy Circle right-of-way, has been prepared and introduced to the
Council of�he City of Saint Paul, and will be adopted on •a���e�► �.�, i 9 4a
to be effect�ve eventually on �vu�a�y ��� /991 ; and
WHEREAS, the Merrill Corporation has agreed to commence construction entirely at
its own risk� follo�nring the approval of this resolution and the issuance of all required
permits; and ;
WHEREAS, the Merrill Corporation has agreed to the removal of the telephone cable
and conduit completely restoring the right-of-way to the satisfaction of the Director of
Public Works, in the event the said Ordinance fails to be approved by the Council of
the City of Saint �'aul;
NOW THEREFORE, BE IT RESOLVED, that, pending the said Ordinance becoming
:effective, the Dir�ector of the Department of Public Works is hereby authorized and
directed to issue a permit to the Merrill Corporation, 1505 Energy Park Drive, Saint
Paul, Minnesota, for the construction, operation, and maintenance of said telephone
cable under and across the Decourcy Circle right-of-way, subject to the same
conditions and requirements as set out in the Ordinance, Council File No. 90- ao5 9
pending beifore the Council of the City of Saint Paul, informal approval of said
construction, ope'�ation and maintenance being hereby granted in anticipation of the
final adoptian anc� approval of said Ordinance.
