Presented By Referred To Council FIle # �' `a� Green Sheet # ��y�� � /� Committee: Date 2 WIiEREAS, the Martin Luther King Recreation Center 8u grade boys basketball team 3 wishes to participate in a fund-raising event with Cub Foods, in which the participants will bag 4 groceries and cazry them out to customers' cars at the Midway Cub Food location and will 5 receive money from Cub and keep any money earned through tips from customers ; and 6 7 WI3EREAS, all money collected from the event will be donated to Martin Luther King 8 Recreation Center, 270 North Kent Street, Saint Paul, for payment of tournament entry fees for 9 the 8�' grade boys basketball team; and 10 11 V+�IEREAS, Cub Foods, located at 1440 University Avenue West, Saint Paul, has agreed 12 to allow the Martin Luther King Recreation Center's 8`" grade boys basketball team to wark at 13 that location on scheduled weekend dates between October 3, 1998 and January 3, 1999 as 14 volunteer baggers and cany-out people, but wishes to be indemnified in the event of any personal 15 injury to a participant in said fund-raising event; and 16 17 WHEREAS, the Saint Paul City Council finds that encouraging youth participation in 18 athletic events is a legitimate public purpose which serves the youth population and fosters 19 stronger communities within the City; and 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, the expenditure of public funds, wich includes the promise of indemnification and defense, for such a purpose will facilitate and enable it to take place; now, therefore, be it RESOLVED, that the Council of the Ciry of Saint Paul on behalf of the City of Saint Paul hereby agrees to defend, indemnify, and hold Cub Foods hannless from any and all damages it may be required to pay as a result of suits, claims actions, or judgments arising out of the participation by the Martin Luther King Recreation Center's St'' grade boy's basketball team at the Midway Cub Foods on scheduled dates between October 3, 1998 and January 3, 1999, for injuries arising out of activities connected with such event, but only those activities permitted and consented to by Cub Foods; and be it FURTHER RESOLVED, that the foregoing defense and indemnification does not cover: 1) casualty loss or properiy damage to Cub Foods property or damage to cars pazked in the lot. 2) any occurrences or events which aze not part of the fund-raising event and which do RESOLUTION CITY OF SAINT PATI,, MINNESOTA not occur or take place at the Cub Foods during the course of the event. 9a,�j q �. 3) Injuries or damages which arise from hidden traps or conditions existing on the grounds or property of Cub Foods of which the company had actual or constructive notice. 4) injuries which arise out of crimival actions, assaults, batteries or other acts of violence committed by any person or persons; and be it FURT'HER RESOLVED, that nothing in the foregoing provisions shall be construed as a waiver of the municipal tort liability limits set forth in Minn.
