WHEREAS, the Saint Paul City Council held a public heaxing on July 17, 1990 to consider the
petition of residents initiated under Chapter 91 of the Saint Paul Administrative Code alleging a
nuisance to eaust at the property located at 661 East Iawson St.;
WHEREAS, the Council heard testimony that the property at 661 East Lawson Street was the site
of repeated late night disturbances which included noise, fights and public drunkenness and that the
property has had an inordinate number of police calls since April of 1989 regarding that property;
WHEREAS, the City Council determined that there had been sufficient evidence and testimony
given to merit referring this matter to the Saint Paul City Attorney's Office for further investigation
and a determination of whether the property located at 661 East Lawson constitutes a nuisance;
NOW THEREFORE BE IT RESOLVED, that the Saint Paul City Attorney's Office shall
investigate the property at 661 East Lawson Street and determine whether to commence any civil or
criminal actions against the owners or persons with a legal interest in the property;
BE IT FURTHER RESOLVED, that the City Council shall be informed by the City Attorney's
Office, the progress of the investigation no later than thirty (30) days from the date of this hearing.

REPORT TO THE SAINT PAUL CITY COUNCIL
The Saint Paul City Council considered a petition initiated under
Chapter 91 of the Saint Paul Administrative Code in which residents
alleged a public nuisance to exist at the property located at 661
East Lawson Street.
After hearing testimony and receiving evidence, the City Council
determined that there was sufficient basis to merit referring the
matter to the Saint Paul City Attorney's Office for further
investigation and a determination of whether the property at 661
East Lawson constituted a nuisance and whether to commence any
civil or criminal action against anyone with a legal interest in
the property.
Because of the volume of information regarding this property, the
City Attorney's Office conducted an extensive investigation which
necessitated repeated contact and correspondence with the residents
who initiated the petition and with the Police Dept. and its

Neighborhood Housing Liason. The investigation was complicated by
the numerous neighbors who had witnessed incidents and the extended
period of time covered by the various incidents.
After completing the investigation, the assembled information had
to be organized so that it could be analyzed to determine if a
civil or criminal action should be commenced by the City Attorney's
Office and who it should be commenced against.
The City Attorney's Office determined that there was probable cause
to charge Raymond Simpson, the owner of the property at 661 East
Lawson Street with "Permitting a Public Nuisance", in violation of
Minnesota Statute section 609.745.
A citation was issued to Raymond Simpson and a court date is
pending for the middle of November in Housing Court.

affect on our bussinness at 648 east lawson, members have almost stopped '
coming in because of cars being broken into, tires set on fire� rocks and
eggs being thrown at cars and them selves.
�Ve have rental, property upstairs for weddings and etc� and have had
probleme renting because of the problems with all three items listed above.
Most of our members are �lderly and are afraid to come to the club
because of these problems and has hurt our bussinness a great deal.

As you know throuqh correspondence and block club meetings,
the 600 LawsonJCook Block Club has been working to resolve the
continuing problems from 661 East Lawson. Since the summer of
1989, we have been in written and verbal contact with the
property owners, Mr. and Nrs, Rayrnond J Simpson, to no avail.
They have refused to meet with us, and the residents of 661
East Lawson have made life intolerable for the neighborhood.
Because of this, we filed on June 8 a petition with the Gity
Clerk to request a public hearing with the City Council to
declare 661 East Lawson a nuisance property. T�1e hane been
informed that the hearing is set for July 10, 1990. The 600
Lawson/Cook B].ock Club appreciates your support in this matter,
and req�uests that you please push the hearincr into the month of
June, if you can. �xpedience is the issue because of escalatina

Dear Council President Wilson:
On July 17, 1990 the 600 Lawson/Cook Block Club will present documentation
showing that the property at 661 E. Lawson has been and continues to be a public
nuisance and that the property owners Raymond J. Simpson and Mary Jo Simpson have
� willfully allowed this public nuisance to exist.
The 600 Lawson/Cook Block Club formed in July of 1989 out of concern and
frustration about the structural and behavioral conditions at 661 E. Lawson.
Since is inception the Club has provided continued outreach to Mr. and Mrs.
Raymond Simpson through both registered mail and phone conversations asking for
their assistance in dealing with the issue and working with the block club.
On a correspondence dated June 27, 1990 Greg Trost, an attorney representing Mr.
Raymond and Mary Jo Simpson, indicated that it had been brought to he and his
clients' attention that the 600 Lawson/Cook Block Club has some complaints
regarding 661 E. Lawson. Trost asked to be contacted to discuss this matter and
in a follow up letter requested an informal meeting between a representative of
the Block Club, a City Council Member, Mr. Si�npson and himself to alleviate the
Block Club's Concern.
Although this response from Mr. and Mrs. Simpson comes a year after the Block
Club's effort to secure landlord responsibility and two weeks prior to the date
of the public hearing, the block club in a good faith effort provided ten

Trost informed the Block Club of two points:
1. That the lower unit of the property is vacant and that Mr. Simpson has
notified the current occupants of the upper unit that they have to vacate the

calls to this address as a "result of neighborhood complaints about the tenants'
behavior".
2. Mr. and Mrs. Simpson were putting the property up for sale, C.D. $500-600.00
down with a solid credit rating.
Trost indicated that Mr. and Mrs. Simpson would not rent the units without
the Block Club's input. The Block Club asked what screening process Mr. and Mrs.
Simpson's use prior to accepting new tenants. Mr. Simpson stated that only the
former landlord reference was checked. Mr. Trost commented that Mr. Si�son
handles the management responsibility of 661 E. Lawson and that he pays the
taxes, utilities and garbage removal for the property. The Block Club asked Mr.
Trost if he had a financial interest in the property and requested a copy of Mr.
Trost's and Mr. and Mrs. Simpson's retainer agreement. Mr. Trost stated that his
interest was not financial and declined the request to provide a copy of the
retainer agreement.

Having worked with the 600 Lawson/Cook Block Club over the past year, I support
the allegation that the unhealthy conditions stemming from 661. E. Lawson have
threatened the public peace, health and safety and have had a blighting influence
on the com�nunity.
Mr. Raymond J. and Mary Jo Simpson were repeatedly made aware of this situation,
but failed to take responsibility for the conditions the tenants at 661 E. Lawson
have continued and continue to create. Thereby they willfully have allowed and
continue to allow a public nuisance to exist upon the property structure under
their legal control.
It is public record that Raymond J. Simpson and Gregory Trost have joint
financial interest in the rental property at 584 Mendota, Mr. Simpson being
registered property owner and Mr. Trost being legal taxpayer. I ask that the City
Council or City Attorney's Office ascertain if Mr. Trost does in fact have
financial interest in the property at 661 E. Lawson. If this is the case, I ask
that Mr. Trost's name accompany Mary Jo and Raymond J. Simpson's name on the
public nuisance complaint.

Dear Mr. and Mrs. Simpson:
We are sure that you are as interested as we are in making our
neighborhood a good place to live. Even if you do not live
in the buildinq you manage, you know that safe and attractive
neighborhoods mean higher real estate values, and we are sure
that you are interested in protecting and improving the value
of your investment.
As well as protecting our property, we care about our community
as a place to live and to raise our children in. Numerous blocks
have organized into block clubs, uniting with the Payne/Phalen
Crime Prevention Program and the East Team Police to deal with
issues snch as crime, cleaniiness, noise, unkept property and
simi.lar problems.
In order to be successful, we will need support and cooperation
of absentee landlords, renters and homeowners. As the manager
of 661 East Lawson Avenue we invite you to join us iri a very
worthwhile goal that we have set for our neighborhood. We believe
that all landlords have a responsibility to the community at-larqe
and to the adjoining property owners, which is to maintain their
property in a fashion similar to the way they maintain their
own residence.
In the future, if the community feels that you are not maintaining
your property in an responsible manner we will work to initiate
proceedings to declare your property a nuisance.
HOW YOII CAN HELP:
1. IIse a good screening process for tenant selection.
2. Establish rules and regulations for your tenant(s) to help
insure that they will not become a nuisance to their block.
Inform your tenant(s) that they must follow the rules or
risk eviction.
3. Contact your tenant(s) when you receive complaints from
their neighborhoods and advise them to solve the problem
and not allow it to reoccur. �
4. Maintain property in an acceptable manner. (i.e. cut qrass,
shovel snow)

I represent Ray Simpson regarding the duplex located at
661 E. Lawson. A hearing has been scheduled for July 10,
1990, at 9:00 a.m. before the City Council to consider the
petition of the 600 Lawson/Cook Block Club alleging a nusiance
to exist at the property. For reasons set forth in this
letter, Mr. Simpson feels that he needs legal representation
in this matter. Unfortunately, I will be out of town on
July 10 and will not be able to attend. As a result, we
request that you postpone the July 10 hearing. Furthermore,
we believe that an informal meeting between a representative
of the Block Club, a City Councilmember, Mr. Simpson, and
myself could alleviate the Block Club's concerns.
At the present time, the lower unit of the property is
vacant. Mr. Simpson has notified the current occupants of
the upper unit that they have to vacate the premises by July
31, 1990. They have occupied that unit since February 1990
and have a one year lease through January 1991. Nevertheless,
Mr. Simpson has requested that they leave because representatives
of the Block Club have expressed dissatisfaction with their
behavior. In addition, it has been brought to our attention
that the police have been call•ed to this address as a result
of neighborhood complaints about the tenants behavior.

At this point, we would like to explore a legal way for
a representative of the Block Club to screen the applications
of future tenants. PJe agree that it is in everyones best
interest to have tenants that the Members of the Block Club
approve of. However, there are some legal restrictions on
the selection process that must be addressed. Minnesota
Statute �363.03, sub. 2 (a copy of which is attached) sets
forth several protected classes of tenants. A property owner
cannot safely refuse to rent to prospective tenants who fit
within these categories unless the owner has specific reasons,
such as inability to pay rent or bad references. Consequently,
the Block Club member who does the screening will need to
supply specific objective reasons when turning down an applicant.
In addition, the Block Club representative who does the applicant
screening would have to agree to appear in court to support
Mr. Sir�pson if an applicant, who is turned down, brings a
discrimination claim against him.
Another area of concern is that of eviction. We would
like to discuss on what basis and for what kinds of behavior
the Block Club wants future tenants evicted. r1r. SiMpson
wants to cooperate if the behavior of future tenants is unacceptable
to the Block Club. However, he would again expect that a
representative of the Block Club would be willing to appear
in court on his behalf in any eviction that he brings at the
Block Clubs request.
This letter is intended to solicit the Block Clubs invovlement
in the future. We are available to Meet the evening of
July 5. I will be unavailable from July 6-16. If July 5
will not work we will both be available the week of July 17.

This letter is a follow up to the meeting of July 6,
1990 concerning 661 E. Lawson. As discussed, the lower unit
of the duplex is vacant. Mr. Simpson has given notice to
the tenants in the upper unit that they must be out by the
end of July. A copy of this notice was supplied to the Block
Club.
Mr. Simpson is currently trying to sell the property
on his own. As discussed, he is obligated to sell the property
to the first person who is willing and able to purchase it.
If the Block Club is interested or knows someone who is interested
in purchasing the property, please contact Mr. Simpson.
He will forward a copy of the Truth in Housing.
If the property does not sell, Mr. Simpson will eventually
have to rent out the units. However, he will not do this
again without first contacting the Block Club for its input.
The Block Club also requested a copy of his lease which he
will supply should he fail to sell the property.

Another topic of discussion was that of eviction of
future tenants. The Block Club indicated that it would provide
a description or list of behavior by future tenants that
will not be tolerated. The actual mechanics of a�plying
these rules to future tenants was not specifically discussed.
However, Mr. Simpson would be willing to add a paragraph
to his present lease which would identify the Block Club
and incorporate into the lease an agreed upon list or description
of the kinds of behavior that won' t be tolerated. The paragraph
could go on to say that the tenants agree to abide by these
rules and that if they don't, they shall be subject to eviction.

My wife and I own a 4-plex at 658-660 E. Lawson Avenue. This property is
the only renta.l pro�erty �re own. 'Ae ha.ve excellant tenants, however our
ter.ants have i.^.iormed us tney are conteplating moving out because of tenants
across the street at 601 �. Lawson, These people and their friends have
thrown rocks through my tenants windows� intimida.ted them to the extent they
are afraid to go out the fornt door� ha.ve kept them awake many evenings with
the noise of their fighiing, yelling and radios. It seems as if they axe
deliberately tryin� to ir.timi3ate their neighbors.
�de realize that this ty�e of situation is hard for police and lawmak ers to
correct, but the situa,tion is like a cancer in the neighborhood and will
spread as landlords mLSt replace good tenants with renters similax to those
at 661 E. Lawson. The present tenants at 561 moved in last fall-prior to
them there were similar tenants who also created problems. The situation
ha.s been bad for some time but it is at its worst right now!
I have ta.lked with the property owner Mr. Ray Simpson and I am convinced
that he will do nothin� to alter the situa.tion. Wha,t� are we to do?

Dear St . Paul City Council Members ,
My wife and I have owned our home at 653 East Lawson for twelve
years . We have put a lot of work and a lot of love into our home . We
have raised two children to young adulthood in this home . Sadly , we are
now considering selling . Why? Because the tenants and their friends at
661 East Lawson have made our lives unbearable .
One year ago , we started a block club specifically to deal with the
problems this property and its tenants were causing our neighborhood . One
year of our lives has been dedicated to this battle . We now have different
tenants than we did one year ago , but our problems are much worse . We
have tried in vain to get the owner, Raymond J . Simpson ,to work with our
block club . We would like good neighbors , it is that simple . We want
neighbors who contribute to the neighborhood , rather than try to tear it
down . These tenants keep us up during the nights with fighting , parties ,
and yelling . They play sexually explicit music so loudly that we can hear
it with our windows closed . They make racial remarks , such as calling my
wife and my neighbors wife "white 'bitches" , and telling us they want us "WHite
pepple out of our neighborhood" .
Must we continue to live like this? Have we no rights to a go�d home in
a quiet area? My son and I both work full time . It is very hard to get up at
4 : 30 A.M. when we have been up most of the night .
We respectfully request that the City Council take� action on our petition
to have this property declared a public nuisance .

Dear Clerk, Councilmembers and Block Club Members:
I represent Ray Simpson regarding the duplex located at
661 E. Lawson. A hearing has been scheduled for July 10,
1990, at 9 :00 a.m. before the City Council to consider the
petition of the 600 Lawson/Cook Block Club alleging a nusiance
to exist at the property. For reasons set forth in this
letter, Mr. Simpson feels that he needs legal representation
in this matter. Unfortunately, I will be out of town on
July 10 and will not be able to attend. As a result, we
request that you postpone the July 10 hearing . Furthermore,
we believe that an informal meeting between a representative
of the Block Club, a City Councilmember, P��r. Simpson, and
myself could alleviate the Block Club' s concerns.
At the present time, the lower unit of the property is
vacant. Mr. Simpson has notified the current occupants of
the upper unit that they have to vacate the premises by July
31, 1990. They have occupied that unit since February 1990
and have a one year lease through January 1991. Nevertheless,
rir. Simpson has requested that they leave because representatives
of the Block Club have expressed dissatisfaction with their
behavior. In addition, it has been brought to our attention
that the police have been called to this address as a result
of neighborhood complaints about the tenants behavior.

At this point, we would like to explore a legal way for
a representative of the Block Club to screen the applications
of future tenants. We agree that it is in everyones best
interest to have tenants that the members of the Block Club
approve of. However, there are some legal restrictions on
the selection process that must be addressed. Minnesota
Statute �363.03, sub. 2 (a copy of which is attached) sets
forth several protected classes of tenants. A property owner
cannot safely refuse to rent to prospective tenants who fit
within these categories unless the owner has specific reasons,
such as inability to pay rent or bad references. Consequently,
the Block Club member who does the screening will need to
supply specific objective reasons when turning down an applicant.
In addition, the Block Club representative who does the applicant
screening would have to agree to appear in court to support
r1r. Simpson if an applicant, who is turned down, brings a
discrimination claim against him.
Another area of concern is that of eviction. We would
like to discuss on what basis and for what kinds of behavior
the Block Club wants future tenants evicted. Mr. Simpson
wants to cooperate if the behavior of future tenants is unacceptable
to the Block Club . However, he would again expect that a
representative of the Block Club would be willing to appear
in court on his behalf in any eviction that he brings at the
Block Clubs request.
This letter is intended to solicit the Block Clubs invovlement
in the future. 4Je are available to meet the evening of
July 5. I will be unavailable from July 6-16 . If July 5
will not work we will both be available the week of July 17 .

nzeds of the citizens of St. Paul outweigh the convenience of

Consider that the block club has been in contact with the
propertJ, owrters, Raymond R. and 1�'Iary Jo Sinpson, for more than
a year to resolve the property proble�ns; to no avail. They re-
fused to meet with us and then their attorney, Greq Trost, con-
tacted us only after receiving noticP of the hearing. Apparently,

rega ding your property at 661 E . Lawson. We have incltided with
this letter, a copy of the Saint Paul Police report of this
property. As this report indic.ates 661 E . Lawson continues to be
a problem for our neighborhood, rec�ucing livability and property
values .
We will not tolerate this activity. The tenants in 661 E .
Lawson are primarily responsible for these disturbances . We ask
you to evict them as soon as legally possible. If you do not
have a lease, you can just give them at least one full month' s
n�tice. If you do have a lease, you c.an file an unlawful
detainer action with the municipal court.
The police report that we have included may help prove that the
tenants should be evicted. For more information on how to evict

have organized into block clubs, uniting with the Payne/Phalen �
Crime Prevention Program and the East Team Police to deal with
issues such as crime, cleanliness, noise, unkept property and
similar problems.
In order to be successful, we will need support and cooperation
of absentee landlords, renters and homeowners. As the manager
of 661 East Lawson Avenue we invite you to join us in a very
worthwhile goal that we have set for our neighborhood. We believe
that all landlords have a responsibility to the community at-large
and to the adjoining property owners, which is to maintain their
property in a fashion similar to the way they maintain their
own residence.
In the future, if the community feels that you are not maintaining
your property in an responsible manner we will work to initiate
proceedings to declare your property a nuisance.
HOW YOU CAN HELP:
1. Use a good screening process for tenant selection.
2. Establish rules and regulations for your tenant(s) to help
insure that they will not become a nuisance to their block.
Inform your tenant(s) that they must follow the rules or
risk eviction.
3. Contact your tenant(s) when you receive complaints from
their neighborhoods and advise them to solve the problem
and not allow it to reoccur.
4. Maintain property in an acceptable manner. (i.e. cut grass,
shovel snow)

As members of the Payne/Phalen neighborhood, we car� about our
community as a place to live and raise our children in, as well
as protecting our property. We are working the East Team Police
and Payne/Phalen Crime Prevention Program to deal with issues
such as cri.me, drugs, noise, unkept property and similar problems.
We are concerned about the late night party activity at 661
East Lawson Avenue. We will not tolerate this behavior and
if said activity does not terminate upon receipt of thi�_
correspondence, we, in full cooperation with the Saint Paul
Police Department, will take the following actions:
l. Initiate a community surveillance of this property,
documenting all license plate numbers and persons frequenting
this address, turning all information into the police
department for processing D.W.I. tags, loitering charges,
noise ordinance violations, etc.
2. Begin a petition to have this property declared a nuisance
by local residents that recommends to the Saint Paul City
Council and Raymond and Mary Jo Simpson - guardians of 661
East Lawson Avenue - to process your eviction.
