8. That the L.M.C . , its successors , and assigns , by
acceptence of the terms and conditions of this
vacation agree to indemnify , defend , and save
harmless the City of Saint Paul , its officers , and
employees from all suits, actions, or claims of any
character brought as a result of injuries or damages
received or sustained by any person , persons , or
property on account of this vacation or petitioner ' s
use of this property, including but not limited to a
claim brought because of any act of omission ,
neglect, or misconduct of said petitioner because of
any claim or liability arising from any violation of
any law or regulation made in accordance with the law
whether by the petitioner or any of its agents or
employees.
9. That the L . M . C . shall , within 6H days of the
publication date of this resolution, file with the
City Clerk an acceptance in writing of the condition
of this resolution and shall within the period (s)
specified in the terms and conditions of this
resolution, comply in all respects with these terms
and conditions.
BE IT FURTHER RESOLVED, that the proper City officials are
hereby authorized to enter into and execute the agreement
referred to in Condition No. 5 of the conditions to the vacation.

RESOLVED, that upon the petition o the City of Saint Paul ,
per Finance Department file no. 8�1990 that part of Block l ,
Eastern Area Addition located at the rtheasterly intersection
of Jackson Street and University Aven e, hereinafter described,
be and the same, is hereby vacated an discontinued as public
property.
The vacated area is described s follows:
Commencing at the Southwest ly corner of Lot 3,
Block 1 , Eastern Area Addit ' on; thence North 56
degrees East (assumed beari g) along the Northerly
line of University Avenue, said line also being the
Southerly line of said Blo k 1 a distance of 400 feet
to the point of beginning; thence North 34 degrees
West 180 feet; thence Nor h 56 degrees East along a
line 180 feet Northerly and parallel to the
Northerly line of Univer ity Avenue, a distance of
339 . 5 feet more or less; thence Southerly to a point
on the Northerly line o University Avenue which lies
a distance of 30A feet orth 56 degrees East of the
second point of beginni g; thence South 56 degrees
West along the North li e of University �Avenue to the
point of beginning.
The vacation shall be subject to the following
conditions:
1. That this vacation shall be subject to the terms
and conditions of Chapter 130, codified March 1 , 1981,
of the Saint Paul Legislative Code, as amended.
2. That the Council of the City of Saint Paul hereby
authorizes the proper City officials to convey the
vacated property, by Quit Claim Deed, to the League of
Minnesota Cities (L.M.C. ) for $500 plus the cost of
real estate appraisal fees in the� amount of $1 , 2P10 for
a total of $1 ,700. ,

3 . That the L.M.C. , its successors, anc� assigns shall
provide a Registered Land Survey re�uired by the
Registrar of Titles , Ramsey County, ` Minnesota, of the
entire parcel that contains the tr ct of land to be
conveyed to the L.M.C. including a revised description
of the vacated area that lea es all portions,
beginning at the top of the slope and northerly, in the
City's ownership.
4. That final design of L.M.C. ' s bui ding addition and
plans for restoration and protec ion of the integrity
of the slopes which affect Easte n Park, shall be
approved by the Mayor of the Cit of Saint Paul .
5. That access to the construction area of L.M.C. ' s new
addition shall be from Universi y Avenue only and that
there shall be no access over o across Eastern Park
Playground.
6. That a permanent easement be retained within the
vacated area to protect the interests of District
Energy, St. Paul, Inc.
7 . That the L.M.C. , its successo s, and assigns , by
acceptance of the terms and c nditions of this
vacation agree to indemnify, �efend, and save harmless
the City of Saint Paul, its officers, and employees
from all suits , actions , or claims of any character
brought as a result of injuries or damages received or
sustained by any person, persons , or property on
account of this vacation or petitioner ' s use of this
