1 WHEREAS, there is call or initiatives to restore the Civil Rights set aside legislation at national,
2 state and local levels; and

4 WHEREAS, local jurisdi ions within the State of Minnesota have a long history of policies
5 intended to oppose and d smantle discrimination based on race, color, national origin, sex, and
6 disability; and
7
8 WHEREAS, among thes policies are long-standing programs designed to set aside portions of
9 public contracting awards for businesses owned and operated by minorities, women, and disabled
10 persons; and
11
12 WHEREAS, such set asi e programs are an effective and appropriate means of addressing past
13 discrimination, both publ' and private; and
14
15 WHEREAS, the U.S. Su reme Court has struck down many existing state and municipal set aside
16 programs, and has establ' hed a strict evidentiary standard for state and local jurisdictions which
17 seek to establish such pr grams; and
18
19 WHEREAS, existing set ide programs in Minnesota have been adversely affected as a result of
20 the Court's decision; NO , THEREF4RE, BE IT

22 RESOLVED, that the St Paul City Council will�join with the Minneapolis City Council, Ramsey
23 County Board of Commi sioners, Hennepin County Board of Commissioners, Minneapolis Board of
24 Education and St.Paul B ard of Education to jointly commission a disparity study, having as its
25 purpose the collection of information relevant to discrimination based on race, se� and disability
26 which may exist in contr cting practices, both past and present the in public sector purchasing�
27 within the several jurisdi ions.
