The vac ted area is described as follows: Th t part of Courtland Place lying south of Acker St eet south to the Burlington Northe�n Railroad; also al of the alley in Block 8, Edmund Rice' s Second Ad-- di ion to the City of Saint Paul, Ramsey County, Mi nesota . The vac tion shall be subject to the following conditions : l. That this vacation shall be subject to the terms �and conditions of Chapter 130, codified March 1, 1981 , of the Saint Paul Legislative Code, as amended. 2. That a permanent sewer easement be retained within the vacated area; on behalf of the City of Saint Paul, Department of Public Works, subject to the following conditions: a. No buildings, structures, or trees are per-- mitted within the easement area nor any temp� orary structure, material storage, fixture, ' or other objects that will prohibit normal access to sewer facilities for maintenance purposes. b. No change from the existing grade is permit-- ted without written permissipn from the Director of the Department of Public Works. , c. No change in surfacing withim the easement ', area is permitted without wr�tten permission ', from the Director of the Department of Public ' Works . ' d. That the petitioner, its successors and assigns shall provide the Sewer Maintenance Division of the Public Works continuous ac� cess to the vacated portion of Courtland Place should access to the said area be con-- trolled by means of gates or fencing or any other means which might prohibit entry. e.
