WHEREAS the Division of Public Health has requested the City Council to
hold. a publi hearing to consider the advisability and necessity of the
correction or wrecking and removal of a fire damaged, dilapidated, wood frame,
one and one—h lf story single family house located on property hereafter referred
to as the "Su ject Property" and commonly known as 109 West Hawthorne Avenue.
This Abstract property is legally described as:
Lot 26, Block 6, Wifelberg Hills, according to the recorded plat
thereof and situate in Ramsey County, Minnesota
WHEREAS� 8SP_(I upon the records in the Ramsey County Recorder's Office on
June 27, 1990 he following persons are owners, interested. parties or responsible
parties of th Subject Property: Thomas LaRose (Deceased in 1970 in Minnesota—
according to is son Miles LaRose) ; Emma LaRose, 2237 Co?nmonwealth Avenue, St.
Paul, MN 5510 (nursing home} ; Miles LaRose, 2531 Nokomis, St. Paul, MN 55119
The addi sses of the above noted persons were obtained from various sources
including the ta� records, phone books, mortgage companies, etc. ; and
WHEREAS, the Division of Public Health has issued an order identified as
an "Abandoned Building Notice" dated Mav 14, 1990 which is attached and
incorporated a part of this Resolution by this reference. This order was served
in accordance with the provisions of Ch�pter 45 of the Saint Paul Legislative
Code on all o ners, interested parties and responsible parties of the Subject
Property known to the enforcement officer. The notice and order informed these
parties that t e fire damaged, dilapidated, wood. frame, one and one—half story
single family ouse located on the Subject Property is an abandoned building and
a mtisance pur-uant to Sections 45.01, Subd. 1 and 45.02, Subd. 11 of the Saint
Paul Legislati e Code. The May 14, 1990 order also had attached to it a list of
deficiencies r barding the house on the Subject Property, s�.id list is attached
and incorporat d as part of this resolution; and
WHEREAS, the May 14, 1990 order informed all known owners, interested
parties and re ponsible parties that they must either repair the structure on the
Subject Prope ty by correcting the list of deficiencies or demolish the
structure, eit er action to take place by June 14, 1990; and
WHEREAS, no action has been taken regarding compliance with the May 14,
1990 notice an order, and �.s a result the Division of Public Health requested
that a public earing be scheduled to take place on August 30, 1990 for the City
Council to con ider the advisability and necessity of ordering the correction of
the nuisance c ndition or, in the alternative, to consider the demolition and
removal of thi house; and

WHEREAS, the above referenced owners, interested parties and responsible
parties have een served notice in accordance with the provisions of Chapter 45
of the Saint Paul Legislative Code, of the time and purpose of the August 3Q,
1990 hearing efore the Council; and
WHEREAS, a hearing was held before the Saint Paul City Council on August
3Q, 1990 and 11 testimony and evidence was considered hy the Council.
NOW THE EFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence pres nted at the August 30, 1990 hearing, the Saint Paul City Council
hereby adopts the following Findings and Ord.er concerning the house at 109 West
Hawthorne Ave ue:
l . T at in Decernber of 1986 the house located on the Subject Property
w s determined to be unoccupied. The house has remained vacant and
h s been either open to access or board.ed since December of 1986.
2. T at since December of 1986 the City of Saint P�ul has on numerous
o c�sions icsued orders to the owners to make this house secure and
n t accessible.
3. T at the owners of the Subject Property have repeatedly failed to
r gister and pay the vacant building fee for this structure as
i quired by Chapter 43 of the Saant Paul Legislative Code.
4. T at there are now and have been since December of 1986 multiple
e terior Housing Code or Buildino Code violations in existence at
t e Subject Property.
5. T at the owners, interested parties and responsible parties of this
ho .se are as previously stated. in this resolution. These
in ividuals have been properly served notice of the August 30, 1990
he ring concerning this house.
6. Th t on May 14, 1990 �n Abandoned Building Notice was sent to the
ow ers, interested parties and iesponsible parties ordering these
pe sons to either demolish the house or make repairs and cure the
li t of deficiencieG by June 14, 1990.
?. Th t the order of May 14, 1990 has been disregarded by the ow�ners,
in erested parties and. responsible parties.
8. Th t all o�ners, interested parties and responsible parties known to
th Division of Public Health have heen informed on numerous
oc �sions of the req�tirements to repair this structure and have
fa led to do so.
9. Th t the fire d.amaged, dilapidated, wood fr�me, one and one-half
st ry single family house located. on the Subject Property is an

a andoned building according to Section 45.01, Subd. 1, of the Saint
P ul Legislative Code in that it is "a buildin; or portion thereof
w ich has stood unoccupied for longer than one (1) year" and it has
b en either "uncecured", "boarded", or has had "multiple exterior
H using Code or Buildinb Code violations" or has been placarded as
" nfit for Human Habitation" pursuant to Chapter 34 of the St. Paul
Leaislative Code,
10. T at the fire damaged, dilapidated, wood frame, one and one-half
st ry single family house located on the Subject Property is a
n isance as included under Saint Paul Legislative Cod.e Section
45 .02, Subd. 11, in that it is an abandoned building located in the
Ci y of Saint Paul that has created a dangerous or unhealthy
co dition or which threatens the public peace, health, safety or
sa itary condition of the City or which is offensive or has a
bl 'ohting influence on the community.
11. Th t the costs of abatement of this nuisance are ectimated to exceed
tw thousand dollars {$2,0OO,OQ) or the abatement involves
de .olition of a building other than � structure accessory to a
re idential building.
ORDER
The Sain Paul City Cotincil hereby makes the following order:
l. Th above referenced owners, interested parties and responsible
pa ties and. their assigns shall make the Subject Property safe and
no detrimental to the public peace, health, safety, and welfare and
re_ ove its blighting influence on the community by rehabilitating
th s structure and correcting those deficiencies set forth in the
li t previously referenced. in accordance with all applicable codes
an ordinances, or in the alternative by demolishinb the structure
an filling the site in accordance with all applicable codes and
or inances, The rehabilitation or demolition of the structure must
be completed. within thirty {30) days of the date of mailing of this
re olution.
2. If the above corrective action is not completed within the thirty
{3 } day time period, the proper City officials of the City of Saint
Pa 1 are hereby authorized. to take whatever steps are necessary to
de olish this structure and fill the site and charge the costs
in urred against the Subject Property gursuant to the provisions of
Se tion 45 .08 of the Saint Paul Legislative Code,

3. I the event the building is to be demolished by the City of Saint
P Lil, all personal property or fixtures of any kind which shall
u reasonably interfere with the demolition and removal shall be
r moved from the building by the owners, interested parties and
r sponsible -parties by the end of the thirty (30) day time period.
I the personal property is not so removed, the City of Saint Paul
s all remove and. dispose of such property and fixtures as is
p ovided by law. �

WHEREAS, the Division of Public Health ha� requested the City Council to
hold. a publ c hearing to consid.er the �.d.visability and nece��ity of the
correction o wrecking and removal of a fire damaged, dilapidated, wood frame,
one and one-h lf story sinble family house located on propertv hereafter referred
to as the "S bject Property" and commonly known as 109 We�t Hawthorne Avenue.
This Abstract property is legally described. as:
Lot 26, Block 6, Wifelberg Hills, accordino to the recorded plat
thereof, and situate in Ramsey County, Minnesota
WHEREAS, ased upon the records in the Ramsey Countv Recorder's Office on
June 27, 1990 the followino persons are owners, interested. parties or responsible
partiec of th Subject Property: Thomas LaRose (Deceased in 1970 in Minnesota-
according to is son Miles LaRose) ; Emma LaRose, 2237 Coramonwealth Avenue, St.
Paul, MN 551 8 (nursing home? ; Miles LaRose, 2531 Nokomis, St. Paul, MN 55119
The add esses of the above noted persons were obtained. from various sources
includin; the ta� records, phone books, mortgaoe companies, etc. ; and
WHEREAS, the Division of Public Health has issued an order identified. as
an "Abandone Building Notice" dated May 14, 1990 which is attached and
incorporated s part of this Resolution by this reference. This order was served
in accordance with the provisions of Chapter 45 of the Saint Paul Legislative
Code on all wners, interested parties and responsible parties of the Subject
Property know to the enforcement officer. The notice and order informed these
parties that he fire damaged, dilapidated, wood frame, one and one-half story
single family house located on the Subject Property is an abandoned buildino and
a nuisance pu suant to Sections 45 .01 , Subd. l and 45 ,02, Subd. 11 of the Saint
Paul Legislat 've Code. The May 14, 1990 order also had attached to it a list of
deficiencies egarding the house on the Subject Property, c�id li�t is attached.

WHEREAS, the May 14, 1990 order informed all known owners, interested
parties and r sponsible parties that they must either repair the structure on the
Subject Prop rty by correcting the list of deficiencies or demolish the
structure, ei her action to take place by June 14, 1990; and
WHEREAS, no action has been taken regarding compliance with the May 14,
1990 notice a d order, and as a result the Division of Public Health requested
that a public hearing be scheduled to take place on August 30, 1990 for the City
Council to co sider the advisability and necessity of ordering the correction of
the nuisance ondition or, in the alternative, to concider the demolition and
removal of th's house; and
