i WHEREAS, the City of Saint Paul, acting through its Valuation Engineer, has secured an agreement for the
z purchase of a parcel of real property described as follows:
Lot 7, Block 3, Fred S. Herring's Plat 2, subject to sewer easement over E 2 ft.; and
WHEREAS, the said property was condemned because of flood damages sustained during the 7une 30, 1997
rain storm and, with 31 other owners of damaged ar endangered properties, the owner petitioned for relief.
Funding for the Hoyt-Montana Flood Remediation Project is to be State and Federal grants and various City
funding sources; and

i� WHEREAS, purchase of the property was final ordered on July 22, 1998; and

�s WHEREAS, the sale price of the said property has been set at sixty seven thousand dollazs ($67,000) this being
ia a fair and reasonable value as determined by an independent appraiser; and

WHEREAS, the HoyVMontana neighborhood on the Ciry's East Side suffered a devastating fissh flood
as a result of the July 1, 1997 storm and was subsequently designated a Federal disaster area; and
WHEREAS, after many years of large financial expenditures by the City trying to resolve this flooding problem
unsuccessfu�ly with pipirtg solutions; and,
WHEREAS, ihe Fioyt/Montana Flood F2emediation Task Force's recommendation to remove andlor demolish
34 homes and construct a dry basin holding pond was accepted by the Mayor; and,
WHEREAS, the City will proceed to do the project in three phases: Phase ! is acquisition, Phase 11 is demolition,
and Phase fll is contruction of the dry basin holding pond; and
WHEREAS, the State DNR has committed up to $1.7 million to the City of Saint Paul for this purpose; and
WHEREAS, the Federal Emergency Management Agency (FEMA) has committed $570,��0 to the City of Saint
Paul for this purpose; and
WHEREAS, the Minnesota Housing Finance Agency has committed $125,000 for this purpose; and
WHEREAS, over ihe length of the whole project (not }ust Phase !) the City must provide a match of 100%
($1.7 miilion ) to the DNR grant, and a 25% match ($190,000) to tfie FEMA grant if it expends these funds; and
WHEREAS, some in-kind City services, such as staff time administering the project, will be allowed as part of
the City's share of the match;
WHEREAS, the Mayor, pursuant to Section 10.07.04 of the City Charter, recommends tfie following changes to
the 1998 operating budget for Phase 1(Acquisition and Demolition) of the project; now
THEREFORE BE IT RESOLVED, by the Counci( of the City of Saint Paul, upon recommendation of the Mayor
and advice of the Long Range Cap+tal Improvement Budget Committee, that the 1998 Opereting and Gapital
Improvement Sudgets, as heretofore adopted and amended by ihis Council, are hereby further amended in the

WHEREAS, the HoyVMontana neighborhood on the Ciry's East Side suffered a devastating fissh flood
as a result of the July 1, 1997 storm and was subsequently designated a Federal disaster area; and
WHEREAS, after many years of large financial expenditures by the City trying to resolve this flooding problem
unsuccessfu�ly with pipirtg solutions; and,
WHEREAS, ihe Fioyt/Montana Flood F2emediation Task Force's recommendation to remove andlor demolish
34 homes and construct a dry basin holding pond was accepted by the Mayor; and,
WHEREAS, the City will proceed to do the project in three phases: Phase ! is acquisition, Phase 11 is demolition,
and Phase fll is contruction of the dry basin holding pond; and
WHEREAS, the State DNR has committed up to $1.7 million to the City of Saint Paul for this purpose; and
WHEREAS, the Federal Emergency Management Agency (FEMA) has committed $570,��0 to the City of Saint
Paul for this purpose; and
WHEREAS, the Minnesota Housing Finance Agency has committed $125,000 for this purpose; and
WHEREAS, over ihe length of the whole project (not }ust Phase !) the City must provide a match of 100%
($1.7 miilion ) to the DNR grant, and a 25% match ($190,000) to tfie FEMA grant if it expends these funds; and
WHEREAS, some in-kind City services, such as staff time administering the project, will be allowed as part of
the City's share of the match;
WHEREAS, the Mayor, pursuant to Section 10.07.04 of the City Charter, recommends tfie following changes to
the 1998 operating budget for Phase 1(Acquisition and Demolition) of the project; now
THEREFORE BE IT RESOLVED, by the Counci( of the City of Saint Paul, upon recommendation of the Mayor
and advice of the Long Range Cap+tal Improvement Budget Committee, that the 1998 Opereting and Gapital
Improvement Sudgets, as heretofore adopted and amended by ihis Council, are hereby further amended in the
following particulars:
