WHEREAS, t e Division of Public Health has requested the City Council to
hold a public he ring to consider the advisability and necessity of the repair
or wrecking and emoval of a mostly boarded, abandoned, fire damaged, two story,
wood frame comme cial building located on property hereafter referred to as the
"Subject Proper y" and commonly known as 1179 Minnehaha Avenue East. This
Abstract propert is legally described as:
Lot 16, an the Westerly 6 feet of Lot 17, Block 2, of E.C. Bowen's
Addition, according to the recorded plat thereof, and situate in
Ramsey Co nty, Minnesota.
WHEREAS, ba ed upon the records in the Ramsey County Recorder's C�ffice on
July 3, 1990 and other information available to the Division of Public Health on
or before Augus 20, 1990, the following persons are owners, interested and/or
responsible par ies of the Subject Property: George Tortorelis, 1784 Ford
Parkway, St. Pa 1, MN 55116-2141; Ethel J. Tortorelis, 1784 Ford Parkway, St.
Paul, MN 5511 -2141 ; Robert J. Patient, 1250 Norwest Center, St. Paul, MN
55101 ; The Offi e of the Manager, 138 Courthouse, Revenue Division, Real Estate
Tax-Delinquent, St. Paul, MN 55101 ; Northwestern State Bank, Mortgage
Department, Att : Rachael Lund, 55 E. 5th Street, St. Paul, MN 55101.
The addre ses of the above noted persons were obtained f rom various sources
including the t x records, phone books, mortgage companies, etc. ; and
WHEREAS, he Division of Public Health has issued an order identified as
an "Abandoned uilding Notice" dated July 11 , 1990 which is attached and
incorporated as part of this Resolution by this reference. This order was served
in accordance w"th the provisions of Chapter 45 of the Saint Paul Legislative
Code on all owne s, interested and/or responsible parties of the Subject Property
then known to he enforcement officer. The notice and order informed these
parties that th mostly boarded, abandoned, fire damaged, two story, wood frame
commercial buil ing located on the Subject Property is an abandoned building and
a nuisance purs ant to Sections 45.01, Subd. 1 and 45.02, Subd. 11 of the Saint
Paul Legislativ Code. The July 11 , 1990 order also had attached to it a list
of deficiencie regarding the building on the Subject Property, said list is
attached and i corporated as part of this resolution; and
WHEREAS, he July 11, 1990 order informed all then known owners, interested
parties and res onsible parties that they must either repair the structure on the
� Subject Proper y by correcting the list of deficiencies or demolish the
structure, eit er action to take place by August 12, 1990; and

WHEREAS, n action has been taken regarding compliance with the July 11,
1990 notice and rder, and as a result the Division of Public Health requested
that a public he ring be scheduled to take place on Tuesday, October 2, 1990 for
the City Counci to consider the advisability and necessity of ordering the
correction of t e nuisance condition or, in the alternative, to consider the
demolition and r moval of this building; and
WHEREAS, t e above referenced owners, interested and/or responsible parties
have been serve notice of the time, place and purpose of the Tuesday, October
2, 1�90 public h aring before the City Council in accordance with the provisions
of Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
October 2, 1990 nd all testimony and evidence was considered by the Council; now
therefore, be i
RESOLVED, that based upon all of the testimony and evidence presented at
the Tuesday, October 2, 1990 hearing, the Saint Paul City Council hereby adopts
the following Fi dings and Order concerning the building at 1179 Minnehaha Avenue
East:
l. Tha in June of 1987 the building located on the Subject Property
was determined to be unoccupied. ThP build.ing has remained vacant
and has been either open to access or boarded since June of 1987.
2. Tha the owner of the Subject Property has repeatedly failed to
reg ster and pay the vacant building fee for this structure as
req ired by Chapter 43 of the Saint Paul Legislative Code.
3. Tha there are now and have been since June of 1987 multiple
ext .rior Housing CodP or Building Code violations in existence at
the Subject Property,
4. Tha the owners, interested parties and responsible parties of this
bui ding are as previously stated in this resolution. These
ind"viduals have been properly served notice of the Tuesday, October
2 990 hearing concerning this building.

5. Tha on July 11, 1990 an Abandoned Building Notice w�s sent to the
the known owners, interested parties and responsible parties
ord ring these persons to either demolish the building or make
rep irs and cure the list of deficiencies by August 12, 1990.
6. Th t the order of July 11, 1990 has been disregarded by the owners,
interested parties and responsible parties.
7. Th t all owners, interested parties and responsible parties known to
th Division of Public Health have been informed on nu.merous
oc asions of the requirements to repair this structure and have
fa" led to do so.

3. In th event the building is to be demolished by the City of Saint
Paul, all personal property or fixtures of any kind which shall
unrea onably interfere with the demolition and removal shall be
remo d from the building by the owners, interested parties and
respo sible parties by the end of the thirty {30) day time period.
If t e personal property is not so removed, the City of Saint Paul
shall remove and dispose of such property and fixtures as is
prov'ded by law. �
4. IT IS FURTHER ORDERED, that a certified copy of this resolution and
the ncorporated Order and list of deficiencies be mailed to the
last nown address of the owners, interested parties and responsible
part"es pursuant to Section 45 .11, Subdivision (5? of the Saint Paul
Legi lative Code.

The legal description f this Abstract property is:
Lot 16, and the Wester y 6 feet of Lot 17, Block 2, of E.C. Bowen' s Addition, according to
the recorded plat ther of, and situate in Ramsey County, Minnesota.
The building is a most y boarded, abandoned, fire damaged, two story, wood frame
commercial structure.
The subject property h s been unoccupied since June of 1987.
The building meets one or more of the conditions that constitute an Abandoned Building as
defined in Chapter 45 f the Saint Faul Legislative Code.
On July 11 1990 the Di ision of Public Health mailed an order to the then known owners,
interested parties an responsible parties of this building requiring that the building be
either repaired, by correcting the attached list of deficiencies, or demolisred on or
before August 12, 1990. Inasmuch as the orders have not been completed to the
satisfaction of the D' ision and the continued abandoned condition of the building
contributes a blighti g influence and potential hazard to the neighborhood, it is the
recommendation of the ivision that the City Council pass a resolution ordering the
owners, interested an /or responsible parties to either repair or demolish the building in
a timely manner to th satisfaction of the City.
In the event the owne s, interested and/or responsible parties fail to comply with the
Council Resolution, t e Division of i�ublic Health should be authorized to demolish the
building and assess a 1 costs incurred in the demolition against the real estate as a
special assessment to be collected in the same manner as taxes.

aba doned building according to Section 45 .01 , Subd. 1 , of the Saint
Pau Legislative Code in t11at it is "a building or portion thereof
whi h has stood unoccupied for longer than one il) year" and du.ring
tha period of time it has been either "unsecured" , "board.ed" , or
has had "multiple exterior Housing Code or Building Code violations"
or as been placard.ed as "Unfit for Hurnan Habitation" pursuant to
Cha ter 34 of the St. Paul Legislative Code."
9. Th t the mostly boarded, abanctoned, fire damaged, two story, wood
fr e commercial building located on the Subject Property is a
nu'sance as included under Saint Paul Legislative Cod.e Section
45 .02, Subd. 11 , in that it is an abandoned building located in the
Ci y of Saint Paul that has created a dangerous or unhealthy
co dition or which threatens the public peace, health, safety or
saiitary condition of the City or which is offensive or has a
bl ghtinb influence on the community,
10. Th t the costs of abatement of tlzis nuisance are estimated to exceed
tw thousand dollars ($2,000.00} or t11e abatement involves
de olition of a build.ing other than a �tr�icture accessory to a
re idential bu.ilding.
ORDER
The Sain Paul City Council hereby makes the following order:
l . Th above referericed owners, interested parties and responsible
p rties ai►d. their assigns shall make the Subject Property safe and
n t detrimental to the public peace, health, safPty, and welfare atld
r move its blighting influence on the community by rehabilitating
t is structure and correcting those deficiencies set iorth in th��
1 'st previously referenced in accordance with all applicable codes
a d ordinances, or in the alternative by demolishing the structure
a d filling the site in accordance with all applicable codes and
o dinances. The rehabilitation or demolition of the structure must
