WHEREAS, the City bf Saint Paul has by ordinance ct�d o prevent and
otherwise amaliorarte the loss of safe and affor b e r ntal housing as a
consequence af Cit�y-assisted development (Sai dministrative Code
ch. 93) ; and '
WHEREAS, the �City pf Saint Paul is further o�l g ed to comply with the
provisions o£ the �Jniform Relocation Assistance and Real Property acquisition
Polices Act af 197'�0 (42 USC 4601 et se . gov ning the relocation and the
provision of ,repla�ement housing for pers s isplaced in a Federally-assisted
project; and
WHEREAS, the State of Minnesota has adop d a statute imposing additional
replacement housinig requirements (Min. at. 504.34-504.35) ; and
WHEREAS, thes�e var',ied statutes and �u es have diverse and inconsistent
requirements ,among, which being: `�

1. that tt�e State requires ne or-one replacement of same sized
reside�tial iunits where�i Federal and City requirements seek
replace�ment bf an equ 1 n ber of bedrooms,

2. that thje Fedieral Go er ent mandates the use of Fair Market Rent (FMR)
as the prope� stan hile the State uses a standard of 30� of 50� of
Median Incomle and ity 30� of 55$ of Median Income, and
3. that the Staite ity seek to preserve affordability for 15 years and
the Fec�eral '�t�! \.p serves affordability for 10 years; and

WHEREAS, City staff has had one year of experience in attem t ta comply �
with and harmonize these varied and conflicting requirem�s /
BE IT RESOLVBD, that the City of Saint Paul supports le�isla ve efforts to
remove the replace�ment housing requirements of exis ing la which are in
conflict with other laws, burdensome on cities and er re with development
and do not apply to other cities. �
