WHEREAS, he Division of Public Health has requested the City Council to
hold a public h aring to consider the advisability and necessity of the repair
or wrecking and removal of a two story, wood frame, fire damaged, single family
house located o property hereafter referred to as the "Subject Property" and
commonly known as 444 Bidwell Street. This Abstract property is legally
described as:
The North 26 feet of Lot 3, Block 58 West St. Paul, together with
the appur enant easement(s) contained in Document No. 1160570.
WHEREAS, ba ed upon the records in the Ramsey County Recorder's Office on
July 3, 1990 an other information available to the Division of Public Health on
or before Augus 22, 1990, the following persons are owners, interested and/or
responsible par ies of the Subject Property: Dennis Burandt, 11550 Co. Rd 33,
Young America, N 55397; Margaret Burandt, 11550 Co. Rd 33, Young America, MN
55397; Tim W. W llett, 209 14th Avenue North, South St. Paul, MN 55075; Stephen
M. Tschida, (ad ress unknown) ; Midwest Savings, 801 Nicollet Mall, Minneapolis,
MN 55402; Fe eral Home Loan, Mortgage Company, Central States Division,
Department 07, 1771 Business Center Drive, Reston, VA 22090.
The addre ses of the above noted persons were obtained from various sources
including the tax records, phone books, mortgage companies, etc. ; and
WHEREAS, the Division of Public Health has issued an order identified as
an "Abandoned Building Notice" dated June 28, 1990 which is attached and
incorporated as part of this Resolution by this reference. This order was served
in accordance ith the provisions of Chapter .45 of the Saint Paul Legislative
Code on all own rs, interested and/or responsible parties of the Subject Property
then known to he enforcement officer. The notice of June 28, 1990 and order
informed these parties that the two story, �aood frame, fire damaged, single
family house 1 cated on the Subject Property is an abandoned building and a
nuisance pursu nt to Sections 45.01 , Subd. 1 and 45.02, Subd. 11 of the Saint
Paul Legislati e Code. The order also had attached to it a list of deficiencies
regarding the house on the Subject Property, said list is attached and
incorporated a part of this resolution; and
WHEREAS, the June 28, 1990 order informed all then known owners, interested
parties and res onsible parties that they must either repair the structure on the
Subject Prope ty by correcting the list of deficiencies or demolish the
structure, eit er action to take place by July 29, 1990; and

WHEREAS, o action has been taken regarding compliance with the June 28,
1990 notice an order, and as a result the Division of Public Health requested
that a public h aring be scheduled to take place on Tuesday, October 2, 1990 for
the City Counc 1 to consider the advisability and necessity of ordering the
correction of he nuisance condition or, in the alternative, to consider the
demolition and emoval of this house; and
WHEREAS, he above referenced owners, interested and/or responsible parties
have been serve notice of the time, place and purpose of the Tuesday, October
2, 1990 public earing before the City Council in accordance with the provisions
of Chapter 45 o the Saint Paul Legislative Code; and

WHEREAS, hearing was held before the Saint Paul City Council on Tuesday,
October 2, 1990 nd all testimony and evidence wac considered by the Council; now
therefore be it

RESOLVED, that based upon all of the testimony and evidence presented at
the Tuesday, Oc ober 2, 1990 hearing, the Saint Paul City Council hereby adopts
the following F"ndings and Order concerning the house at 444 Bidwell Street:
1 . Tha in March of 1987 the house located on the Subject Property was
determined to be unoccupied. The house has remained vacant and has
bee either open to access or boarded since March of 1990.
2. Th t the Division of Public Health of the City of Saint PaLil
co emned this structure as "Unfit for Human Habitation" under
Ch ter 34 of the Saint Paul Legislative Code in June of 1990. This
building is still subject to that condemnation order.
3. Th t since March of 1987 the City of Saint Paul has on one occasion
is� ed an order to the owners to make this house secure and not
accessible. Because of the inaction on the part of the owners, the
City had to hire a private contractor to make the house secure.
4. Th t the owners of the Subject Property have failed to register and
pa the vacant building fee for this structure as requi_red by
Ch pter 43 of the Saint Paul Legislative Code.
5 . Th t there are now and have been since March of 1987 multiple
ex erior Housing Code or Building Code violations in existence at
th Subject Property.
6. Th t the owners, interested parties and responsible parties of this
ho se are as previously stated in this resolution and have been
pr perly served notice of the Tuesday, October 2, 1990 hearing
co cerning this house.
7. Th t on June 28, 1990 an Abandoned Building Notice was sent to the
th n known owners, interested parties and responsible parties
or ering these persons to either demolish the house or make repairs
an cure the list of deficiencies by July 29, 1990.
8. Th t the order of June 28, 1990 has been disregarded by the owners,
in erested parties and responsible parties.

9. Tha all owners, interested parties and responsible parties known to
the Division of Public Health on or before June 28, 1990 have been
inf rmed of the requirements to repair this structure and have
fai ed to do so.
10. Tha the two story, wood frame, fire damaged, single family house
loc ted on the Subject Property is an abandoned building according
to Section 45.01, Subd. 1, of the Saint Paul Legislative Code in
tha it is "a building or portion thereof which has stood unoccupied
for longer than one {1) year" and during that period of time it has
bee either "unsecured", "boarded", or has had "multiple exterior
Hou ing Code or Building Code violations" or has been placarded as
"Un it for Human Habitation" pursuant to Chapter 34 of the St. Paul
Leg'slative Code."
11. Tha the two story, wood frame, fire damaged., single family house
loc ted on the Subject Property is a nuisance as included under
Sai t Paul Legislative Code Section 45.02, Subd. 11 , in that it is
an abandoned building located in the City of Saint Paul that has
cre ted a dangerous or unhealthy condition or which threatens the
public peace, health, safety or sanitary conclition of the City or
whi h is offensive or has a blighting influence on the community.
12. Tha the costs of abatement of this nuisance are estimated to exceed
two thousand dollars {52,000.00) or the abatement involves
dem lition of a building other than a structure accessory to a
res'dential building.
ORDER
The Saint Paul City Council hereby makes the following order:
1 . The above referenced owners, interested parties and responsible
pa ties and. their assigns shall make the Subject Property safe and
not detrimental to the public peace, health, safety, and welfare and
re ve its blighting influence on the community bv rehabilitating
thi structure and correcting those deficiencies set forth in the
list previously referenced in accordance with all applicable codes
and ordinances, or in the alternative by demolishing the structure
an filling the site in accordance with all applicable codes and
or inances. The rehabilitation or demolition of the structure must
be omplPted within thirty {30) days of the date of mailing of this
resolution.
2. If the above corrective action ic not completed within the thirty
i30) day time period, the p.roper City officials of the City of Saint
Patl are herebv authorized to take whatever steps are necessary to
de olish this structure and fill the site and charoe the costs
in urred againct the Subject Property pursuant to the provisions of
Se tion 45.08 of the Saint Paul Legislative Code.

3. In the event the building is to be demolished by the City of Saint
Pa 1, all personal property or fixtures of any kind which shall
un easonably interfere with the demolition and removal shall be
re oved from the building by the owners, interested parties and
re ponsible "parties by the end of the thirty (30} day time period.
If the personal property is not so removed, the City of Saint Paul
sh 11 remove and dispose of such property and fixtures as is
pr vided by law. �
4. IT IS FURTHER ORDERED, that a certified copy of this resolution and
th incorporated Order and list of deficiencies be mailed to the
la t known address of the owners, interested parties and responsible
pa ties pursuant to Section 45.11, Subdivision (5) of the Saint Paul
Le islative Code.

The legal description of this Abstract property is:

The building is a two story, wood frame, residential structure.
The subject property as been unoccupied since March of 1987.
The building meets on or more of the conditions that constitute an Abandoned Building as
defined in Chapter 45 of the Saint Paul Legislative Code.
On June 28, 1990 the ivision of Public Health mailed an order to the then known owners,
interested parties an responsible parties of this building requiring that the building be
either repaired, by c rrecting the attached list of deficiencies, or demolished on or
before July 29, 1990. Inasmuch as the orders have not been completed to the satisfaction
of the Division and t e continued abandoned condition of the building contributes a
blighting influence a d potential hazard to the neighborhood, it is the recommendation of
the Division that the City Council pass a resolution ordering the owners, interested
and/or responsible pa ties to either repair or demolish the building in a timely manner to
the satisfaction of t e City.
In the event the owne s, interested and/or responsible parties fail to comply with the
Council Resolution, t e Division of Public Health should be authorized to demolish the
building and assess a 1 costs incurred in the demolition against the real estate as a
special assessment to be collected in the same manner as taxes.,

The Division f Public Health has determined that the above noted building is
an abandoned uilding, which Chapter 45 of the Saint Paul Legislative Codes
dPfines as:
"ariy bu lding or portio�i of a building which has stood with an
incompl te e�terior shell for longer than three (3) years or any
buildin or portion thereof which has stood unoceupied for longer than
one (1) year and which meets one or more of the following criteria;
(a) u secured, or
(b) b arded, or
(c) h ving multiple exterior Housing Code or Building Code violations,

(d) p acarded as "Unfit for Human Habitation" pursuant to Chapter 34
o the Saint Paul Legislative Code."
The ordinance further states that an abandoned building is a nuisance and it
may be ordere torn down by the City.
NOTE: If yo do not want to have the City begin action to have the building
torn down, t en the attached list of deficiencies must be repaired or you must
tear the bui ding down on or before July 29, 1990.
Any repair o demolition must be completed in accordance will all applicable
laws.
If the work, is not completed or if you have not torn the building down by the
above date, he Division of Public Health will refer this matter to t11e City
Council to r ceive authority to tear down the building. All costs incurred in
wrecking the building will be charged against the real estate as a speci�l

Ramsey County ecorder's Office. Cornpliance with the attached list of
deficiencies w 11 remove your building from the list of abandoned buildings
but it does no mean that the building cornplies will all applicable Housing
and Building C des.
The date for c mpliance with these orders shall not be extended unless you
receive writte approval f rom the Division of Public Health.
If you wish to have the City tear down your buildin�, vou may do so by
requesting a c nsent form be sent to you f rom our office, signing it and

WHEREAS, the Di ision of Public Health has requested the City Council to hold a public
hearing to consider t e advisability and necessity of the repair or wrecking and removal of
a two story, wood fr me, fire damaged, single family house located on property hereafter
referred to as the 'Subject Property" and commonly known as 444 Bidwell Street. This
Abstract property is legally described as:
The North 26 fe t of Lot 3, Block 58 West St. Paul, together with the appurtenant
easement(s? co tained in Document No. 1160570.
WHEREAS, based upon the records in the Ramsey County Recorder's Office on July 3, 1990
and other informatio available to the Division of Public Health on or before August 22,
1990, the following ersons are owners, interested and/or responsible parties of the Subject
Property: Dennis Bur ndt, 11550 Co. Rd 33, Young America, MN 55397; Margaret Burandt, 11550
Co. Rd 33, Young Ame ica�, MN 55397; Tim W. Willett, 209 14th Avenue North, South St. Paul,

The addresses f the above noted persons were obtained from various sources including
the tax records, ph ne books, mortgage companies, etc. ; and
WHEREA5, the D'vision of Public Health has issued an order identified as an Abandoned

Building Notice" da ed June 28, 1990 which is attached and ,incorporated as part of this
Resolution by this eference. This order was served in accordance with the provisions of
Chapter 45 of the S int Paul Legislative Code on al,l owners, interested and/or responsible
parties of the Subj ct Property then known to the enforcement officer. The notice of June
28, 1990 and order informed these parties that the two story, wood frame, fire damaged,
single family house located on the Subject Property is an abandoned building and a nuisance
pursuant to Section 45 .01, Subd. 1 and 45.02, Subd. 11 of the Saint Paul Legislative Code.
The order also had ttached to it a list of deficiencies regarding the house on the Subject
Property, said list is attached and incorporated as part of this resolution; and
WHEREAS, the une 28, 1990 order informed all then known owners, interested parties and
responsible parties that they must either repair the structure on the Subject Property by
correcting the list of deficiencies or demolish the structure, either action to take place
by July 29, 1990; d
WHEREAS, no tion has been taken regarding compliance with the June 28, 1990 notice
and order, and as a result the Division of Public Health requested that a public hearing be
� scheduled to take lace on Tuesday, October 2, 1990 for the City Council to consider the
advisability and n cessity of ordering the correction of the nuisance condition or, in the
alternative, to co sider the demolition and removal of this house; and

WHEREAS, the ab ve referenced owners, interested and/or responsible parties had been
served notice of the ime, place and purpose of the Tuesday, October 2, 1990 public hearing
before the City Counc ' 1 in accordance with the provisions of Chapter 45 of the Saint Paul
Legislative Code; and
WHEREAS, Chapte 45.11 (Subd. 4) of the Saint Paul Legis}.ative Code requires that at
least ten days prior o the hearing, the enforcement officer shall notify the owner and all
interested parties by personal service of the notice upon the owner or his duly authorized
representative and upon each interested party or his duly authorized representative; and
WHEREAS, on Oct ber 1 , 1990 it was determined that Tony G. Simon, 500 Main Street North
East, Minneapolis, MN 55413 was listed in the records of the Ramsey County Recorder's Office
as a contract purcha er of 444 Bidwell Street and that he had not been served notice of the
October 2, 1990 publ 'c hearing; and
WHEREAS, the C ty Council, upon the request of the Division of Public Health, at the
October 2, 1990 publ c hearing laid this matter over until October 23, 1990 to provide the
Division of Public ealth sufficient time to notify Tony G. Simon and all other owners,
interested and respo sible parties of the time, place and purpose of the Tuesday, October 23,
1990 public hearing efore the City Council in accordance with the provisions of Chapter 45
of the Saint paul Le islative Code; and
WHEREAS, a hea ing was held before the Saint Paul City Council on Tuesday, October 23,
1990 and all testimo y and evidence was considered by the Council; now therefore be it
RESOLVED, that based upon all of the testimony and evidence presented at the Tuesday
October 2, 1990 pub ic hearing, the Saint Paul City Council hereby adopts the following
Findings and Order c ncerning the house at 444 Bidwell Street:
l . That in arch of 1987 the house located on the Subject Property was determined
to be u occupied. The house has remained vacant' and has been either open to
access r boarded since March of 1990. ,
2. That th Division of Public Health of the City of Saint Paul condemned this
structu e as "Unfit for Human Habitation" under Chapter 34 of the Saint Paul
Legisla ive Code in June of 1990. This building is still subject to that
condemn tion order.
3. That si ce March of 1987 the City of Saint Paul has on one occasion issued an
order t the owners to make this house secure and not accessible. Because of the
inactio on the part of the owners, the City had to hire a private contractor to
make th house secure.
4. That t e owners of the Subject Property have failed to register and pay the
vacant uilding fee for this structure as required by Chapter 43 of the Saint
Paul Le islative Code.
5. That t ere are now and have been since March of 1987 multiple exterior Housing
Code o Building Code violations in existence at the Subject Property.

6. That the wners, interested parties and responsible parties of this house are as
previousl stated in this resolution and have been properly served notice of the
Tuesday, ctober 2, 1990 public hearing concerning this house.
7. That on une 28, 1990 an Abandoned Building Notice was sent to the then known
owners, 'nterested parties and responsible parties ordering these persons to
either d molish the house or make repairs and cure the list of deficiencies by
July 29, 1990.
8. That the order of June 28, 1990 has been disregarded by the owners, interested
parties nd responsible parties.
9. That all wners, interested parties and responsible parties known to the Division
of Publ �c Health on or before June 28, 1990 have been informed of the
requirem nts to repair this structure and have failed to do so.
10. That the two story, wood frame, fire damaged, single family house located on the
Subject roperty is an abandoned building according to Section 45.01 , Subd. 1 ,
of the S int Paul Legislative Code in that it is "a building or portion thereof
which ha stood unoccupied for longer than one tl) year" and during that period
of time t has been either "unsecured", "boarded", or has had "multiple exterior
Housing ode or Building Code violations" or has been placarded as "Unfit for
Human Ha itation" pursuant to Chapter 34 of the St. Paul Legislative Code."
11. That the two ctory, wood frame, fire damaged, single family house located on the
Subject Property is a nuisance as included under Saint Paul Legislative Code
Section 5.02, Subd. 11 , in that it is an abandoned building located in the City
of Sain Paul that has created a dangerous or unhealthy condition or which
threate s the public peace, health, safety or sanitary condition of the City or
which i offensive or has a blighting influence on the community.
12. That the costs of abatement of this nuisance are estimated to exceed two thousand
dollars ($2,000.00) or the abatement involves demolition of a building other than
a struc ure accessory to a residential building.
ORDER
The Saint Pau City Council hereby makes the following order:
1 . The abo e referenced owners, interested parties and responsible parties and their
assigns shall make the Subject Property safe and not detrimental to the public
peace, ealth, safety, and welfare and remove its blighting influence on the
communi y by rehabilitating this structure and correcting those deficiencies set
forth i the list previously referenced in accordance with all applicable codes
and ord'nances, or in the alternative by demolishing the structure and filling
the si e in accordance with all applicable codes and ordinances. The
rehabil 'tation or demolition of the structure must be completed within thirty
(30) da s of the date of mailing of this resolutioi►.
2. If the bove corrective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Paul are hereby authorized
to take whatever steps are necessary to demolish this structure and fill the site
and ch rge the costs incurred against the Subject Property pursuant to the
provis'ons of Section 45 .08 of the Saint Paul Legislative Code.

3. In the e nt the building is to be demolished by the City of Saint Paul, all
personal roperty or fixtures of any kind which shall unreasonably interfere with
the demol 'tion and removal shall be removed from the building by the owners,
intereste parties and responsible parties by the end of the thirty t30) day time
period. f the personal property is not so removed, the City of Saint Paul shall
remove an dispose of such property and fixtures as is provided by law.
4. IT IS F RTHER ORDERED, that a certified copy of this resolution and the
incorpor ted Order and list of deficiencies be mailed to the last known address
of the o ners, interested parties and responsible parties pursuant to Section
45.11 , S bdivision (5) of the Saint Paul Legislative Code.

The Division f Public Health has determined that the above noted building is
an abandoned uilding, which Chapter 45 of the Saint Paul Legislative Codes
defines as:
"any bu' lding or portion of a building w�hich has stood with an

buildi or portion thereof which has stood unoccupied for longer than
one (1) year and which meets one or more of the following criteria;

The ordinanc further states that an abandoned building is a nuisance and it
may be order d torn down by the City.
NOTE: If yo do not want to have the City begin action to have the building
torn down, t en the attacYied list of deficiencies must be repaired or you must
tear the building down on or before July 29, 1990.
Any repair or demolition must be completed in accordance will all applicable
laws.
I.f the work, is not corripleted or if you have not torn the building down by the
above date, the Division of Public Health wil.l refer this matter to the City
Council to eceive authority to tear down the building. All costs incurred in

Resolution dec aring this property to be a nuisance shall be on file in the
Ramsey County ecorder's Off ice. Cornpliance with the attached list of
deficiencies w 11 remove your building from the list of abandoned buildings
but it does no mean that the building complies will all applicable Housing
and Building C des. '
The date for c rnpliance with these orders shall not be extended unless you
receive writte approval from the Division of Public Health.
If you wish to have the City tear down yaur building, you may do so by
requesting a c nsent form be sent to you from our office, signing it and
returning i� to us. However, please be aware that all owners and interested
parties must ign the form before the City can tear the buildir►g down without
a City Counci order. Also be aware that the cost of the demolition, if
performed hy he City, would become a special assessment against the property.

WHEREAS, t e Division of Public Health has requested the City Council to
hold a public he ring to consider the advisability and necessity of the repair
or wrecking and r moval of a two story, wood frame, fire damaged, single family
house located on property hereafter referred to as the "Subject Property" and
commonly known s 444 Bidwell Street. This Abstract proper•ty is legally

WHEREAS, bas d upon the records in the Ramsey County Recorder's Office on
July 3, 1990 and ther information available to the Divisior� of Public Health on
or before August 22, 1990, the following persons are owners, interested and/or
responsible part es� of the Subject Property: Dennis Burandt, 11550 Co. Rd 33,
Young America, M 55397; Margaret Burandt, 11550 Co. Rd 33, Young America, MN
55397; Tim W. Wi lett, 209 14th Avenue North, South St. Paul, MN 55075; Stephen

The addres es of the above noted persons were obtained from various sources
including the t records, phone books, mortgage companies, etc. ; and
WHEREAS, t e Division of Public Health has issued a�i order identified as
an "Abandoned uilding Notice" dated June 28, 1990 which is attached and
incorporated as art of this Resolution by this reference. This order was served
in accordance w th the provisions of Chapter .45 of the Saint Paul Legislative
Code on all owne s, interested and/or responsible parties of the Subject Property
then known to t e enforcement officer. The notice of June 28, 1990 and order
informed these arties that the two story, wood frame, `fire damaged, single
family house lo ated on the Subject Property is an abandoned building and a
nuisance pursua t to Sections 45.01 , Subd. 1 and 45.02, �ubd. 11 of the Saint
Paul Legislativ Code. The order also had attached to it a list of deficiencies
re;arding the ouse on the Subject Property, said list is attached and
- incorporated as part of this resolution; and
WHEREAS, he June 28, 1990 order informed all then kndwn owners, interested
parties and res onsible parties that they must either repair the structure on the
Subject Proper y by correcting the list of deficiencies or demolish the
structure, eith r action to take place by July 29, 1990; and

WHEREAS, no action has been taken regarding compliance with the June 28,
1990 notice and order, and as a result the Division of Public Health requested
that a public hearing be scheduled to take place on .Tuesday, October 2, 199Q for
the City Council to consider the advisability and necessity of ordering the
correction of the nuisance condition or, in the alternative, to consider the
demolition and removal of this house; and �
WHEREAS, the above referenced owners, interested and/or responsible parties
have been served notice of the time, place and purpose of the Tuesday, �ctober
2, 1990 public hearing before the City Council in accordance with the provisions
of Chapter 45 of the Saint Paul Legislative Code; and

` WHEREAS,�a hearing was held before the Saint Paul City Council on Tuesday,
October 2, 1990 and all testimony and evidence was considered by the Council; now
therefore be it •

RESOLVED, that based�upon all of the testimony and evidence presented at
the Tuesday, October 2, 1990�hearino, the Saint Paul City Council hereby adopts
the following Findings and Order concerning the house at 444 Bidwell Street:
1. That in March of 1987 the house located on the Subject Property was
determined to be unoccupied. The house has remained vacant and has
been either open to access or boarded since March of 19�0.
2. That the Division of Public Health of the City of Saint Paul
condemned this structure as "Unfit for Human Habitation" under
Chapter 34 of the Saint Paul Legislative Code in June of 1990. This
building is still subject to that condemnation order.
3. That since March of 1987 the City of Saint Paul has on one occasion
issued an order to the owners to make this house secure and not
accessible. Because of the inaction on the part of the owners, the
City had to hire a private contractor to make the house secure.
4. That the owners of the Subject Property have failed to register and
pay the vacant building fee for this structure as required by
Chapter 43 of the Saint Paul Legislative Code.
5. That there are now and have bPen since March of 1987 multiple
exterior Housing Code or Building Code violations in existence at
the Subject Property.
6. That the owners, interested parties and responsible parties of this
house are as previously stated in this resolution and have been
properly served notice of the Tuesday, October 2, 1990 hearing
concerning this house.
7. That on June 28, 1990 an Abandoned Buildin; Notice was sent to the
then known owners, interested parties and responsible parties
ordering these persons to either demolish the house or make repairs
and cure the list of deficiencies by July 29, 1990.
8. That the order of June 28, 1990 has been disregarded bv the owners,
interested parties and responsible parties.
