WHEREA�,The City of Saint Paul has requested that the Department of Transportation grant a '
variance from the State's�tandards for design of urban roadways for the reconstruction of
PROSPERTTY AVENUE from Rose Avenue to East Maryland Avenue; and �
WHEREAS,The Commissioner of the Departrnent of Transportarion has by letter norif'ied the City
that the request for a variance has been granted upon condidon that the City Council of the City of
Saint Paul adopt a resolution indemnifying, saving and holding haimless the State of Minnesota
from any claims arising out of the granting of this variance; and
WHEREAS,The City has no other option available to it to receive the variance requested unless is
complies with the demand of the Commissioner of the Department of Transportation; now,
therefore,be it
RESOLVED,Th�t as the sole condition to receiving a variance from the provisions of State Aid
Rules Section 88�20.9912, the Council of the City of Saint Paul does hereby agree to indemnify,
save and hold haimless the State of Minnesota and all its agents and employees of and from any
and all claams,demands, actions,or causes of actions of any nature or character arising out of or
by reason of,in any manner, the reconstruction of CSAH 64 (PROSPERITY AVENUE) from
Rose Avenue to East Maryland Avenue,in any other manner than as in accordance with Minnesota
Rules 8820.9912 and further agrees to defend at their sole cost and expense any action or
proceeding commenced for the purpose of asserting any claim of whatsoever character arising as a
result of the granting of this variance.

2 of the Saint Paul community; and

4 WHEREAS, !these andividuals are too often not provided opportunities to voice their
5 concerns, participate in decision making processes, or contribute their resources as
6 viable Saint �aul citizens; and

8 WHEREAS, the 1V�ayor's Strategic Planning Committee on Youth and Education
9 developed a plan tp address youth related issues; and

11 WHEREAS,;one i�lentified strategy focused on"involving and preparing youth as leaders
12 in the Sai.nt Paul aommunity; and �

14 WHEREAS, the �ity's establishment and support of a citywide Youth Council emerged
15 as a vehicle �or yolung people to make significant contributions to City government,
16 schools and �the cdmmunity at large; and

18 WHEREAS, in d�monstrating the City's commitment to youth empowerment, the City's
19 Youtb Coordinatar selected eight Saint Paul youth to develop a youth council model;
