WHEREAS, it �s t intent of the City Council to protect the public health, safety and welfare
by protecting the public treets in every way possible from intrusion and disruption of the free flow -
of traffic for the purRose of installation of fiber optic communication systems, when said systems
create an additional lburd n on the free flow of traf�c, cause inconvenience to the public, or when
they consume the finite s aces within the streets; and,
WHEREAS, it is a nding of the Council that the public streets in the City have limited
capacity for use by utiliti s and telephone companies, and it is the desire of the City to place
reasonable controls o� su h firms in order to limit the impact of their installations, protect the
residents of the City fro undue liaUility and expense, and to provide for the broadest possible
range of services and pro ucts available within the limitations; and

WHEREAS, it is a rther finding of the Council that the installation of fiber optic
communications syste�ns resents a particular concern, due the multiplicity of firms seeking
permission to install �with the public streets, and the impact that these Mumerous systems will have
� on the capacity of the pu lic rights-of-way within the City; and
WHEREAS, the Ci Council currently has pending before it an ordinance that deals with the
problems noted abov�, sa d ordinance pending before the Public Works �ommittee; now, therefore,
be it,
RESOLVED, tl�a��t e City Council of the CIty of Saint Paul does 1�ereby declare a
moratorium on the install tion of fiber optic telecommunications lines within the public right of way
for the next ninety (90) d ys. '
