EXPEDITING INSPECTIONS NECESSARY TO THE ABATEMENT AND REMOVAL OF HAZARDOUS
BUILDINGS
WHEREAS, Minneso�a law governing municipal abatement or removal of hazardous
buildings, Minnesota Statutes 463 et seq. , is unclear as to the nature of the
inspection necessary for the determination that a building is hazardous and in
need of abatemen� or removal; and
WHEREAS, cl�rification of the law relative to the powers and duties of
enforcement and inspections staff would enhance the City's ability to make use
of the procedures available under Minnesota Statutes chapter 463 and would
enable the City �o more effectively abate or remove hazardous buildings;
BE IT RESOLVED that the City support amendment of the Minnesota hazardous
buildings statue, Minnesota Statutes chapter 463, to expressly allow that the
determination of the existence of a hazardous building and the commencement of
the process leading to abatement or removal be initiated by an inspection of
the exterior of �he building in question and to provide for the issuance of a
search warrant supporting an administrative search in enforcement of municipal
building and housing codes and the hazardous buildings statute based on the
affidavit of the enforcement or inspections officer who has made an exterior
inspection and has, therefore, reasonable cause to believe that a hazardous
condition could exist.
