Gotzian's Subdivision; and Whereas, T'he Zoning Committee of the Planning Commission conducted public hearings on April 5, May 3 and May 31, 1990, and submitted its recommendation to the Commission. The Commission, by its Resolution 90-59, decided to approve the application based on the following findings and conclusions: 1. The property was cleaxly designed for and operated as a heavy commercial use. It does not appear that the land and building can be reasonably or econcmically reused for a conforming purpose. 2. The proposed use as a catering facility appears to be "equally appropriate or more appropriate to the district than the previous nonconforming use". 3. if the use and the access thereto is properly regulated, the proposed use would be "consistent with the health, safety, morals, and general welfare of the community". The Dayton' s Bluff Community Council vo�ed to support Denise and An�' s e€forts by assisting them in this appeal process. The residents"�feel fortunate that citizen participation all�ows for this apportuni�y to- appeal. _ The reasons for the appeal are as follows: 1. Communication was not maintained. The ball was dropped on our end by the former CO who was supposed to be working with Commercial State Bank and the residents on finding a suitable reuse of the building. There was no evidence of this file ever existing in our office. 2. The Planning Commission violated its own rules of evidence by taking testimony after the public hearing. The Zoning Committee should have not considered the letter of evidence from Commercial State Bank that led to the Zoning Committee reversing its initial positioli on the matter. 3. The Planning Commission acted contrary to the wishes of the community. Nearly half ofi�� the residents that live in a four block area of 940 Beech have openly expressed the�r opposition to the nonconforming use permit. Commercial State Bank. #10611: Rehearing to consider new evidence presented following the Zoning Committee's original hearing of a request for a Nonconforming Use Permit. Mr. McGuire gave a new slide presentation which included pictures from the inside of the building, and additional information for the staff report. Mr. McGuire noted several health and safety code violations on the property. He also noted that the semi-trailer had been removed from the rear of the premises. McGuire stated in his opinion, reuse of the structure for a conforming purpose would not be feasible. He also stated that the Small Business Division of Planning and Economic Development has been working with the developer on this property acquisition. Attorney Steve Rau, who is representing Commercial State Bank, the property owner, addressed the committee stating the bank feels there has been no discontinuation of nonconforming use. He noted that the bank had been actively seeking to lease the property since they evicted the last tenant. Mr. Rau also stated that the bank would suffer a serious financial loss, which would impose a hardship on them, if some reuse of the property were not allowed. He also noted that the property has been paying about $9,000 per year in real estate taxes. Although considerable work would have to be done to the structure to bring it up to code, the current developer, has agreed to do this work. In response to a question from a committee member, Mr. McGuire stated that the developer had previously testified there would be 12 to 15 deliveries per week and one-fourth of those deliveries would be from semi-trucks. Hours of operation for the business would be 6:00 a.m. to 6:00 p.m. Monday through Friday and 10:00 a.m. to 11:00 p.m. Friday and Saturday. Mr. Vaught stated he would like to consider making restrictions on delivery hours. Since the developer was not present, Mr. Christenson stated his frustration in not being able to ask the developer if the restrictions on delivery hours and type of delivery trucks would be acceptable to the them. Mr. Neid stated he would like the developer to restrict delivery hours from 7:00 a.m. to 3:00 p.m. , Monday through Friday. Ms . Hirte also stated her frustration that the developer was not present to give an opinion on the restrictions. She re-stated the community's main concern was semi-truck traffic on the neighborhood streets. The community feels that Beech Street has carried most of the traffic to this site in the past. Ms. Omoto stated that Hansons, the developers, did not know about the hearing until two days ago, and were not able to come today. She stated the bank was not interested in speaking to other parties Ms. Omoto referred who had interest in the site, because the bank said the referrals would only offer half of what the property is worth. Mr. Rau spoke in rebuttal stating that the bank has a contract with the Hansons which they must honor until such time as it is clear that their use will not be allowed on the property. The bank is therefore not in a position to offer the building to others who might be referred by the interested neighborhood. Following Mr. Rau's rebuttal, Ms. Morton closed the public hearing. Mr. Christenson recommended approval of a Change in Non-Conforming Use based on findings one through three of the original staff report, subject to the conditions that the developer prepare a site survey of the existing layout, provide paving for the gravel parking lot at the rear of the building, and designated parking spaces for use by tenants, employees, and visitors to the site. Landscaping and screening are to be provided in accordance with city standards and specifications. He also recommended that the loading dock area be used for off-street parking for the upper tenant's vehicle and the applicant's vehicles. There are to be no more than 25 delivery vehicles coming to the site per week and no more than six of those deliveries are to be from semi-trucks. The semi-truck deliveries must be between the hours of 7:00 a.m. and 5:00 p.m. Monday through Friday. The hours of operation shall be 6:00 a.m. to 6:00 p.m. , Monday through Thursday and until 10:00 p.m. Friday and 6:00 a.m. to 11:00 p.m. on Saturday. Mr. Vaught seconded the motion. Mr. McGuire stated that the trash will be stored inside the structure and will be removed daily. Mr. Christenson stated he does not want to expand the amount of semi-truck deliveries in excess. Mr. Vaught stated he is generally opposed to making delivery restrictions but in this case it is not unreasonable. Mr. Segal stated the discussion was focused on the re-use of the building as it conforms to use, etc. The first floor probably will not be converted to housing. Mr. Vaught stated he has had a personal account with Commercial State Bank but is unbiased in this issue and will vote. Ms. Morton stated on a vote of four in favor and three opposing, the Zoning Committee will recommend approval of the Nonconforming Use Permit to the Planning Commission on June 8, 1990. This letter will first outline the facts pertinent to CSB's ownership of this property as well as the property's previous non-conforming use. Then this letter will describe why the Planning Coc�nission should reconsider CSB's applica.tion and why a denial of the non-conforming variance would work tm.reasona.ble hardship on CSB. CSB foreclosed the mortgage which it held on the above-referenced property. On June 2, 1987, said bank purchased the property at the Sheriff's Foreclosure Sale. The period of redemption expired December 2, 1987, at which time CSB became fee owner of the property. On September 9, 1987, subject property wa.s inspected by Robert Johnson Associates for the purpose of estimating its Fair Market Value. The appraisal and analysis revealed at that time a Fair Market Value of $150,000.00 The subject property is loca,ted on the southeast corner of Beech Street and Forest Street in St. Paul, Minnesota, with about 120 feet on Beech Street and 134 feet on Forest Street. The site comprises 16,000 square feet (120' x 134' ) . The rear 44 feet of the site is open and is a gravel surfaced parking area. The site also provides a loading and pa.rking area on the front side. The first floor contains wa.rehouse areas and severa.l areas which are walk-in type coolers. The older two-story pa.rt of the building contains some open storage areas and 2 walk-in cooler areas. There is an additiona.l walk-in cooler which was just storage and not cooled. On October 24, 1989, Robert Hansen signed a Purchase Agreement for the siun of $135,000.00. Robert and Susan Hansen own and operate the Professional Ca.tering Service, (PCS) , presently doing business at 720 Pa.yne Avenue in St. Paul. PCS was founded in 1972 by the Hansens and has grown from a small coffee shop to a cafeteria, to a thriving catering service. PCS's present corporate clients include Group Health, H. B. Flzller, MEA, as well as some state offices. Mr. Hansen and CSB have applied for city garticipation in financing the acqui- sition and rehabilita.tion of the building for the Hansens. Over the past year we have worked diligently with Mr. Craig 0'Brien, of St. Paul's Depa.rtment of Planning and Economic Development, to successfully cons��a.te this transaction. A failure to approve CSB's application for a non-conforming use would result in substantial financial loss and would work an unreasonable hardship on CSB. For example, as the attached letter from Robert Johnson Associates illustrates, complying with existing zoning and use requirements is not economica.11y feasible. The use of this property in its current state is the onl logical and economic use of the property. More specifica.11y, two irrefuta,ble facts support CSB's position. First, the cost of tearing down the present structure and converting it to a multi- residential or single family housing units would not be realized in the sub- sequent sale price of those units; the present residential real estate market for the area involved. clearly illustrates the non-viability of this alter- na.tive. Second, CSB has marketed this building for over two ears and the present buyer, who requires a non-conforming use of the property, has been the only viable buyer for this property. Indeed, since the structure was built on the property, its use historically has been non-conforming. The residents of the neighborhood have indicated that they have suffered a hardship due to previous occupants of the property. Our position is that the proposed occupant is substantially different in nature and would become a vibrant addition to the area. Neighborhood opposition to the proposed non-conforming use seems to be premised entirely on past experiences with Anderson Meats. These past experiences, however, concern a heavy co�nercial use of the property which contrasts with the present proposed catering business. This potential buyer has expressed a willingness to comply with all of the Zoning Committee's Staff Report Recom- mendations. Omotto stated she did not know since there was no file kept, but the City staff told her this was an issue before. Ms. Hirte asked Ms. Omotto if the issue of semi-truck traffic was discussed at the full council meeting. Mr. Omotto stated, no. Ms. Denise Potting of 932 Beech St. addressed the committee in opposition to the proposal. She had posters and photographs for the committee' s review. She stated that Ms. Hanson, the applicant, told her they would push forward to obtain this property for the purpose of expanding their business and they expect to reach $1,000,000 this year. Ms. Potting' s concern is the potential for expansion of the business including the increased number of deliveries and the increase of semi-trucks on the neighborhood streets at late hours of the night. She is also concerned about the increased on-street parking problem. She suggested alternative uses for the property: green space, homes , 24-hour day-care center, senior citizen center, or a three-plex residence. Ms . Potting stated there is a preschool nearby in a church and a day-care center at 919 Beech St. with approximately 60 children plus the residents` children, who would all be endangered by the semi-truck traffic. There is only one lane of traffic on the street. Ms. Potting stated she did not file a complaint about the previous business because she did not think anything could be done about it since it was legal. However, now that the building is vacant, the residents decided it was the correct time to take opposition. � . � �'�r���� Commercial State Bank Page Two May 5, 1990 Ms. Anna Nadeau of 969 Beech Street addressed the committee in opposition to the proposal. Her concerns are the semi-truck traffic on the street, residents' car damage and property damage caused by the trucks, trucks blocking the school bus stop, blockage of the fire hydrant, and the rat problem caused by meat. She also stated the neighborhood lost six parking spaces because the semi-trucks needed the space to maneuver. She stated support of the idea for another day-care center to serve the 3M employees in the neighborhood. Mr. Neid asked if any complaints were filed to the City regarding previous sidewalk damage to neighbor's property. Ms. Nadeau stated, no. Applicant Ms. Bobbi Hanson and her father Mr. Bob Hanson, who are the owners and operators of the catering service, addressed the committee. Ms. Hanson stated they own four, gasoline operated vehicles, the largest being a cube van. Any additional vehicles purchased would be vans. There are 12-15 deliveries per week, one-fourth are from semi-trucks. Delivery hours are 6:00 a.m. to 6:00 p.m. Friday and Saturday hours would be 10:00 a.m. until 11:00 p.m. ; the business will not be open on Sunday. In regard to number six on the list of Land Use recommendations, Ms. Hanson stated they would need to go through normal insurance procedures, and would not be able to pay for any damage up front. She also stated there are fourteen off-street parking spaces behind the building, there is a garage in front of the building for the tenants upstairs and another spot behind the garage. There is plenty of space near the loading dock to park the business vehicles. Ms . Hanson stated their business is presently on Payne Avenue and she wishes to keep the business on the east side of Saint Paul since most of her employees are from the east side. Ms. Hanson stated her present filter system meets all the health and safety codes required, but she could not meet request number five for a filter system to control cooking odors. (The only odors are from fresh baked bread and rolls. ) Mr. Hanson stated all the trash would be stored inside the trash room. If the business grows , the amount of supplies would increase with each delivery, but the deliveries would only increase to 20-25 deliveries per week. Mr. Neid asked about the number of current employees . Ms. Hanson stated there are 13 full-time employees working from 5:00 a.m. to 5:00 p.m. on Monday through Friday. Mr. McGuire stated large trucks are required to stay on main "hall routes" but then may use the shortest possible route, including a residential street to reach their destination. There should not be any blocking of residential streets, and there should be no trucks lined up on the street waiting to deliver. Mr. Segal stated the committee could not condition the permit regarding truck routes to the business. Mr. McGuire stated there is a vacant residential apartment on the second floor, but it is not economically feasible to convert the first floor to apartments . No expansion to the second floor or outside the footprint of the building would be allowed under the non-conforming use permit. Mr. Christenson moved to deny the permit, based on a finding that the developer had not demonstrated unreasonable hardship or economic infeasibility of reusing the existing structure for a conforming purpose.
