r presents the same base rate that the City paid to

C ' ty. Said ponding easement is described as follows:
All that portion of Lot 17 of Guerin' s Out Lots to
City of St . Paul according to the recorded plat

Deeds in and for said Ramsey County, Minnesota,
excepting therefrom, the East 5 feet of said

4. T at the petitioner , its successors, and assigns shall
p y compensation in the amount of $1, 32Ql. Q10
f r the encroachment of its building over the City' s
s wer easement in the east 18 feet o�E Block 1 of
G eene' s Addition to Saint Paul . This compensation
s all be deposited in Public Works Fund #C90--2T623--
0 87-29116 . The petitioner , its successors , and
a signs shall be responsible for any and all costs for
r moval of the encroaching building within the City' s
s id easement area if the City needs to remove,
r pair , or replace any of its sewer facilities within
s id easement. This encroachment shall be permitted to
r main only for the life of the present structure and
s all cease to exist upon the demolition, removal ,
r construction, or otherwise non--existence of the
e croaching building.
5. T at the petitioner , its successors, and assigns
s all Quit Claim its interest in the vacated portion
o the alley in Block l , Greene' s Addition to
S . Paul , to the Housing Redevelopment Authority of
t e City of Saint Paul , Minnesota in, a form and manner
t be approved by the City Attorney. '
6 . T at a permanent sewer easement be retained on behalf
o the City of Saint Paul, Department of Public Works
w thin the vacated areas described as follows :

line 18 feet west of an parallel to the east

asement shall be subject to the following

structure, material storage, fixture, or other
objects that will prohibit normal access to sewer

construction of a fence as descri�ed in condition

d. That the petitioner, its successors, and assigns
shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents,
employees, and servants from all �uits , actions,
or claims which shall arise from any injuries, or
damages received or sustained by any break in any
service pipe, water main, or connection in said
reserved easement, arising out of or resulting
from any action or negligence of the petitioner,
its employees , agents , or business invitees.
7. T at the petitioner, shall be permitted to construct a
f nce, for security purposes , within the vacated areas
o Acker Street and Park Street described as follows:
Beginning at a point on the northerly extension
of the west line of Lot 18, Guerin' s Out Lots to
St. Paul , 8 feet north of the northwest corner
of said Lot 18; thence east along a line 8 feet
north of and parallel to the south line of
vacated Acker Street a distance of 256 feet;
thence southeasterly along a d�agonal line
to a point which is 10 feet south of the south
line of vacated Acker Street at�d 10 feet east
of the west line of vacated Park Street as
widened by the Common Council April 7, 1886;
thence south along a line 10 feet east of and
parallel to the west line of vacated Park
Street as widened, to the easterly extension
of the south line of Lot 17 of said Guerin' s
Out Lots; thence west along said easterly
extension a distance of ten feet more--or�less
and there terminating.
T e petitioner , its successors, and assigns shall be
r sponsible for any and all costs which may be caused
t the fence including but not limited to, costs for
r moval, repair, or replacement as a result of any
r pair , replacement or removal of sewer facilities

8. T at a permanent water utility easem�ent be retained,

shall be solely responsible for maintaining this
easement at all times, including removing snow and
debris therefrom.

shall pay all costs and expenses for mounted signs
and the placement thereof, designating this
easement as a fire emergency area to include
prohibited parking , subject to the approval of the
Department of Fire & Safety Services.
