An ordin nce amending Chapter 60 of the Saint Paul Legislative Code
pertaining t zoning for the City of Saint Paul and the zoning maps thereof
WHEREAS, Pursu nt to Minnesota Statutes, §462.357 and §64.400 of the
Legislative Co e, Housing & Redevelopment Authority duly petitioned to rezone
property on Da ton Avenue, being legally described as That part of Lots 1 and
2, Block 78; D yton and Irvine's Addition to the City of Saint Paul, described
as follows:
Beginning t the northwest corner of 'said Lot 2; thence S 89 degrees 21'40"
E, assumed earing, along the north line of said Lots 1 and 2, a distance
of 109.00 eet; thence S 0 degrees 38'20" W 78.50 feet; thence N 89 degrees
21'40" W 7 .40 feet; thence S 45 degrees 23'S9" W 28.17 feet; thence S 0
degrees 11'34" W 17.96 feet to the south line of said Lot 2; thence N 89
degrees 22'S0" W 10.00 feet to the southwest corner of said Lot 2; thence N
0 degrees 1'34" E, along the west line of said Lot 2, a distance of 116.47
feet to th point of beginning;
from P-1 to B- for the purpose of permitting reuse of the property as a pool
for the YWCA, he petition having been certified by the Planning Division on
June 6, 1990 a having been consented to by at least 67� of the owners of the
area of the pr perty to be rezoned, and further having been consented to by at
least two-thir s of the owners of the property situated within 100 feet of the
total contiguo s property within one year proceeding the date of the petition;
and
WHEREAS, The Z ning Committee of the Planning Commission on August 2, 1990,
held a public earing for the purpose of considering the rezoning petition, and
pursuant to Se tion §107.03 of the Administrative Code, submitted its
recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The P anning Commission considered the rezoning petition at its
meeting held o August 24, 1990 and recommended that the City Council approve
the petition; nd
WHEREAS, Notic of public hearing before the City Council on the said rezoning
petition was d ly published in the official newspaper of the City on September
1, 1990 and no ices were duly mailed to each owner of affected property and
property situa ed wholly or partly within 350 feet of the property sought to be
rezoned; and

September 20, 1990, where all interested parties were heard, the Council having
considered al the facts and recommendations concerning the petition;

On August 2, 199 , the Zoning Committee of the Planning Commission held a
public hearing o this rezoning. The petitioner testified. On August 16,
1990, the Commit ee voted 5 to 3 to approve the rezoning b�sed on staff
findings.
On August 24, 19 0, the Planning Commission upheld the Zoning Committee's
recommendation o a vote of 13 to 2.
This rezoning is scheduled to be heard by the City Council on September 20,

A. PURPOSE: To onsider a petition to rezone property frovp P-1 to B-2 to permit

Paul YWCA Hea th and Fitness Facility.
B. PARCEL SIZE: e parcel has 109 feet of frontage along the south side of Dayton
Avenue and a pth of 79 feet. The area of the parcel is 8,611 square feet.
C. IST NG D SE: The parcel is currently part of an off-street parking lot
used in conjun tion with businesses located to the west 'and south of the sub�ect
site.
D. S OUNDING D USE:
North: Multi-family residential uses located on RM-2 zbned land.
East: Off-s reet parking on P-1 land, and a public par,k.
South: Off-s reet parking located on P-1 zoned land.
West: Mixed ommercial uses located on land zoned B-2.
E. ONING CODE CI AT ON: Section 64.400. (a) states in part that "the council may,
from time to t me, amend, supplement or change the distr�.ct boundaries or the
regulations he ein, or subsequently established herein pursuant to the
provisions of innesota Statutes Section 462.357 and amendments thereto as may
be made from t me to time. . .".

be initiated b the council, the planning commission or by petition of the
owners of sixt -seven (67) percent of the area property to be rezoned. . ."

F. HISTORY: The site was rezoned from "C" Residence to Co�mercial in March of 1958
to permit the development of off-street customer parki�g for a business to the
west. Part o the site was later developed with a commercial structure. The
site was rezo ed to RM-2 & B-2 during the comprehensive city-wide rezoning in
1975. A rezo ing of the property to P-1, to once again permit the development
of off-street parking for uses to the west and south, was processed and approved
in 1987.
G. DISCUSSION: e proposed reuse and rearrangement of uses on this block will
result in som changes in the parking requirements and the allocation of parking
resources ava lable on the site. A parking deficit of �three spaces will result
if the curren plans for the YWCA remain unchanged (see' parking computation memo
from Wendy La e attached) . A variance from the parking requirments should be
sought by the developer if this shortfall cannot be accc�mmodated by changes
within the us area of the project.
G. FINDINGS:
1. A consent etition containing the signatures of 14 o�wners of property lying
wholly or artially within 100 feet of the subject p;roperty, was received in
the Zoning Office on June 11, 1990.
2. Following he mandatory seven (7) working day waiting period, under the
terms of § 4.400. (c) of the zoning code, the petitian was determined to be
sufficient by staff on June 19, 1990.
3. Constructi n of a proposed building to house a swimm'ing pool for the health
and fitnes center would cover the entire rezoned ar�ea of the site.
4. Developmen of the structure for the swimming pool would remove 33 parking
spaces fro the existing parking lot. The the new development would require
38 additio al parking spaces to meet parking requirements for the total
facility. Since the lot is a shared parking facility, the 71 space deficit
in parking spaces created by the new development could be eliminated through
changes in the mixture of uses within the remaining buildings served by the
parking lo .
G. S AFF RECOMMEN ATION: Based on the above suggested findings, the staff
recommends app oval of the requested rezoning.
