WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Public Works Department, represented
by Larry Lueth, Assistant City Engineer, who has been designated
as the responsible person on the application, has applied for a
variance permitting the Public works Department to al, ow oad
construction activitzes between 10:00 p.m. and' � �t on
Shepard Road between Randolph and Elm Streets which might
otherwise exceed the sound level limits permitted by §293.09; and
WHEREAS, applicant is seeking a variance for the hours of
10:00 p.m. to -4--99—p-�nr- between September 21, 1998 and January
30, 1999; and � 1ta° — ""_
WHEREAS, if applicant is not granted a variance the
Department of Public Works will not be able to accelerate
placement of embankment fill prior to winter and will not be able
to maintain the 1999 construction schedule; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
recommended that the variance be granted; now, therefore, be it

City of Saint Paul Public Works, represented by Larry Lueth, has requested a
sound level variance to permit Public Works to allow road construction
activity between 10:00 p.m. and 7:00 a.m. until January 30, 1999 along 5hepard
oad between Randolph anfl Elm Streets_ Anticipated noise sources are bottom
dump trucks and grading equipment used to deliver and level fi11.
VANTAGE5 IF APPROVED:
Public Works will be able to accelerate the construction prior to winter, and
ill be able to maintain the 1999 construction schedule deadline.
The Council will be able to review the variance at any time, to determine
hether any conditions are necessary to safeguard the health, sa�ety and
elfare of the public.
DISADVANTAGES IF APPROVED:
Persons living or working near Shepard Road between Randolph and Elm Streets
ay be able to hear the sounds from the road construction that occurs during
the overniqht hours.
DISADVANTAGES IF NOT APPROVED:

Attached is a sound level variance application from Iarry Lueth, Assistant City
Engineer, City of Saint Paul Public Works, requesting that trucks be allowed to deliver
fill to the Shepard Road Projeci, and that roadway grading equipment be allowed to
operate. The azea involved is Shepard Road between Randolph and Elm Streets. A
variance is ret�uested from 10:00 p.m. ta 7:00 a.m., from September 21, 1498 to
January 30 1999.
Also attached is a copy of the Public Hearing Nodce sent to property owners within 200
feet of Shepazd Road between Randolph and Elm Streets.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Public Works Department, represented
by Larry Lueth, Assistant City Engineer, who has been designated
as the responsible person on the application, has applied for a
variance permitting the Public works Department to al, ow oad
construction activitzes between 10:00 p.m. and' � �t on
Shepard Road between Randolph and Elm Streets which might
otherwise exceed the sound level limits permitted by §293.09; and
WHEREAS, applicant is seeking a variance for the hours of
10:00 p.m. to -4--99—p-�nr- between September 21, 1998 and January

WHEREAS, if applicant is not granted a variance the
Department of Public Works will not be able to accelerate
placement of embankment fill prior to winter and will not be able

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Public Works Department, represented
by Larry Lueth, Assistant City Engineer, who has been designated
as the responsible person on the application, has applied for a
variance permitting the Public works Department to al, ow oad
construction activitzes between 10:00 p.m. and' � �t on
Shepard Road between Randolph and Elm Streets which might
otherwise exceed the sound level limits permitted by §293.09; and
WHEREAS, applicant is seeking a variance for the hours of
10:00 p.m. to -4--99—p-�nr- between September 21, 1998 and January
30, 1999; and � 1ta° — ""_
WHEREAS, if applicant is not granted a variance the
Department of Public Works will not be able to accelerate
placement of embankment fill prior to winter and will not be able
to maintain the 1999 construction schedule; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
recommended that the variance be granted; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance from the sound 1eve1 limits of §293_09 to the
Saint Paul Public Works Department for road construction
activities on Shepard Road between

Attached is a sound level variance application from Iarry Lueth, Assistant City
Engineer, City of Saint Paul Public Works, requesting that trucks be allowed to deliver
fill to the Shepard Road Projeci, and that roadway grading equipment be allowed to
operate. The azea involved is Shepard Road between Randolph and Elm Streets. A
variance is ret�uested from 10:00 p.m. ta 7:00 a.m., from September 21, 1498 to

sound level variance to permit Public Works to allow road cons�uction activiry
between 10:� p.m. and 7:00 a.m., until January 30, 1999 along Shepard Road
between Randolph and Elm Streets. Anticipated noise sources aze bottom dump
trucks and grading equipment used to delivei and levei fill.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Public Works Department, represented
by Larry Lueth, Assistant City Engineer, who has been designated
as the responsible person on the application, has applied for a
variance permitting the Public Works Department to allow road
construction activities between 10:00 p.m. and 7:00 a.m on
Shepard Road between Randolph and Elm Streets which might
otherwise exceed the sound level limits permitted by §293.09; and
WHEREAS, applicant is seeking a variance for the hours of
10:00 p.m. to 7:00 p.m. between September 21, 1998 and January
30, 1999; and
WHEREAS, if applicant is not granted a variance the
Department of Public Works will not be able to accelerate
placement of embankment fill prior to winter and will not be able
to maintain the 1999 construction schedule; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
recommended that the variance be granted; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance from the sound level limits of §293.09 to the
Saint Paul Public Works Department for ro '
