90-1401 �C�/^-.L..<�C.��.'.{.-- y�l '�Ir'�'g ��, ` T'�� { �A �,,., Counc i l F i l e # �� 7'd/ ' / Green Sheet # �07 RESOLUTION - ----� CITY OF SAINT PAUL, MINNESOTA l ,� Presented By Referred To Cortmittee: Date � WHEREAS, the Saint Paul City Council held a public heaxing on July 17, 1990 to consider the petition of residents initiated under Chapter 91 of the Saint Paul Administrative Code alleging a nuisance to eaust at the property located at 661 East Iawson St.; WHEREAS, the Council heard testimony that the property at 661 East Lawson Street was the site of repeated late night disturbances which included noise, fights and public drunkenness and that the property has had an inordinate number of police calls since April of 1989 regarding that property; WHEREAS, the City Council determined that there had been sufficient evidence and testimony given to merit referring this matter to the Saint Paul City Attorney's Office for further investigation and a determination of whether the property located at 661 East Lawson constitutes a nuisance; NOW THEREFORE BE IT RESOLVED, that the Saint Paul City Attorney's Office shall investigate the property at 661 East Lawson Street and determine whether to commence any civil or criminal actions against the owners or persons with a legal interest in the property; BE IT FURTHER RESOLVED, that the City Council shall be informed by the City Attorney's Office, the progress of the investigation no later than thirty (30) days from the date of this hearing. ---------------------------------------- �--------------- ------- ------ --------- Yeas Na s Absent Requested by Department of: Dimond � Goswitz �. After hearing testimony and receiving evidence, the City Council determined that there was sufficient basis to merit referring the matter to the Saint Paul City Attorney's Office for further investigation and a determination of whether the property at 661 East Lawson constituted a nuisance and whether to commence any civil or criminal action against anyone with a legal interest in the property. Because of the volume of information regarding this property, the City Attorney's Office conducted an extensive investigation which necessitated repeated contact and correspondence with the residents who initiated the petition and with the Police Dept. and its , • . 9o-/yoi Neighborhood Housing Liason. The investigation was complicated by the numerous neighbors who had witnessed incidents and the extended period of time covered by the various incidents. After completing the investigation, the assembled information had to be organized so that it could be analyzed to determine if a civil or criminal action should be commenced by the City Attorney's Office and who it should be commenced against. The City Attorney's Office determined that there was probable cause to charge Raymond Simpson, the owner of the property at 661 East Lawson Street with "Permitting a Public Nuisance", in violation of Minnesota Statute section 609.745. A citation was issued to Raymond Simpson and a court date is pending for the middle of November in Housing Court. Lawson has been and continues to be a public nuisance and that the property owners Raymond J. Simpson and Mary Jo Simpson have � willfully allowed this public nuisance to exist. The 600 Lawson/Cook Block Club formed in July of 1989 out of concern and frustration about the structural and behavioral conditions at 661 E. Lawson. Since is inception the Club has provided continued outreach to Mr. and Mrs. Raymond Simpson through both registered mail and phone conversations asking for their assistance in dealing with the issue and working with the block club. On a correspondence dated June 27, 1990 Greg Trost, an attorney representing Mr. Raymond and Mary Jo Simpson, indicated that it had been brought to he and his clients' attention that the 600 Lawson/Cook Block Club has some complaints regarding 661 E. Lawson. Trost asked to be contacted to discuss this matter and in a follow up letter requested an informal meeting between a representative of the Block Club, a City Council Member, Mr. Si�npson and himself to alleviate the Block Club's Concern. Although this response from Mr. and Mrs. Simpson comes a year after the Block Club's effort to secure landlord responsibility and two weeks prior to the date of the public hearing, the block club in a good faith effort provided ten representatives and met with Kathy Gelao, Aide to Council Member Goswitz, Sgt. William Snyder, East Team, Mr. Trost, Mr. Simpson and myself. At this meeting Mr. Trost declined participation in this the meeting if the it was audio or video taped. Trost informed the Block Club of two points: 1. Mr. and Mrs. Simpson were putting the property up for sale, C.D. $500-600.00 down with a solid credit rating. Trost indicated that Mr. and Mrs. Simpson would not rent the units without the Block Club's input. The Block Club asked what screening process Mr. and Mrs. Simpson's use prior to accepting new tenants. Mr. Simpson stated that only the former landlord reference was checked. Mr. Trost commented that Mr. Si�son handles the management responsibility of 661 E. Lawson and that he pays the taxes, utilities and garbage removal for the property. The Block Club asked Mr. Trost if he had a financial interest in the property and requested a copy of Mr. Trost's and Mr. and Mrs. Simpson's retainer agreement. Mr. Trost stated that his interest was not financial and declined the request to provide a copy of the retainer agreement. Having worked with the 600 Lawson/Cook Block Club over the past year, I support the allegation that the unhealthy conditions stemming from 661. E. Lawson have threatened the public peace, health and safety and have had a blighting influence on the com�nunity. A hearing has been scheduled for July 10, 1990, at 9:00 a.m. before the City Council to consider the petition of the 600 Lawson/Cook Block Club alleging a nusiance to exist at the property. For reasons set forth in this letter, Mr. Simpson feels that he needs legal representation in this matter. Unfortunately, I will be out of town on July 10 and will not be able to attend. As a result, we request that you postpone the July 10 hearing. Furthermore, we believe that an informal meeting between a representative of the Block Club, a City Councilmember, Mr. Simpson, and myself could alleviate the Block Club's concerns. At the present time, the lower unit of the property is vacant. Mr. Simpson has notified the current occupants of the upper unit that they have to vacate the premises by July 31, 1990. They have occupied that unit since February 1990 and have a one year lease through January 1991. Nevertheless, Mr. Simpson has requested that they leave because representatives of the Block Club have expressed dissatisfaction with their behavior. In addition, it has been brought to our attention that the police have been call•ed to this address as a result of neighborhood complaints about the tenants behavior. s.�� . �J �.,,���;� 600 Lawson/Cook Block Club July 2, 1990 Page Two At this point, we would like to explore a legal way for a representative of the Block Club to screen the applications of future tenants. PJe agree that it is in everyones best interest to have tenants that the Members of the Block Club approve of. However, there are some legal restrictions on the selection process that must be addressed. Minnesota Statute �363.03, sub. 2 (a copy of which is attached) sets forth several protected classes of tenants. A property owner cannot safely refuse to rent to prospective tenants who fit within these categories unless the owner has specific reasons, such as inability to pay rent or bad references. Consequently, the Block Club member who does the screening will need to supply specific objective reasons when turning down an applicant. In addition, the Block Club representative who does the applicant screening would have to agree to appear in court to support Mr. Sir�pson if an applicant, who is turned down, brings a discrimination claim against him. We have raised two children to young adulthood in this home . Sadly , we are now considering selling . Why? Because the tenants and their friends at 661 East Lawson have made our lives unbearable . One year ago , we started a block club specifically to deal with the problems this property and its tenants were causing our neighborhood . One year of our lives has been dedicated to this battle . We now have different tenants than we did one year ago , but our problems are much worse . We have tried in vain to get the owner, Raymond J . Simpson ,to work with our block club . We would like good neighbors , it is that simple . We want neighbors who contribute to the neighborhood , rather than try to tear it down . These tenants keep us up during the nights with fighting , parties , and yelling . They play sexually explicit music so loudly that we can hear it with our windows closed . Simpson, and myself could alleviate the Block Club' s concerns. At the present time, the lower unit of the property is vacant. Mr. Simpson has notified the current occupants of the upper unit that they have to vacate the premises by July 31, 1990. We agree that it is in everyones best interest to have tenants that the members of the Block Club approve of. Minnesota Statute �363.03, sub. 2 (a copy of which is attached) sets forth several protected classes of tenants. A property owner cannot safely refuse to rent to prospective tenants who fit within these categories unless the owner has specific reasons, such as inability to pay rent or bad references. Consequently, the Block Club member who does the screening will need to supply specific objective reasons when turning down an applicant. In addition, the Block Club representative who does the applicant screening would have to agree to appear in court to support r1r. Simpson if an applicant, who is turned down, brings a discrimination claim against him. Another area of concern is that of eviction. We would like to discuss on what basis and for what kinds of behavior the Block Club wants future tenants evicted.
