Whereas, The Council, by Resolution #90-1205, adopted July 26, 1990, approved plans for the
Minnesota Department of Transportation showing proposed alignment, profiles, grades and cross
sections for the reconstruction of the Jackson, Cedar Streets' bridges; and
Whereas, The City's Police Department has been in discussion with MnDot's Commissioner
for the continued use by the City of freeway right-of-way on the south side of I-94 between Cedar
and Jackson streets for the parking of police vehicles; and
Whereas, The plans submitted by MnDot and approved by this Council did not take into
account the use of the right-of-way by the Police Department, and it is the desire of the Council to
amend the said Resolution 90-1205 for the purpose of obtaining an agreement with MnDot for the
continued usage of the freeway right--of-way for that purpose; now therefore be it
Resolved, That Resolution 90-1205, adopted July 26, 1990, be and is hereby amended so as to
specify that it is the strong desire of the City of Saint Paul to continue to use the right-of-way for
parking lot purposes, that MnDot construction plans be cha.nged to include such improvements for
the parking lots, that MnDot and the City renegotiate the terms for the continued use of this right-
of-way, and that if possible, the City be allowed to obtain title to the right-of-way; and be it
Further Resolved, That the City Clerk be and is hereby instructed to transmit a copy of this
resolution to the Commissioner of the Minnesota Department of Transportation.
