That section 34 11 (9) of the Saint Paul Legislat've' de is hereby amended to read as
follows:
(9) Rubbish torage and removal. Ev 'dence building shall be supplied
with app oved containers with cove r storage of rubbish and weekly
rubbish r moval.

Section 2
That section 34. 1(10) he aint Paul Legislative Code is hereby amended to read as
follows
(10) Garbage torag d removal. Every residence building shall be supplied

and capa i store all the garbage from the unit and which are equipped
with tig i t g covers. Every residence building shall be provided with
weekly g r ge removal.

An ordinance amending the Saint Paul
Legislative Code by adding a new chapter 279
relating to the impoundment and forfeiture
, of motor vehicles associated with certain
designated offenses.
THE COUNCIL OF E CITY OF SAINT PAUL DOES ORDAIN:
Section 1
The Saint Paul gislative Code is hereby amended by adding the following new chapter 279
to read as follows:
"Chapter 279. I poundment and Forfeiture of Motor Vehicles Associated with Certain
Designated Offe ses.
Sec. 279.01. Def nitions. For the purpose of this chapter the following terms shall mean
the following:
(a) Convi tion. Conviction means any of the following which have been accepted
and recorded by the court:
(1 a plea of guilty; or
(2 a verdict of guilty by a jury or a finding of guilty by the court; or
(3 a stay of imposition of sentence pursuant to Minn. Stat.
§609.135, subd. 1.
(b) Desi ated offense. Designated offense means a conviction of a violation of
any provision in sections 272.01, 272.03, or 280.03 of the Legislative Code, or in Minn.
Stat. §609.324, s bd. 3.
(c) Moto vehicle. A motor vehicle means every vehicle which is self-propelled,
including but no limited to motorcycles, motor scooters and "motorized bicycles" as
defined in Minn. Stat. §169.01, subd. 4a.
(d) Notic . Notice mailed by certified mail to the address shown in the Minnesota
department of p blic safety records is deemed sufficient notice to the owner and secured
party for all motbr vehicles required to be registered pursuant to Minn. Stat. ch. 168.
(e) Owne . Owner means a person, other than a secured party, having the
property in or ti e to a motor vehicle. The term includes a person entitled to the use
and possession o a motor vehicle subject to a security interest in another person, but
excludes a lessee under a lease not intended as security.

ecur d a'r . Secured party means a person who has perfected a secured /y7rl�/
interest in a m tor vehicle pursuant to Minn. Stat. ch. 168A.
(g) Secu �ed interest. Secured interest means a perfected, secured interest as
defined in Mi . Stat. §168A.01, and subject to the restrictions in Minn. Stat. §168A.22.
Sec. 279.02. Ce�{tain motor vehicles subject to forfeiture.
Any motor vehi le used to commit or facilitate in any way, or used in any way during,
the commission�of any designated offense is subject to forfeiture.
Peace officers a resting or charging persons for violating any designated offense are
empowered to s ize and impound in the name of the city of Saint Paul any motor
vehicle used to ommit or facilitate in any way, or used in any way during, the
commission of ny designated offense, and shall hold the motor vehicle subject to court
order of forfeit re.
T'he Saint Paul olice department is deemed to have custody of the motor vehicle seized
subject to the o der of the court having jurisdiction over the forfeiture proceeding. Any
motor vehicle s�ized as a result of a violation of any designated offense is not subject to
replevin.
Sec. 279.03. Not�ce to owner and secured party; bond by owner for possession during
pendency.
Within seven (7 calendar days after the seizure of a motor vehicle pursuant to section
279.02, notice o the seizure shall be given by the chief of police or his designee by
mailing to the o ner and any secure party thereof at their last known address listed in
the records of t�e Minnesota department of public safety, a written notice of forfeiture.
In the event tha either the owner or the secured party of the seized motor vehicle are
unknown, notice shall be by publication in a legal newspaper for the city of Saint Paul at
least once withi seven (7) calendar days after the seizure. This notice shall describe the
year, make, mo�el, license plate and vehicle identification number of the seized motor
vehicle.
This notice shal inform the owner and any secured party of a motor vehicle seized
under this chapt�r that should they seek possession of the motor vehicle before the
forfeiture action is determine the owner and any secured part may file with the Saint
Paul police dep rtment sufficient security, or post bond payable to the city of Saint Paul,
in an amount eq al to the retail value of the motor vehicle seized as listed in the
National Autom' bile Dealers Association Used Car Guide. Upon posting of security or
bond, the seized motor vehicle shall be returned to the owner and the forfeiture action
shall proceed ag inst the security or bond in lieu of the seized motor vehicle.
Sec. 279.04. For�eiture; judicial determination.
The forfeiture a tion under this chapter is a civil in rem action, separate from and
independent of ny criminal prosecution. A court may issue an order of forfeiture only
upon a convictio� of a designated offense.
(a) Withir� twenty (20) days following the seizure of any such motor vehicle, a
separate compla nt shall be filed in district court against the motor vehicle describing
the year, make �d model, vehicle identification number of the motor vehicle, and
specifying the ti e and place of the unlawful use and stating the designated offense. The
complaint shall �e captioned in the name of the City of Saint Paul as plaintiff and the
motor vehicle as defendant.

(b) A co y of the complaint shall be served upon the owner and any secured
party by certifie mail to the address shown in the records of the Minnesota department
of public safety. Notice may otherwise be given in the manner provided by law for
service of a su ons and complaint in a civil action.
(c) The omplaint shall provide notice that any person claiming any right, title, or
interest in the �hotor vehicle shall file an answer within twenty (20) days of service of
the complaint. '�'he answer must set forth the specific basis for the claim made as to
right, title or in�erest in the motor vehicle and demand a judicial determination of the
forfeiture.
(d) The �nswer must be filed in district court together with proof of service of a
copy of the ans er on the City Attorney or one of her or his assistants.
(e) Upo the conviction of a person arrested for a designated offense the City
shall move the istrict court for an order requiring the motor vehicle to be sold subject
to any limitatior� set forth in this chapter.
Sec. 279.05. For�eiture, judicial determination and distribution of proceeds.
(a) If no nswer is filed within the time prescribed and the court order the motor
vehicle sold, the motor vehicle shall be deemed abandoned and shall be disposed of in
the manner pre�cribed in chapter 163 of the Legislative Code.
(b) If an nswer is filed, and following a hearing the court order the motor
vehicle sold, the the order shall provide that all right, title and interest in the vehicle
shall immediatel vest in the city of Saint Paul, and that the city is authorized to sell the
motor vehicle c nsistent with the procedure set forth in sections 162.10(a) and (b) of the
Legislative Cod , and that the city is authorized thereafter to convey title to the motor
vehicle free of a�l liens and encumbrances.
(c) All co ts incurred by the city in the seizure, storage, forfeiture and sale shall
first be deductec�from the proceeds of any such sale, and any balance remaining from
the proceeds sh�ll be paid over to the city, except as provided in section 279.05(d)
below.
(d) The i terests of bona fide secured parties in a motor vehicle seized and sold
under this chapt�r shall be satisfied in their order of priority. Any balance remaining
shall be distribu ed in the order set forth in section 279.05(c) above.
Sec. 279.06. Li tations on forfeiture of property associated with designated offenses.
A motor vehicle used by a person as a common carrier in the transaction of business as
a common carri r is subject to forfeiture under this chapter only if the owner or
operator of the �otor vehicle is a consenting party to, or is privy to, the commission of
the designated o fense.
Sec. 279.07. Dismissal, acquittal.
If the person arr�sted for or charged with a violation of a designated offense is
acquitted, the co rt having jurisdiction over the forfeiture proceeding shall dismiss the
complaint agains�the motor vehicle and order its return to the person legally entitled to
possess it. The ci�ty shall further return or release any security or bond which has been
posted.

Customers of ostitutes frequently cruise residential streets and solicit
neighborhood r sidents. Such offenses are a direct threat to the safety
and well-bein of St. Paul residents and neighborhoods. This ordinance
is consistent ith the intent of state statutes that allow confiscation
of motor vehicles when used in commission of certain crimes.
ADVANTA(iES IF APPROVED:
The safety an well-being of city neighborhoods will preserved and
residents will be free to walk the streets and use their front yards
without fear f being propositioned.
