Whereas, Minne�ta itizens Council on Crime and Justice made ap�lication to the Planning
Commission for a special c ndition use permit and modification of special conditions to allow reuse
of the e�sting motel fa�cilit es as a community residential facility which would house up to 186 '
persons pursuant to th� pr visions of the Saint Paul Zoning Code for property located at 1964
University Avenue (so thw st corner of University and Prior Avenues), legally described as KOSY'S
Corners beginning at t�ie i tersection of west line of Prior Avenue and sow�thwest line of University
Avenue thence northweste y on said southwest line 248.64 feet thence southwest at right angle
217.66 feet thence sou�hea terly 371.63 feet to point on said west line thence north 250.00 feet to
beginning; and �
Whereas, The Z nin Committee of the Planning Commission conducted a public hearing on
July 19, 1990, after ha�ng rovided notice to affected property owners, and submitted its
recommendation to th Co 'ssion. The Commission, by its Resolution 90-74, adopted July 27,
1990, decided to deny�he equest for modification of the 1320 feet spacing requirement between
community residential facil ties and to deny the application based on the following findings and
conclusions: '
1. The mini um distance spacing requirement for community residential facilities,
§60.423(3) (d) of�the zoning code is not met. '
2. All other on itions of §60.423 (3) required for the issuance of a SCUP appear to be
met, or could be�met
3. There are oth r reasonable reuses for this site which would be permitted under the B- �
3 zoning without nee for modification of special conditions.
4. The Umv rsi United Plan, a part of the City's comprehensive plan states there are '
man viable co�er ial uses for this ro er .

5. Based on 199 statistics from the Minnesota Department of Corrections, the proposed
facility is more t an o times the size of the largest community based corrections facility in
the state, and m re t an three times the average size for such facilities. ,
6. There ar sev ral other community residential facilities within one-half mile of the site.

7. Based on�199 statistics the City of Saint Paul currently hosts 31% of the Licensed
Community Bas d C rrections (LCBC) beds in the State of Minnesota. If this proposal is
approved, Saint�'aul would be hosting between 45 and 50% of the LCBC beds in the State. '
Saint Paul is ho e t only 6.14% of the total population of Minnesota according to the most
recent official � pul tion estimates. ''
8. The petit'one s have not proved their case that strict application of the minimum
distance spacing req irement would "...unreasonably limit or prevent otherwise lawful use of a
(this) piece of p ope or an existing structure...". Therefore the primary condition required
to justify the r� est d modification of special conditions is not met. ,

On July 19, 1990, he Zoning Committee of the Planning Commi�sion held a public
hearing on thi re uest for a Special Condition Use Permit. The petitioner
testified. At�the close of the public hearing, the Committe� voted 4 to 3 to
deny the Special C ndition Use Fermit based on stsff findings.
On July 27, 19�0, he Planning Commission upheld the Zoning �ommittee's
recommendation ;on vote of 14 to 2.
This appeal is ''sch duled to be heard by the City Council on ISeptember 20, 1990.

WHEREAS, Minnesot � Ci izens Council on Crime and Justice, file #10654, has applied
for a Special Con�iti n Use Permit with modification of the minimum distance spacing
requirement for C4mmu ity Residential Facilities, under the provisions of
§60.544. (9) of th� Sa'nt Paul Legislative Code, for the purpose� of establishing a
community based corre tions facility to serve up to 120 women and their children on
property located �t 1964 University Ave, legally described as K�osy's Corners
beginning at the int rsection of west line of Prior Avenue and southwest line of
University Avenuej, t ence northwesterly on said southwest line ,248.64 feet, thence
southwest at a ri ht angle 217.66 feet thence southeasterly 371.63 feet to a point
on said west line�th nce north 250.00 feet to beginning; and ,
WHEREAS, the Zoni�►g ommittee of the Planning Commission on Ju�;y 19, 1990, held a
