RESOLUTION OF INTENT
METROPOLITAN STATE UNIVERSITY
LOWER BLUFF 40 ACRE STUDY

WHEREAS, by Co ncil File No. the Council of the City of Saint Paul, as part of the Lower
Bluff 40 Acre Study, has enacted an ordinance rezoning certain property in the Daytan's Bluff area
of the city, includin par els located at 381-397 Bates and 407 Bates in the City of Saint Paul,
County of Ramsey, tate of Minnesota and more fully described as follows:

WHEREAS, consist nt 'th the Saint Paul Comprehensive Plan Land Use Plan, the Planning
Commission reco end d a B-2 use classification for the Property assuming ea�pansion by
Metropolitan State niv rsity to use the Property, but the City Council concerned with introduction
of business use into re idential area should Metropolitan State University not so expand enacted a
RT-1 use classificati�n f r the Property;
WHEREAS, neighb rho d representatives have indicated that the neighborhood would support a
B-2 use classificatio in t e event of acquisition by Metropolitan State University for university use;

WHEREAS, it is th pre ent intention of the City Council, consistent with the requirements of law
respecting amendme t o the Zoning Code, to favorably consider a B-2 use classification for the
Property should it b ac ired by Metropolitan State University; now therefore, be it

As part of the Lo r B uff 40-Acre Study, The Planning Commissi recommended a B-2 classi-
fication for the � ope ty assuming expansion by Metropolitan St e Univ. to use the propert ,
but the city cou il ecame concerned that business might be i roduced into a residential
area if the Unive ity does not expand. Therefore, they enacted� an RT-1 use for the proper y.
This resolution a irm the council's intent to rezone if the pr perty is acquired by the
University.

Dear Commit ee Members:
At the re es of the Committee, I have prepared the enclosed
resolution of present intent on the part of the Council to
favorably on ider a rezoning of 381-397 and 407 Bates upon
petition b M tropolitan State University at such time as the
University xp nds into these addresses.
In the opi io of this office, such rezoning could not be done
under the ow r Bluff 40 Acre Study Rezoning once the hearing
process is co plete and ordinances covering that rezoning are
adopted, bu ould require a subsequent rezoning action. A consent
petition b M tro State may pose a problem if at the date of
petition or wi hin one year preceding it, Metro State has assembled
a significa t ontiguous ownership as consents of the owners two
thirds of th descriptions within 100 feet of Metro State's
ownership a e equired under Minnesota Statutes, Section 462 . 357
