WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hoid public hearings to consider the advisability and necessity of
ordering the repair or wrecking and removal of a one and one-haif, story wood frame dwelling
located on properiy hereinafter referred to as the "Subject Properiy" and commonly known as 312
Erie Street. This property is legally described as follows, to wit:
L,ot 15, Block 13, A. Vance Brown's Subdivision of Biock 4 and East Half of Block
13 of Brown, Stinson and Ramsey's Addition to St. Paul.
WHEREAS, based upon the records in the Ramsey Counry Recorder's Office and
information obtained by Division of Code Enforcement an or before June 5, 1998, the following are
the now known interested or responsible parties for the Subject Property: Diane E. McCabe, 33334
County 25 Blvd., Cannon Falls, MN 55009-4234; Tracy J. Demo, 312 Erie Street, St. Paui, MN
55102-3239; Hiway Credit Union, 111 Empire Drive, St. Paul, MN 55103; Ramsey County

WHEREAS, Division of Code Enforcement has served 'an accordance with the provisions of
Chapter 45 of the Saint Paul Lzgislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated July 8, 1998; and
WHEREAS, this order informed ffie then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by July 22, 1998; and
WHEREAS, the enforcement of�cer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condifion has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the City CouncIl and the Saint Paul Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul L,egislative Code, of the tune, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the L,egislatave Hearing Officer of the Saint Paul City
Council on Tuesday, September 15, 199$ to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with ail applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed with five (� days after the date of
the Council Aearing; and
R'HEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 23, 1998 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts ihe following Findings and
Order concerning the Subject Properry at 312 Erie Street:
1. That the Subject Property comprises a nuisance condit3on as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properiy.
4. That an Order to Abate Nuisance Bnilding(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safery
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notificauon requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul Ciry Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this shucture and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within five (� days after the date
of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this struciure, fill the site and charge the costs incurred
against the Subject Property pursuantto the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, ali
personal properry or fixtures of any kind which interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

Gerry Strathman called the meeting to order at 10:02 am.
Resolution ordering the owner to remove or repair the building located at 370 Atwater
Street If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Tom Walsh, owner, appeazed.
Chuck Votel reported the building was condemned October 14, 1997. The vacant buiiding
registration fees are paid. The real estate taxes aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an esfimated market value on the property of $53,300. A Code
Compliance Inspe�tion was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the buiiding within 15 days. The owner
says he intends to repair the property.
Gerry Strathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.

Chuck Votel reported this buiiding was condemned February 11, 1998. Diane McCabe is the
registered owner. Appazently a new owner Tracy Demo has recently stepped forward. There
have been two summary abatement notices issued for removing garbage from the dwelling and
reaz yazd and to cut tall grass. Ramsey Counry T�ation has placed an estimated market value of
$33,500 on the praperiy. Code Enforcement estimates the cost to repair this structure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Gerry Strathman recommended approval citing all information indicates the building is beyond
salvation.

Toumaua I.ee, owner, appeazed.
Guy VJillits repoY�ed orders were mailed with a compliance date of June 22, 1998. Wark was not
completed. The Thomas-Dale Block Club cut the grass for a total of $280 on June 23.
Toumoua Lee, owner, appeued and stated he was taking possession of the property at the time of
this incident. He asked for the assessment to be reduced.
Gerry Strathman stated the notification was sent to both the mortgage company and to Toumoua
I,ee before the work was done. The assessment is against the property, therefore the present
owner is responsible for it. If the assessment was done before Mr. T_ee became the owner, he
could make claim against the previous owner.
Gerry Strathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicie with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
person did not tell Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
ptoperty.
787 Fuller Avenue
Guy Willits reported this assessment is for cieanup of an illegal dumping spilling over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capable of removing the spillover. Mr. Wiliits suggested deleting the assessment.
Legislauve Hearing Off'icer recommended deleting the assessment citing the spillover was not
under the owner's conuol.

Guy Willits reported one of the two people that lived there died last week. Mr. Willits suggested
laying over to October 6.

981 Argvle Street
Kirby Henke, owner, appeared.
Hazold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yard at 981 Argyle Street. '1`he order was issued Apri122, 1998. Mr.
Robertson sgoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Parks and Recreation after the compliance date. At that time, Mr.
Henke said he would clean it himself. Pazks and Recreation cleaned the property on May 8,
1998. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Harold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Hettke that he could
clean up the property. Mr. Henke had taken some of the items frozn the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
proper[y. Mr. Henke was trying to resolve getting back into the property when the wotk was
done by the City. The following damage was done by the City workers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
rigped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue grill.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
Attorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approvai of the assessment.

Guy Wiliits reported orders were mailed on three times for ihe dilapidated garage with a
compliance date of May 3Q 1998. The gazage was removed by the City on July 9, 1998.
Gerry Strathman recommended approval of the assessment.
Pronertv Code Enforcement Anneai for 1564 Unner Afton Road.
No one appeared representing the property.
Thomas LeClair reported he talked to the owner this morning. T`he owner says he found a sketch
that shows a trench system Qn his septic system. This is completely different than what is on the
annual inspection report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector system on the ground to substantiate the trench system. Mr. LeClair is
agreeable to a six week layover.

Gerry Strathman called the meeting to order at 10:02 am.
Resolution ordering the owner to remove or repair the building located at 370 Atwater
Street If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Tom Walsh, owner, appeazed.
Chuck Votel reported the building was condemned October 14, 1997. The vacant buiiding
registration fees are paid. The real estate taxes aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an esfimated market value on the property of $53,300. A Code
Compliance Inspe�tion was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the buiiding within 15 days. The owner
says he intends to repair the property.
Gerry Strathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation.

Chuck Votel reported this buiiding was condemned February 11, 1998. Diane McCabe is the
registered owner. Appazently a new owner Tracy Demo has recently stepped forward. There
have been two summary abatement notices issued for removing garbage from the dwelling and
reaz yazd and to cut tall grass. Ramsey Counry T�ation has placed an estimated market value of
$33,500 on the praperiy. Code Enforcement estimates the cost to repair this structure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Gerry Strathman recommended approval citing all information indicates the building is beyond
salvation.

Toumaua I.ee, owner, appeazed.
Guy VJillits repoY�ed orders were mailed with a compliance date of June 22, 1998. Wark was not
completed. The Thomas-Dale Block Club cut the grass for a total of $280 on June 23.
Toumoua Lee, owner, appeued and stated he was taking possession of the property at the time of
this incident. He asked for the assessment to be reduced.
Gerry Strathman stated the notification was sent to both the mortgage company and to Toumoua
I,ee before the work was done. The assessment is against the property, therefore the present
owner is responsible for it. If the assessment was done before Mr. T_ee became the owner, he
could make claim against the previous owner.
Gerry Strathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicie with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
person did not tell Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
ptoperty.
787 Fuller Avenue
Guy Willits reported this assessment is for cieanup of an illegal dumping spilling over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capable of removing the spillover. Mr. Wiliits suggested deleting the assessment.
Legislauve Hearing Off'icer recommended deleting the assessment citing the spillover was not
under the owner's conuol.

Guy Willits reported one of the two people that lived there died last week. Mr. Willits suggested
laying over to October 6.

981 Argvle Street
Kirby Henke, owner, appeared.
Hazold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yard at 981 Argyle Street. '1`he order was issued Apri122, 1998. Mr.
Robertson sgoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Parks and Recreation after the compliance date. At that time, Mr.
Henke said he would clean it himself. Pazks and Recreation cleaned the property on May 8,
1998. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Harold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Hettke that he could
clean up the property. Mr. Henke had taken some of the items frozn the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
proper[y. Mr. Henke was trying to resolve getting back into the property when the wotk was
done by the City. The following damage was done by the City workers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
rigped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue grill.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
Attorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approvai of the assessment.

Guy Wiliits reported orders were mailed on three times for ihe dilapidated garage with a
compliance date of May 3Q 1998. The gazage was removed by the City on July 9, 1998.

Pronertv Code Enforcement Anneai for 1564 Unner Afton Road.
No one appeared representing the property.
Thomas LeClair reported he talked to the owner this morning. T`he owner says he found a sketch
that shows a trench system Qn his septic system. This is completely different than what is on the
annual inspection report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector system on the ground to substantiate the trench system. Mr. LeClair is
agreeable to a six week layover.

5. That the deficiencies causing this nuisance condition have not been corrected.

Division of Code Enforcement has declared this buiiding(s) to constitute a"nuisance" as
defined by I,egislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condifion by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council gass a resolution
ordering the zesponsible parties to either repair, or demolish and remove this building in a
timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removai, and to assess the costs incuned against the real estate as a special
assessment to be collecked in the same manner as taxes.

Robinson, Pubiic Aealth; Chuck Votel, Code Enforcement; Guy Willits, Code Enforcement
Gerry Strathman called the meeting to order at 10:02 am.
Resolution ordering the owner to remove or repair the building located at 370 Atwater
Street If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Tom Walsh, owner, appeazed.
Chuck Votel reported the building was condemned October 14, 1997. The vacant buiiding
registration fees are paid. The real estate taxes aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an esfimated market value on the property of $53,300. A Code
Compliance Inspe�tion was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the buiiding within 15 days. The owner
says he intends to repair the property.
Gerry Strathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation.

No one agpeazed representing the property.
Chuck Votel reported this buiiding was condemned February 11, 1998. Diane McCabe is the
registered owner. Appazently a new owner Tracy Demo has recently stepped forward. There
have been two summary abatement notices issued for removing garbage from the dwelling and
reaz yazd and to cut tall grass. Ramsey Counry T�ation has placed an estimated market value of
$33,500 on the praperiy. Code Enforcement estimates the cost to repair this structure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Gerry Strathman recommended approval citing all information indicates the building is beyond
salvation.

Toumaua I.ee, owner, appeazed.
Guy VJillits repoY�ed orders were mailed with a compliance date of June 22, 1998. Wark was not
completed. The Thomas-Dale Block Club cut the grass for a total of $280 on June 23.
Toumoua Lee, owner, appeued and stated he was taking possession of the property at the time of
this incident. He asked for the assessment to be reduced.
Gerry Strathman stated the notification was sent to both the mortgage company and to Toumoua
I,ee before the work was done. The assessment is against the property, therefore the present
owner is responsible for it. If the assessment was done before Mr. T_ee became the owner, he
could make claim against the previous owner.
Gerry Strathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicie with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
person did not tell Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
ptoperty.
787 Fuller Avenue
Guy Willits reported this assessment is for cieanup of an illegal dumping spilling over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capable of removing the spillover. Mr. Wiliits suggested deleting the assessment.
Legislauve Hearing Off'icer recommended deleting the assessment citing the spillover was not
under the owner's conuol.

Guy Willits reported one of the two people that lived there died last week. Mr. Willits suggested
laying over to October 6.

981 Argvle Street
Kirby Henke, owner, appeared.
Hazold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yard at 981 Argyle Street. '1`he order was issued Apri122, 1998. Mr.
Robertson sgoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Parks and Recreation after the compliance date. At that time, Mr.
Henke said he would clean it himself. Pazks and Recreation cleaned the property on May 8,
1998. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Harold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Hettke that he could
clean up the property. Mr. Henke had taken some of the items frozn the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
proper[y. Mr. Henke was trying to resolve getting back into the property when the wotk was
done by the City. The following damage was done by the City workers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
rigped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue grill.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
Attorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approvai of the assessment.

Guy Wiliits reported orders were mailed on three times for ihe dilapidated garage with a
compliance date of May 3Q 1998. The gazage was removed by the City on July 9, 1998.
Gerry Strathman recommended approval of the assessment.
Pronertv Code Enforcement Anneai for 1564 Unner Afton Road.
No one appeared representing the property.
Thomas LeClair reported he talked to the owner this morning. T`he owner says he found a sketch
that shows a trench system Qn his septic system. This is completely different than what is on the
annual inspection report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector system on the ground to substantiate the trench system. Mr. LeClair is
agreeable to a six week layover.
