WHEREAS, the Division of Public Health has requested the City Council to
hold a publ "c hearing to consider the advisability and necessity of the
correction o wrecking and removal of a fire damaged and vandalized two-story
residence loc ted on property hereafter referred to as the "Subject Property" and
commonly kno n as 278 Charles Avenue. This Abstract property is legally
described as:
Lot 1 o Johnson's Addition to St. Paul, also the West 3 feet of Lot
8 of B ock 21 of Robertson and Van Etten's Addition to St, paul,
accordi g to the recorded plat thereof, and situate in Ramsey
County, Minnesota.
WHEREAS, ased. upon the records in the Ramsey County Recorder's Office on May
18, 1990 the following persons are owners, interested parties or responsible
parties of t e Subject Property: Yehia l . Ibrahim, 1903 Silverbell Road 4k220,
Eagan, MN 5 122-3127; Mohamed M. E1-Towely (address unknown) ; Farida F. E1-
Towely (addr ss unknown) ; Richard A. DeSantell (address unknown) ; Easther I.
Rust, formerl Easther I. DeSantell (address unknown) ; First National Bank of
Saint Paul, C 0 First Bank - Minneapolis, Attention Jennifer Whitlock, Consumer

The add esses of the above noted persons were obtained from various sources
includin; the ta� records, phone books, mortgage companies, etc. ; and
WHEREAS the Division of Public Health has issued an ord.er identified as
an "Abandone Building Notice'" dated May ?5, 199Q which is attached and
incorporated s part of this Resolution by this reference. This order was served
in accordance with the provisions of Chapter 45 of the Saint Paul Legislative
Code on all o ners, interested parties and responsible parties of the Subject
Property know to the enforcement officer. The notice and order informed these
parties that he fire damaged and vandalized two-story residence located on the
Subject Prope ty is an abandoned building and a nuisance pursuant to Sections
45.01 , Subd. and 45.02, Subd. 11 of the Saint Paul LegislativP Code. The May
25 , 1990 orde also had attached to it a list of deficiencies regarding the house
on the Subjec Property, said list is attached and incorporated. as part of this
resolution; a d
WHEREAS the May 25, 1990 order informed all known owners, interested
parties and r sponsible parties that they must either repair thP structure on the
Subject Prop rty by correcting the list of deficiencies or demolish the
structure, ei her action to take place by June 25, 1990;

WHEREAS, no action has been taken regarding compliance with the May 25,
1990 notice nd order, and as a result the Division of Public Health requested
that a public hearing be scheduled to take place on August 30, 1990 for the City
Council to co sider the advisability and necessity of ordering the correction of
the nuisance condition or, in the alternative, to consider the demolition and
removal of th"s house; and
WHEREAS, the above referenced owners, interested. parties and responsible
parties have een served notice in accordance with the provisions of Chapter 45
of the Saint Paul Legislative Code, of the time and purpose of the Auguct 30,
1990 hearing efore the Council; and
WHEREAS, a hearing was held before the Saint Paul City Council on August
30, 1990 and_ 11 testimony and evidence was considered by the Council.
NOW THE EFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence pres nted at the Au;ust 30, 1990 hearing, the Saint Paul City Council
hereby adopt_ the following Findings and Order concerning the house at 278
Charles Avenu :
l . T at in December of 1988 the house located on the Subject Property
w s determined to be unoccupied. The house has remained vacant and
h s been either open to access or boarded since December of 1988.
2. T at the Division of Public Health of the City of Saint Paul
c ndemned this structure as "Unfit for Human Habitation" under
C apter 34 of the Saint Paul Legislative Cod.e in November of 1988.
T is building is still subject to that condemnation order.
3. T at since December of 1988 the Ci_tv of Saint Paul has on numerous
o casions issued orders to the owner� to make this house secure and
n t accessible. On many occasions, because of the inaction on the
p rt of the owners, the City has had to hire a private contractor to
m ke the house secure.
4. T at the owners of the Subject Property have repeatedly failed to
r gister and pay the vacant building fee for this structure as
r quired by Chapter 43 of the Saint Paul Legislative Code.
5 , T at there are now and have been since December of 1988 multiple
e terior Housing Code or Building Code violations in existence at
t e Subject Property.
6. T at the owners, interested parties and responsible parties of this
h use are as previously stated in this resolution. These
i dividuals have been properly served_ notzce of the Aubust 30, 1990
h aring concerninb this house.

7. T at on May 25 , 1990 an Abandoned Buildino Notice was sent to the
o ners, interested parties and responsible parties ordering these
p rsons to either demolish the house or make re�airs and cure the
1 'st of deficiencies by June 25, 1990.
8. T at the order of May 25, 1990 has been disregarded by the owners,
i terested parties and responsible parties,
9. T at all owners, interested parties and responsible parties known to
t e Division of Public Health have been informed on numerous
o casions of the requirements to repair this structure and have
f iled to do so.
10. T at the fire damaged and vandalized two-story residence located on
t e Subject Property is an abandoned building according to Section
4 .01, Subd. l, of the Saint Paul Legislative Code in that it is "a
b ilding or portion thereof which has stood unoccupied for longer
t an one (1) year" a.nd has been either "unsecured", "boarded", or
h s had "multiple exterior Housing Code or Building Code violations"
o has been "placarded as "Unfit for Human Habitation" pursuant to
C apter 34 of the St. Paul Legislative Code."
11 . T at the fire damaged and vandalized two-story residence located on
t e Subject Property is a nuisance as included under Saint Paul
Le islative Code Section 45 .02, Subd. 11, in that it is an abandoned
b ilding located in the City of Saint Paul that has created a
da gerous or unhealthy condition or which threatens the public
pe ce, health, safety or sanitary condition of the City or which is
of ensive or has a blighting influence on the community.
12. Th t the costs of abatement of this nuisance are estimated to exceed
tw thousand doll�.rs ($2,000,00) or t.he abatement involves
de olition of a buildino other than a structure accessory to a
re idential building.
ORDER
The Sain Paul City Council hereby makes the following order:
1. Th above referenced owners, interested parties and responsible
pa tiec and their assign� shall make the Subject Property safe and
no detrimental to the public peace, health, safety, and welfare and
re ove its blighting influence on the community by rehabilitating
th s structure and correctino those deficiencies set forth in the
li t previously referenced in accordance with all applicable codes
an ordinances, or in the alternative by demolishing the structure
an filling the site in accordance with all applicable codes and
or inances. The rehabilitation or demolition of the structure must
be completed within thirty (30) days of the date of mailino of this
re olution.

2. If the above corrective action is not completed within the thirty
(30) day time period, the proper City officials of the City of Saint
P ul are hereby authorized to take whatever steps are necessary to
d molish this structure and fill the site and charge the costs
i curred against the Subject Property pursuant to the provisions of
S ction 45.08 of the Saint Paul Leoislative Code.
3. I the event the building is to be demolished by the City of Saint
P ul, all personal property or fiatures of �ny kind which shall
u. reasonably interfere with the demolition and removal shall be
r moved from the building by the owners, interested parties and
r sponsible parties by the end. of the thirty (30} dav time period.
I the personal property is not so removed, the City of S�int Paul
s all remove and dispose of such property and fi�tures as is
p ovided by law.
4. I IS FURTHER ORDERED, that a certified copy of this recolution and
t e incorporated Order and list of deficiencies be mailed to the

The building is a n isance pursuant to Chapter 45 of the Saint Paul Legislative Code. The
owners, interested arties and responsible parties known to the Division of public Health
were given an order to repair or tear down the building at 279 Charles Avenue by June 25,
1990. All parties ailed to comply with those orders. The building has remained
unoccupied and vaca t since December of 1988.

The City will tear own the building and eliminate a nuisance if the owners do not comply

The building is a uisance pursuant to Chapter 45 of the Saint Paul Legislative Code. The
owners, interested parties and responsible parties known to the Division of public Health
were given an orde to repair or tear down the building at 279 Charles Avenue �by June 25,
1990. All parties failed to comply with those orders, The building has remained
unoccupied and vac nt since December of 1988.
ADVANTAOESIF APPROVED:
The City will tear down the building and eliminate a nuisance if the owners do not comply
with the Council 0 der.
DISADVANTAGES IF APPROVED:
It will cost the C'ty approximately $4,000.00 - $6,000.00 to tear down the building. The
cost will be asses ed against ,the. property taxes.
DISADVANTAGES IF NOT APPROVED:
If the building is ot torn down, a nuisance, constituting a serious health hazard
(potential fire dan er, rodent and insect harborage, potential crime site and blighting
