WE�RFAS, Bay West, Inc. (the "Company") filed with the City Clerk an
Application for assification of property located on the southerly portion of
Empire Builder ndustrial Park as Employment Property pursuant to Minnesota
Statutes Section 69.170 and the Saint Paul Riverfront Enterprise Zone Prograan
(the "Program"); d
VV�R�S, the new investment, tax classification, and State tax credits as
set forth in deta'1 in the September 24, 1990 Staff Report will result in.the
creation of 60 ew positions in Saint Paul with the oonstruction of a new
39,000 square foo offic and storage facility for Bay West, Inc.; and
WF�REAS, the e has been presented to and considered at this meeting a
Particigation Agr ement between the City and the Com�ny whereby the Canpany
covenants respecti g the completion of property i�rovements; and
WAEREAS, th Port Authority of the City of Saint Paul has received
authorization fr the Degartment of Trade and Econanic Develognent to utilize
an alternative 1 cal oontribution of infrastructure improvements in lieu of
local property tax reduction; and
WE3EREAS, the ity Clerk duly published on Septenber 15, 1990 in the Saint
Paul Legal Ledger, the official newspaper for the City a notice of public
hearing before the City Council upon the Camp�any's Application; and
WHEREAS, the District 6 and 7 Planning Councils have reviewed and
reco�nmer„ded approv 1 of the Application; and
Wf�REAS, the ity Council conducted a public hearing on October 18, 1990,
upon the Applica ion at which hearing opportunity was provided for the
Applicant, the Co ty Assessor, representatives of affected taxing authorities
and any taxpayer f the City or menber of the public to present their views
orally or in writi g at or before the hearing, and having dt�ly considered the
testimony and wr'tten views presented at the hearing and the Application,
staff report and aft Participation Agreement; now therefore, be it
RESOLVED by he Council of the City of Saint Paul that it hereby
.determines t�iat th Application of Bay West, Inc., the property improvements,
retained and new j bs and tax benefits proposed meet the objectives of the
Saint Paul Riverfr nt Enterprise Zone Program.

RE90LVID �IER that the City Council additionally finds and determines
that the constru tion of the new facility (1) is reasonably likely to create
new employment in the City; (2) is not likely to have the effect of
transferring existing employment fran one or more other cities within
Minnesota; (3) is not likely to cause the total market value of employment
property within e municipality to exceed five perc�ent of the total market
value of all t able property within the municipality; or, if it will,
oonsidering the unt of additional municipal services likely to be required
for the emplo nt property, is not likely to substantially impede the
operation or the financial integrity of the municipality or any other public
body levying� tax s on property in the maunicigality; and (4) is not likely to
result in the r ction of the assessed value of existing property within the
City awned by icant.
RESOLVED URTHER that the Application and employment property
reclassification thereby proposed is hereby approved and the City Clerk is
directed to tran 't the Application together with a certified oopy of this
resolution to t e Canmissioner of Trade and Economic Development for
consideration an final approval.
RESOLVED THER that the Participation�Agreement between the City and
the Applicant is ereby approved, and the proper City offioers are authorized
to sign the sa on behalf of the City, and upon its signature by the
. Applicant to tr snit Attachment C of saicl Agreement to the Crnmissioner of

Bay Wes , Inc. proposes to acquire approximately 186,780 sq.ft. (4.3
acres) f land frcm the Port Authority of the City of Saint Paul in E�npire
Builder Industrial Park and that it be determined eligible for reclas-
sificat' n as employment property through the City's Riverfront F�►terprise
Zone pr gram. The property will not be formally reclassified for tax
propose , as an alternative oontribution of infrastructure improvements is
being p vided in lieu of local property tax reduction. This alternative
contrib tion has been approved by the Minnesota Department of Trade and
Economi Development. The property description is attached. This
proper is identif ied by the Ramsey County Ta�c Department through the

B. I AND PROPOSE� USE
Bay West is an eriviroranental consulting firm that has been in business
since 19 4. The firm d�es oonsulting and training in hazardous waste and
qround ter issues, tank testing and resportiding to spills.
The firm oonstructed an 18,000 sq.ft. facility in 1986. Since then, Bay
West has added lab s�xic�e and is leasing 5,000 sq.ft. at a nearby location.
�e firm is proposing to construct a 39,000 sq.ft. office ar�l storage
facility. The project cost is estimated at $2,500,000. The firm naw
e�►ploys 0 people and will add another 60 employees under the proposed ex-
pansion lan.

C. PROITE INQ2F�ASE� MARKET VALUE
'I'he mar et value will increase by the amount of the i�rov�nents plus the
land v ue since the property has not generated any taxes while urider Port
Authority ownership. The developnent will result in an increase in the
estimat market value of $2.5 million. The proj�ct is within the City of
Saint P ul Aousing and Redevelognent Authority's Scattered Site Tax Incre-
ment Di trict. This project will have a positive impact on the District's
revenue .
D. RETA AND NEW JOBS
T'he y has 60 full-time e9nployees who will be retained in Saint Paul
with th oonstruction of the new facility. In addition, the canpany es-
timates they will hire 60 new enployees within the next five years. The
canp�a� '11 enter into a City of Saint Paul F�npl�oyment and Training Par-
ticipati n Agreement.

dustrial Park was created. Based on $47,231 per acre of improveiaents, the
local co tribution is $203,093 for this project.

Bay Wes , Inc. 's application proposes to create up to 60 new jobs, none of
which ould be a transfer fran another Minnesota municipality. The
propos 1 will not result in the abandonment or demolition of other
proper owned by the applicant in Saint Paul, which could potentially
cause reduction in the assessed value of existing property within the
City.
