THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 That Chapters 08 and 420 of the Saint Paul Legislative Code be and are hereby repeale in their entirety, and the following enacted as a new chapter 408. Ch pter 408. Recycling Collection Center Recycling Processing Center Section 408.01 License Required. No person shall engage in the business of operat ng a recycling collection center or a recycling processing center ithin the city without a license. A separate license shall be held for ach business premises or auxiliary location within the city. Sec. 408 . 02 . efinitions. For the purposes of this chapter, the ;ollowing terms sh 11 have the meaning indicated in this section: Recyclabl Material is reusable material including but not limited to gla s, plastics and synthetic materials, paper products such as newspa ers, stationery, scrap paper, computer paper and corrugated car board, rubber, batteries, ferrous and non-ferrous metals, concre e, asphalt, wood and building materials not including yard waste. Recycling Collection Center is a recycling collection facility in a building or the acceptance by donation, redemption, or purchase of recyclable aterials. Such a facility may allow limited compacting or rushing of recyclable materials. Recycling Drop-Off Station is a facility consisting of reverse vending machin s or unattended weather resistent containers that are provided for t e collection of recyclable materials. Any such recyclable mat rial collected shall be of a size permitting it to be placed complet ly inside an enclosed reverse vending machine, weather resistant cont iner or trailer so that said materials are not exposed to the element . Such a facility may be established in conjunction �R1G �� . � � � A } y i i��'`� tr�ith'�Tfd acce sor �to an existin commercial or industrial use. The Y g term recyclin drop-off station shall not include temporary mobile collection co tainers. Recyclin Processing Center is a recycling facility that ( accepts, stor s, and processes recyclable materials whether or not maintained in connection with another business. Processing includes but is not li ited to bailing, briquetting, crushing, compacting, grinding, shr ding, sawing, shearing and sorting of recyclable materials and he heat reduction of such materials. Sec. 408.03 . ees. The annual license fee for a recycling collection center ' s three hundred sixty-three dollars and twenty-five cents ($365. 25) , a d the annual license fee for a recycling processing center is six hund ed eighty-seven dollars and twenty-five cents ($687.25) . Sec. 408. 04 . icense Requirements. (a) Applicati n. An applicant for an initial license under this chapter s all submit to the license and permit division a written a plication signed by himself or herself if an individua , by all partners if a partnership, or by the president or chief executive officer if a corporation. The applicati n shall be signed under oath and shall contain the following information: (1) Name, residence, and telephone number of every person havi g an interest in the business in excess of ten (10) perc nt ownership. (2) The rade name and address of the business on behalf of whic the application is made and its telephone number. (3) Exac address and property description of the premises in Sain Paul where any part of the business is to be carried on, ogether with a diagram of the premises showing, with exac ness, the location of the abutting roads, ' properties, buil ings and uses, and the location, materials and design of a 1 buildings to be used in the licensed business, incl ding structures required hereunder. (4) Such other information as the inspector may reasonably requ re to assist the council. b) Investiqa ion. Upon receipt of an initial application, the inspector shall forward it to the building inspection and design division, the fire department, and the division of public health. ach office will complete due investigation and will report to the council through the inspector within forty-five days. Sec. 408 . 05. iaense Regulations. a) Recyclinq Collection Center. Every licensee of a recycling collectio center must comply with the following conditions: 2 � r.- /7 RIGI�N �'=��� �� . . �;�'�� �- ) The required license, name and phone number of the facility ope ator, and the hours of operation must be prominently dis layed. (2) The se of power-driven equipment shall be limited to wit in a building(s) except for the once-a-day transfer of deposited recyclable materials in containers from exterior drop-off stations on the premises to storage locations wit in the building(s) . (3) All xterior storage of material and goods for drop-off stations must be in durable, waterproof, and rustproof cont iners or enclosures that are covered so that said mate ials and goods are not exposed to the elements. Al1 cont iners or enclosures must be secured from unauthorized entr or removal of goods or material, attractively pain ed, maintained in good condition, and of a capacity suff'cient to accommodate all such materials. The coll ction schedule must also be posted in full view of the publ 'c at all times. (4) The ontainers used for recycling drop-off stations must be clea ly marked to identify the type of material and goods that may be deposited and shall display a notice stating that no material or goods shall be left outside the recy ling containers. There shall be a sign indicating that cans and bottles should be rinsed prior to deposit at the rop-off station or the collection center. (5) The ecycling collection center shall not operate between 7: 00 P.M. and 7 : 00 A.M. if the facility is located within five hundred (500) feet of residentially zoned or resi entially used property measured from the property line of t e recycling collection center to the property line of the earest residentially zoned or residentially used prop rty. (6) No f' re hazards shall exist on the premises. (7) The remises shall be maintained in a clean and orderly cond tion free of rats and other vermin, wastes and stan ing water. No oil, grease, petroleum products or othe harmful, hazardous or noxious liquids shall be allo ed to run off the property or absorb into the ground. (8) Nois levels shall not exceed the limits set forth in Chap er 293 of the Legislative Code. (9) Weed and grass on the premises shall be maintained in acco dance with Chapter 45 of the Legislative Code. (10) No m terial used in the business shall rest on or protrude on a y public property or be permitted to be blown off the prem ses. (11) No a tivity required by this chapter to be licensed shall be c nducted any place except upon the premises described in a license, other than necessary transport of materials to o from licensed premises. 3 01\ �-l7�i � � � ' . . . �� 177�7, b) Recyclin Processing Center. Every licensee of a recycling processi g center shall comply with the following conditions: (NOTE: a recycling processing center that collects recyclable material shall be subject only to the following conditions and not thos stated above for a recycling collection center. ) (1) The required license, name and phone number of the facility ope ator, and the hours of operation must be prominently dis layed. (2) All xterior storage and processing areas must comply with the equirements for containers and screening set forth in Section 60. 612 (18) if in an I-1 zoning district or Section 60. 6 4 (1) if in an I-2 zoning district. (3) Ther shall be no open burning of any material and no fire haza ds shall exist on the premises. The use of cutting torc es, furnaces and other equipment which produce a flame shal not be construed to constitute open burning. (4) The remises shall be maintained in a clean and orderly cond'tion free of rats and other vermin and free of stan ing water. No oil, grease, petroleum products or othe harmful, hazardous or noxious liquid shall be allowed to r n off the property or absorb into the ground. (5) Nois levels shall not exceed the limits set forth in Chap er 293 of the Legislative Code. (6) Weed and grass on the premises shall be maintained in acco dance with Chapter 45 of the Legislative Code. (7) No m terial used in the business shall rest on or protrude on a y public property, or be permitted to be blown off the prem ses. (8) No a tivity required by this chapter to be licensed shall be c nducted any place except upon the premises described in a license, other than necessary transport of materials to o from licensed premises. Sec. 408. 06. ecord Reeping. a) Licensees shall maintain records on the premises for at least one year or the following transactions: i) Purc ases from minors. Purchases of all materials, excl ding beverage containers and paper products, from pers ns under age of eighteen. In addition, each licensee shal obtain written consent of a parent or guardian of the mino before purchasing any materials for which records of purc ases are required. The written consents shall also be main ained by the licensee for one year. ii) Purc ases over $200. Purchases of all materials, excluding beve age containers and paper products, for an amount of $200 or more from any person. 4 0 R i G � A�� �� � . � ��_,,��.: � formati n recorded. Each record shall be learly and legibly written in the English language and shall inc ude the amount paid, the date and time of the receipt, the selle 's identification including the seller's name and address. ecords shall be open to inspection at all reasonable times by he inspector or designee or any member of the police departmen . (c) If probab e cause exists that specific goods or materials are stolen co traband or have been used in the commission of a crime and a rep esentative of the police department notifies the licensee f such, the licensee shall not sell or permit to be sold, rem ve or permit to be removed, such goods and materials until suc time as may be determined by the Chief of Police or his repre entative, provided that such time shall in no case exceed th period of 90 days from the time of notification. Sec. 408. 07 . icense not transferable. Licenses issued hereunder shall not be trans erable. Sec. 408. 08. enewal; Transition Provisions. (a) Renewal. Any person to whom an initial license has been issued may obtai the annual renewal of the license by filing with the inspector an application which specifies any changes in the informati n submitted with the initial application and the annual li ense fee. The inspector shall process the application in the ma ner specified in section 408 . 04 and the council shall consider he application in the manner specified in section 310. 04. (b) Transitio Provisions. Applications for renewal by persons holding a license under the provisions of chapters 408 or 420, as of the effective date of this ordinance, with respect only to existing remises, shall be treated as a renewal rather than an initial 1 cense provided that the persons agrees to abide by the terms of his chapter within 90 days from the expiration of the original icense; provided, however, that no such licenses shall be renewe for premises except those located in B-3 , I-1, I-2 and I-3 z ning districts. (c) Adverse a tion.
