1 RESOLVED, that upon the petition of Gary W. Stockwell, per Department of Technology and Management
2 Services File Number 7-1998, public properties hereinafter described are hereby vacated and discontinued as
3 public property; and, subject to the herein stated exceptions, the easements within those public properties are
4 hereby released.
The vacated area is described as follows:

That part of MACKUBIN STREET from the North line of Hoyt Avenue to the South line of
Idaho Avenue.

11 This vacation shall be subjec� to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for this
vacation which is due and payable within 6Q days of the effective date of this resolution.
That a penmanent utility easement shall be retained on behalf of the City of Saint Paul, Department
of Public Works on, over, under and across the following described area to allow access to existing
sewer mains;
That part of Mackubin Street lying southerly of the westerly extension of the north line of Lot
1, Biock 5 of Edwin M. Ware's Cumberland Addition and northeriy of the following
described line:
Beginning at the northwesterly corner of said L.ot 1, Biock 5 of Edwin M. Ware's
Cumberland Addition; thence southwesterly to a point on the west line of Mackubin
Street 40.00 feet southerly of the intersection of the westerly extension of said north
line of Lot 1, Slock 5 with the westerly line of Mackubin Street.
and sha11 be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance putposes
will be permitted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration and

costs of such improvements shall be the sole responsibility of the petitioner, its successors p � q

e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless the City
of 3aint Paul, its officers, agents, employees, and servants from all suits, actions, or claims
which shall arise from any injuries or damages received or sustained by any break in any
service pipe or connecuon in said reserved easement arising out of or resuiting from any
action or negligence of the petitioner, its employees, agents, or business invitees.
No change from the existing grade within the easement area will be permitted without written
permission from the Department of Public Works.
No change in surfacing within the easement azea will be pemutted without written
permission from the Department of Public Works.
16 3. That the petitioners, their successors, and assigns, agree to indemnify, defend and save hanmless the
17 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
18 brought as a result of injuries or damages received or sustained by any person, persons, or property
19 on account of this vacation or petitioner's use of this property, including but not limited to a claim
20 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
21 claims or liability azising from any violation of any law or regulation made in accordance with the
22 law, whether by the petitioner or any of their agents or employees

24 4. That the petitioners, their successors, and assigns, shall within 60 days of the effective date of this
25 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and
26 shall within the period(s) specified in the terms and conditions of this resolution, comply in a11
27 respects with these terms and conditions.

I am requesting a date of October 7, 1498, for a public heazing to approve the attached Council
Resolution. The puipose of the resolution is to vacate part of Mackubin Street from Idaho to
Hoyt to allow the vacated azea to accrue to the adjoining properties.
The utilities and City offices with rights to the subject azea have a11 responded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed for
signatures. The resolution is currently in Peter Hames' office.
I have enclosed photocopies of the Green Sheet, the Council Resolution, and a map of the area to
be vacated. Please let me know if there is anything else you might need for this.

1) That a permanent sewer easement shall be retained on, over, under, and
across, the following described area, to allow access to existing sewer mains:
That part of Mackubin Street lying southerly of the westerly extension of the
north line of Lot 1, Block 5 of Edwin M. Ware's Cumberland Addition and
northerly of the following described line:
Beginning at the northwesterly corner of said Lot 1, Block 5 of Edwin M. Ware's
Cumberland Addition; thence southwesterly to a point on the west line of
Mackubin Street 40.00 feet southerly of the intersection of the westerly
extension of said north line of Lot 1, Block 5 with the westerly line of Mackubin

vacation which is due and payable within 6Q days of the effective date of this resolution.
That a penmanent utility easement shall be retained on behalf of the City of Saint Paul, Department
of Public Works on, over, under and across the following described area to allow access to existing
sewer mains;
That part of Mackubin Street lying southerly of the westerly extension of the north line of Lot
1, Biock 5 of Edwin M. Ware's Cumberland Addition and northeriy of the following
described line:

a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any

exercising its reserved rights may be allowed by obtaining written permission from the

permission from the Department of Public Works.

20 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
21 claims or liability azising from any violation of any law or regulation made in accordance with the

I am requesting a date of October 7, 1498, for a public heazing to approve the attached Council
Resolution. The puipose of the resolution is to vacate part of Mackubin Street from Idaho to
Hoyt to allow the vacated azea to accrue to the adjoining properties.
The utilities and City offices with rights to the subject azea have a11 responded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed for
signatures. The resolution is currently in Peter Hames' office.
I have enclosed photocopies of the Green Sheet, the Council Resolution, and a map of the area to
be vacated. Please let me know if there is anything else you might need for this.

The Department of Public Works has no objections to this vacation subject to
the folfowing:
1) That a permanent sewer easement shall be retained on, over, under, and
across, the following described area, to allow access to existing sewer mains:
That part of Mackubin Street lying southerly of the westerly extension of the
north line of Lot 1, Block 5 of Edwin M. Ware's Cumberland Addition and
northerly of the following described line:
Beginning at the northwesterly corner of said Lot 1, Block 5 of Edwin M. Ware's
Cumberland Addition; thence southwesterly to a point on the west line of
Mackubin Street 40.00 feet southerly of the intersection of the westerly
extension of said north line of Lot 1, Block 5 with the westerly line of Mackubin

2) The petitioner shall pay all costs and expenses for any reconstruction of the
intersection which may be necessary to properly eliminate the appearance of

satisfaction of the Department of Public Works.

1 RESOLVED, that upon the petition of Gary W. Stockwell, per Department of Technology and Management
2 Services File Number 7-1998, public properties hereinafter described are hereby vacated and discontinued as
3 public property; and, subject to the herein stated exceptions, the easements within those public properties are

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for this
vacation which is due and payable within 6Q days of the effective date of this resolution.
That a penmanent utility easement shall be retained on behalf of the City of Saint Paul, Department
of Public Works on, over, under and across the following described area to allow access to existing
sewer mains;
That part of Mackubin Street lying southerly of the westerly extension of the north line of Lot
1, Biock 5 of Edwin M. Ware's Cumberland Addition and northeriy of the following
described line:
Beginning at the northwesterly corner of said L.ot 1, Biock 5 of Edwin M. Ware's
Cumberland Addition; thence southwesterly to a point on the west line of Mackubin
Street 40.00 feet southerly of the intersection of the westerly extension of said north
line of Lot 1, Slock 5 with the westerly line of Mackubin Street.
and sha11 be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance putposes
will be permitted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration and

action or negligence of the petitioner, its employees, agents, or business invitees.
No change from the existing grade within the easement area will be permitted without written
permission from the Department of Public Works.
No change in surfacing within the easement azea will be pemutted without written
permission from the Department of Public Works.
16 3. That the petitioners, their successors, and assigns, agree to indemnify, defend and save hanmless the
17 City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
18 brought as a result of injuries or damages received or sustained by any person, persons, or property
19 on account of this vacation or petitioner's use of this property, including but not limited to a claim
20 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
21 claims or liability azising from any violation of any law or regulation made in accordance with the
22 law, whether by the petitioner or any of their agents or employees

25 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and

Resolution. The puipose of the resolution is to vacate part of Mackubin Street from Idaho to

The utilities and City offices with rights to the subject azea have a11 responded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed for
signatures. The resolution is currently in Peter Hames' office.
I have enclosed photocopies of the Green Sheet, the Council Resolution, and a map of the area to

across, the following described area, to allow access to existing sewer mains:
That part of Mackubin Street lying southerly of the westerly extension of the
north line of Lot 1, Block 5 of Edwin M. Ware's Cumberland Addition and
northerly of the following described line:
Beginning at the northwesterly corner of said Lot 1, Block 5 of Edwin M. Ware's
Cumberland Addition; thence southwesterly to a point on the west line of
Mackubin Street 40.00 feet southerly of the intersection of the westerly
extension of said north line of Lot 1, Block 5 with the westerly line of Mackubin
