RESOLVE , at upon the petition of Louise M. Howe, per Finance
Departme t ile No . 16--1990 that part of Concord Street lying
between ta e Street and Ada Street , hereinafter described, is
hereby v ca ed and discontinued as public property.
The vac ted area is described as follows:
T at part of Concord Street lying within the Easterly
3.,29 feet of Lot 22 and the Westerly 19. 71 feet of
L t 1 , Auditor ' s Subdivision No . 30 , St . Paul ,
M ' nnesota, according to the recorded plat thereof on
f ' le in the office of the County Recorder , Ramsey
C un y , Minnesota , and lying southerly of the
f�llo ing described line:
Co encing at the southwest corner of said
Easterly 3. 29 feet; thence northerly, alonq the
we t line of said Easterly 3. 29 feet , a distance
of 80. 83 feet to the point of beginning of the
li e to be described; thence southeasterly to a
point on the east line of said Westerly 19. 71
fe t , which point is 78 . 07 feet northerly of the
'� so th line of said Lot 21 , measured along said
ea t line, and there terminating .
That this vacation shall be subject to the following conditions :
1 . T at this vacation shall be subject to the terms and
c nditions of Chapter 13P1, codified March 1, 1981 , of
t e Saint Paul Legislative Code, as amended .
2. T at the petitioner, her heirs, and assigns shall pay
, a $500 . 00 administrative fee for this vacation which
i due and payable within 6P! days of the publication
d te of this resolution.
3. T at the land described above is being vacated to
a commodate a building encroachment and that upon
r moval, reconstruction, alteration, demolition, or
o herwise non-existence of the encroaching building
t e vacated land shall revert to the City of Saint
P ul as street right--of-way without cost or charges to
t e City.
4. T at the petitioner , her heirs, and assigns , by
a ceptance of the terms and conditions of this
v cation agree to indemnify, defend, and save harmless
t e City of Saint Paul, its officers, and employees
f om all suits , actions , or claims of any character
b ought as a result of injuries or damages received or

ustained by any person, persons , or property on
ccount of this vacation, or petitioner ' s use of this
roperty, including but not limited to a claim brought
ecause of any act of omission, neglect or misconduct
of said petitioner or because of any claims or
liability arising from any violation of any law or
r gulation made in accordance with the law whether by
t e petitioner or any of its agents or employees.
5. T at the petitioner , her heirs , and assigns , shall
within 60 days of the publication date of this
r solution file with the City Clerk an acceptance in
w iting of the conditions of this resolution and shall
w' thin the period (s) specified in the terms and
c nditions of this resolution comply in all respects
w' th these terms and conditions .
