DBA Gabe's by the Park at 991 N. Lexington Parkway has applied for a Modification of Parking Requirements for an Extension of Service for a patio permit for an on-sale liquor license reducing the number of off-street parking spaces required from 108 to 83 ; and �IiEREAB, notice of a public hearing before the City Council was duly mailed to each owner of affected property within 350 feet of the property for which the modification of parking requirements was sought; and WIiEREAB, the City Council based on evidence presented at the public hearing as substantially reflected in the minutes make the following findings of fact: 1. The applicant proposes to add an unenclosed concrete patio area of about 1, 000 square feet in area adjacent to the northeastern portion of the building. The proposed patio area would remove two existing parking spaces. The applicant proposes to restripe a rear portion of the parking lot to provide a few more off-street parking spaces. 2. The applicant has a shared parking agreement with Gould National Batteries, Inc. for the use of the adjacent 66 space parking lot. The applicant has indicated in a letter from his attorney that "as long as Gould National Battery, Inc. holds (title to) the property (adjacent to Gabe's) , a 'gentleman's agreement' allowing Gabe's in the Park to use their parking lot at night in exchange for their being able to use Gabe's parking lot during the day will continue to exist. " In addition, this letter indicates that if Gould National Batteries, Inc. ever decides to sell this parking lot property, the applicant's attorney will be notified of this decision. ' 3. In the site plan review process for this proposed patio area, � the Parks and Recreation Division of Community Services identified several conditions for the approval of the site plan for the applicant. First, the fencing for the patio should be 6 feet in height and must be continuous so that the only access to the patio is through the building. Another condition requires the redesign of the planting plan to provide a backdrop to the parkway of fewer plant varieties and more plants, perhaps in a hedge along the property line along with some coniferous plantings outside the planter bed. ORIGINAL � � � �y�-��� � _2_ A third condition of the site plan approval includes prohibiting outdoor loudspeakers and/or live music on the property. The applicant has agreed to meet these three conditions. 4. Another condition of the site plan approval that was considered by the Parks and Recreation Division included eliminating the existing curb cut and driveway off Lexington with the installation of a new curb on Lexington and the parkway area restored with sod and appropriate plantings. The Parks and Recreation Division discussed this possibility with the applicant but decided that it was not workable or practical to require. The Public Works Department recommended that this driveway be altered to an "in only" driveway for safety reasons. 5. The applicant indicated that they agree with a one-way entrance driveway from Lexington but that removing the driveway would not be workable and would be bad for business for several reasons. First, their operation cannot depend on the Gould driveway to the north of Gabe's for access from southbound Lexington traffic; they believe that much of their business depends on this direct access. Second, this driveway is an existing situation rather than a proposed change. Third, the possibility exists that the outdoor patio with liquor may not work; if this occurs they would like to have the flexibility of converting back to their original layout. Finally, they are concerned that such a change will add to the expense of the proposed revision and make it harder to justify economically. 6. The revised site plan submitted by the applicant indicates the changes that have been recommended by the Public Works Department and by the Parks and Recreation Division. 7. According to the applicant, he has been in business for about 13 years and has only had two minor violations; one was a gambling violation involving a private Super Bowl party about 4-5 years ago and one was for serving liquor to a minor about 2-3 years ago. Gabe's by the Park plans to provide an expanded liquor service area into the 1, 000 square foot patio area, but does not have sufficient land to accommodate additional parking. When this anticipated patio area is included in calculating the parking requirements for this establishment with an on-sale liquor license, Gabe's by the Park is 25 parking spaces short. The applicant has indicated that an informal shared parking agreement with Gould National Batteries, Inc. , the owner of the adjacent 66 space parking lot, allows Gabe's patrons to use this 66 space lot in the evening when Gabe's has most of his business. In return, Gabe's allows Gould National Batteries, Inc. employees to park in the Gabe's parking lot during regular daytime working hours. The modification would permit the applicant to serve liquor both within the existing establishment and in the proposed concrete patio area near the northeastern corner of the building. Based on the size of the proposed concrete patio area and the patron area within the building, staff calculated that to meet the licensing parking requirement he would have to provide 25 additional parking spaces. B. LEGISLATIVE CODE CITATION: Parking: Section 410.04 of the Legislative Code requires that establishments with on sale liquor licenses provide one off-street parking space for every 45 square feet of patron area. However, it provides for modifications of this requirement: "The council may modify the off-street parking requirements contained in this section. . .upon findings made by the council that granting of such modification would not have a substantial detrimental impact on the surrounding neighborhood. Modification, if granted, shall be by resolution adopted by at least five (5) affirmative votes." "In granting any modification, the council may attach reasonable conditions regarding the location, design, character and other features of the licensed structure and parking area deemed necessary for the protection of the adjacent neighborhood." C. SITE AND AREA CONDITIONS: The property is located on the eastern edge of Energy Park and has a lot area of about 41,935 square feet (201' x 208.63' ) . The property is essentially level with 79 off-street parking spaces currently striped on the site. To the north is a large building owned by Gould National Battery Inc. with some parking adjacent to the south side of the building. To the west is a 66 space parking lot owned by Gould National Battery Inc. and multiple family residential uses beyond the lot. To the south across Energy Park Drive are various industrial uses. To the east across Lexington Parkway are single family, two family, and multiple family residential uses as well as the Northtown Credit Union. D. FINDINGS: �-�o-i�9 1. We have not revised the site plan as per recommendation number 4 by the Parks and Recreation Department involving eliminating the existing curb and driveway off of Lexington. We do not want to eliminate that driveway for the following reasons: 1. It will greatly add to the expense of the revision and makes the patio much harder to justify in terms of the cost/benefit ratio. 2 . The Public Works Department recommended that the driveway be made a one-way "in only" driveway. Eliminating the driveway altogether now would not only be costly but also would eliminate an access point for Gabe's By the Park. Many of Gabe's clientele are softball players who come From the softball fields just north of the business location. This access point is very convenient to all of the softball players and the elimina- tion of it, we believe, would add confusion. 4. In the event that the patio is not successful and we eliminate it sometime in the near future, we would like to have the flexibility of converting back to our current set up. Eliminating that driveway at the present time would not allow us any flexibility in the event of any changes made in the future. We do not own the driveway to the north of this access and we believe it beneficial to have at least two access points to our property. 5. There are no explanations given for this very expensive recommendation and we believe it is arbitrary and of questionable benefit to the city. Thank you. The patio fencing must be continuous, so that the only access to the patio is through the building, and the fence should be 6 ft. in height as well . 2. The planting plan must be redesigned to provide a backdrop to the parkway. There are currently too many different plant varieties called for, and too few plants. A single plant tyPe, such as the Globe Arborvitae, trimned as a hedge, would be much better. Also, some coniferous plantings should be included, outside the planter : bed (see #4 below). 3. Outdoor loudspeakers and/or live music must be prohibited. � 4. The existing curb cut and driveway off Lexington must be eliminated, with new curb installed on Lexin�ton and the parkway area restored with sod and appropriate plantings. Our File No. 431. 1 Dear Chester: On February 14, 1990, I spoke with Phil Martino, an executive with GNB Batteries, Inc. , whose corporate headquarters are located at 1110 Highway 110, Mendota Heights, Minnesota, (612) 681-5000, regarding the property identified on the attached Exhibit "A" as parcels D4 and I. Mr. Martino told me that this property had in fact been for sale, but because of environmental concerns and problems, they have canceled the purchase agreement. GNB Batteries, Inc. apparently has no plans at this time to sell the property and it is likely they will be moving some office people into the site on Lexington sometime in the near future. They d'o not plan to put any production operation into effect there, but they are considering housing office personnel at the site. Mr. Martino assured me that as long as GNB Batteries, Inc. owns the property, the "gentlemen's agreement" allowing you use of their parking lot at night in exchange for their being able to use Gabe's parking lot during the day will continue to exist. Apparently there is some ingress and egress problems associated with the property they own north of Gabe's.
