Kristin Anderson (hereafter, "Anderson") has assisted the City o£ Saint Paul (hereafter, the "City") in the recovery o£ a cast bronze bust of Henrik Ibsen, created by Nor.vegian sculptor Jacob H. Fjelde around 1885. The bust was donated to the City by a private group, installed in Como Park in 1907, and then was stolen in 1982. A bust of Ibsen was recovered from a video store in Robbinsdale by students of Anderson, Karin and Jon Daniels (hereafter, "Daniels"), with tY�e permission of the video store owner, and thereafter kept in safekeeping by Anderson at Augsburg College. The City has determined that the bust is the Ibsen bust stolen from Como Park. Anderson is willing to give the City possession of the bust, but asks that she and her students, together with Augsburg College, be indemnified against possible claims by the owner of the video store, a Mr. Lucas. Lucas has moved to California, and his present whereabouts are unknown. Indemnity 2. The City, in consideration of the return of the bust by Anderson, hereby indemnifies, and agrees to hold Anderson, Daniels and Augsburg College harmless from and against any and all losses, liabilities, suits, obligations, judgments, costs and expenses, including, without limitation, reasonable attorney fees, which may be incurred by each o£ them that arise out of or relate to their discovery of the bust, their respective role in removing the bust from the video store and their decision to give the bust to the City.
