WFIEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisability and necessity of
arderiug the repair or wrecking and removal of a one-story, wood frame dwelling located on
properiy hereinafter refened to as the "Subject Property" and commonly lmown as 370 Atwater
Street. T'his properry is legally described as follows, to wit:
The North 2!3 of Lots 14, 15 and 16, Block 2, Pacific Addition to Saint Paul.
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before March 4, 1998, the following
are the now known interested or responsible parties for the Subject Properry: Thomas V. Walsh,
5635 165th 5treet North, Hugo, MN 55038-9397; Heartland Credit Union, 5500 E. Babcock Trail,
Inver Grove Heights, MN 55077
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul I,egislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated April 9, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by 7uly 8, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
VJHEREAS, this nuisance condiuon has not been corrected and Division of Code
Enforcement requested that the Ciry Clerk schedule public hearings before the L,egislative Hearing
Officer of the City Council and the Saint Pau1 Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
purpose of the public hearings; and
WHER.EAS, a heariug was held before the I.egislative Hearing Officer of the Saint Paul Ciry
Council on Tuesday, September 15, 1998 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable aodes and ordinances, or in the alYernative by
demolishing and removing the structure in accordance with all appiicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within �'�' °^�� after the

WF3EREAS, a hearing was held before the Saint Paul City Council on VJednesday,
September 23, 1998 and the testimony and evidence including the action taken by the I.egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning ihe Subject Properry at 370 Atwater Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s} is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nnisance Building(s) was sent to the ffien known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subyect Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties sha11 make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolirion and removal of the structure must be completed within-��'°°^� �?a,s after the

2. If the above correcrive action is not comgleted within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and chazge the costs incurred
against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properry or fi�tnres of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the Ciry
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsibie parties to either repair, or demolish and remove this building in a
timely manner, and faiIin� that, authorize the Aivision of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Robinson, Public Health; Chuck Votel, Code Enforcement; Guy Willits, Code Enforcement
Gerry Strathman called the meeting to order at 10:02 am.
Resolution ordering the owner to remove or repair tlse building located at 370 Atwater
Stree� If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Tom Walsh, owner, appeared.
Chuck Votel reported the building was condemned October 14, 1997. The vacant building
registration fees aze paid. The real estate ta�ces aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an estimated mazket value on the property of $53,300. A Code
Compliance Inspection was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the building within I S days. The owner
says he intends to repair the property.
Gerry Suathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation.

No one appeared representing the property.
Chuck Votel reported this building was condemned Pebruary 11, 1998. Diane McCabe is the
registered owner. Appazentiy a new owner Tracy Demo has recently stepped forwazd. There
have been two summary abatement notices issued for removing gazbage from the dweiling and
reaz yard and to cut tall grass. Ramsey County T�ation has placed an estimated market value of
$33,500 on the property. Code Enforcement estimates the cost to repair this siructure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Toumoua Lee, owner, appeazed.
Guy Wiilits reported orders were mailed with a compliance date of 3une 22, 1998. Work was not
compieted. The Thomas-Dale Block Club cut the grass for a total of $280 on 7une 23.
Toumoua Lee, owner, appeared and stated he was taking possession of the property at the time of
ihis incident. He asked for the assessment to be reduced.
Gerry Suathman stated the notification was sent to both the mortgage company and to Toumoua
Lee before the work was done. The assessment is against the properry, therefore the present
owner is responsible for it. If the assessment was done before Mr. I.ee became the owner, he
could make claim against the previous owner.
Gerry Suathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicle with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
pezson did not teli Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
property.
787 Fuller Avenue
Guy Willits reported this assessment is for cleanup of an illegal dumping spiliing over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capahle of removing the spillover. Mr. Wiilits suggested deleting the assessment.
I.egislative Hearing Officer recommended deleting the assessment citing the spillover was not
under the owner's control.

Guy Willits reported one of the two people thax lived there died last week. Mr. Willits suggested
laying over to October 6.

981 Arevle Street
Kirby Henke, owner, appeazed.
Harold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yazd at 981 Argyle 3treet. The order was issued April 22, 1998. Mr.
Robertson spoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Pazks and Re�reation after the compliance date. At that time, Mr.
Henke said he wouid clean it himself. Pazks and Recreation cleaned the properry on May 8,
1498. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Hazold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Henke that he could
clean up the property. Mr. Henke had taken some of the items from the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
property. Mr. Henke was trying to resolve getting back into the property when the work was
done by the City. The following damage was done by the City wotkers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
ripped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue griii.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
AYtorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approval of the assessment.

Guy Willits reported orders were mailed on three times for the dilapidated gazage with a
compliance date of May 3Q 1998. The garage was removed by the City on 3uly 9, 1998.
Gerry Strathman recommended approval of the assessment.
Pronertv Code Enforcement Anueal for 1564 Unner Afton Road.
No one appeared representing the properry.
Thomas LeClair reported he talked to the owner this morning. The owner says he found a sketch
that shows a trench system on his sepuc system. This is compietely different than what is on the
annual inspecuon report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector sysiem on the ground to substantiate the trench system. Mr. L.eClair is
agreeable to a six week layover.

Robinson, Public Health; Chuck Votel, Code Enforcement; Guy Willits, Code Enforcement
Gerry Strathman called the meeting to order at 10:02 am.
Resolution ordering the owner to remove or repair tlse building located at 370 Atwater
Stree� If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Tom Walsh, owner, appeared.
Chuck Votel reported the building was condemned October 14, 1997. The vacant building
registration fees aze paid. The real estate ta�ces aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an estimated mazket value on the property of $53,300. A Code
Compliance Inspection was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the building within I S days. The owner
says he intends to repair the property.
Gerry Suathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.
Gerry Strathman recommended allowing the owner six months to complete rehabilitation.

Chuck Votel reported this building was condemned Pebruary 11, 1998. Diane McCabe is the
registered owner. Appazentiy a new owner Tracy Demo has recently stepped forwazd. There
have been two summary abatement notices issued for removing gazbage from the dweiling and
reaz yard and to cut tall grass. Ramsey County T�ation has placed an estimated market value of
$33,500 on the property. Code Enforcement estimates the cost to repair this siructure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Toumoua Lee, owner, appeazed.
Guy Wiilits reported orders were mailed with a compliance date of 3une 22, 1998. Work was not
compieted. The Thomas-Dale Block Club cut the grass for a total of $280 on 7une 23.
Toumoua Lee, owner, appeared and stated he was taking possession of the property at the time of
ihis incident. He asked for the assessment to be reduced.
Gerry Suathman stated the notification was sent to both the mortgage company and to Toumoua
Lee before the work was done. The assessment is against the properry, therefore the present
owner is responsible for it. If the assessment was done before Mr. I.ee became the owner, he
could make claim against the previous owner.
Gerry Suathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicle with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
pezson did not teli Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
property.
787 Fuller Avenue
Guy Willits reported this assessment is for cleanup of an illegal dumping spiliing over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capahle of removing the spillover. Mr. Wiilits suggested deleting the assessment.
I.egislative Hearing Officer recommended deleting the assessment citing the spillover was not
under the owner's control.

Guy Willits reported one of the two people thax lived there died last week. Mr. Willits suggested
laying over to October 6.

981 Arevle Street
Kirby Henke, owner, appeazed.
Harold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yazd at 981 Argyle 3treet. The order was issued April 22, 1998. Mr.
Robertson spoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Pazks and Re�reation after the compliance date. At that time, Mr.
Henke said he wouid clean it himself. Pazks and Recreation cleaned the properry on May 8,
1498. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Hazold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Henke that he could
clean up the property. Mr. Henke had taken some of the items from the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
property. Mr. Henke was trying to resolve getting back into the property when the work was
done by the City. The following damage was done by the City wotkers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
ripped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue griii.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
AYtorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approval of the assessment.

compliance date of May 3Q 1998. The garage was removed by the City on 3uly 9, 1998.

No one appeared representing the properry.
Thomas LeClair reported he talked to the owner this morning. The owner says he found a sketch
that shows a trench system on his sepuc system. This is compietely different than what is on the
annual inspecuon report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector sysiem on the ground to substantiate the trench system. Mr. L.eClair is
agreeable to a six week layover.

information obtained by Division of Code Enforcement on or before March 4, 1998, the following
are the now known interested or responsible parties for the Subject Properry: Thomas V. Walsh,

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of

1. That the Subject Property comprises a nuisance condition as defined in Saint Paul

three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.

5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subyect Property

Services, Division of Code Enforcement, Vacant/Nuisance Buildings.

Inasmuch as this Order to Abate has not been compiied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsibie parties to either repair, or demolish and remove this building in a
timely manner, and faiIin� that, authorize the Aivision of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Gerry Strathman called the meeting to order at 10:02 am.

Tom Walsh, owner, appeared.
Chuck Votel reported the building was condemned October 14, 1997. The vacant building
registration fees aze paid. The real estate ta�ces aze unpaid in the amount of $2,741.70. Ramsey
County Taxation has placed an estimated mazket value on the property of $53,300. A Code
Compliance Inspection was done on May 8, 1998. A$2,000 bond was posted in September.
This resolution orders the owner to repair or remove the building within I S days. The owner
says he intends to repair the property.
Gerry Suathman viewed photographs of the property. He asked was there any reason to proceed
with the order instead of granting the customary six month extension. Chuck Votel responded
no.

Chuck Votel reported this building was condemned Pebruary 11, 1998. Diane McCabe is the
registered owner. Appazentiy a new owner Tracy Demo has recently stepped forwazd. There
have been two summary abatement notices issued for removing gazbage from the dweiling and
reaz yard and to cut tall grass. Ramsey County T�ation has placed an estimated market value of
$33,500 on the property. Code Enforcement estimates the cost to repair this siructure is $50,000.
The cost to demolish is $5,000 to $6,000. This resolution orders the owner to repair or remove
the building within five days. The Code Compliance Inspection was done in August. The house
has been extensively damaged by fire, smoke, and water.

Guy Wiilits reported orders were mailed with a compliance date of 3une 22, 1998. Work was not
compieted. The Thomas-Dale Block Club cut the grass for a total of $280 on 7une 23.
Toumoua Lee, owner, appeared and stated he was taking possession of the property at the time of
ihis incident. He asked for the assessment to be reduced.
Gerry Suathman stated the notification was sent to both the mortgage company and to Toumoua
Lee before the work was done. The assessment is against the properry, therefore the present
owner is responsible for it. If the assessment was done before Mr. I.ee became the owner, he
could make claim against the previous owner.
Gerry Suathman recommended approval of the assessment.
851 Tuscarora Avenue
Guy Willits reported orders were mailed five times to the owner to remove a vehicle with expired
plates from the yazd. There were four compliance dates given. The City removed it for $333.
Jose Gustavo Ortiz, owner, appeared and stated he temporarily moved to Mexico and came back
last month. The person that lived in the house while he was gone did not move the vehicle. This
pezson did not teli Mr. Ortiz about the orders.
Gerry Strathman recommended approval of the assessment citing the owner is responsible for the
property.
787 Fuller Avenue
Guy Willits reported this assessment is for cleanup of an illegal dumping spiliing over from 783
Fuller Avenue onto 787 Fuller Avenue. The owner of 787 Fuller Avenue is an elderly woman;
she was not capahle of removing the spillover. Mr. Wiilits suggested deleting the assessment.

under the owner's control.

Guy Willits reported one of the two people thax lived there died last week. Mr. Willits suggested

981 Arevle Street
Kirby Henke, owner, appeazed.
Harold Robertson reported this assessment comes from a summary abatement issued by Code
Enforcement to clean the yazd at 981 Argyle 3treet. The order was issued April 22, 1998. Mr.
Robertson spoke to Kirby Henke in May when a night inspection was done because illegal
occupancy was suspected. This property had previously been condemned for fire damage and
lack of basic facilities. Mr. Robertson advised Mr. Henke that a work order had been sent and
cleanup would be done by Pazks and Re�reation after the compliance date. At that time, Mr.
Henke said he wouid clean it himself. Pazks and Recreation cleaned the properry on May 8,
1498. It was an extensive cleanup.
Kirby Henke viewed the photographs provided by Hazold Robertson and stated a friend was
going to clean it up the day before it was done. The Fire Marshal told Mr. Henke that he could
clean up the property. Mr. Henke had taken some of the items from the fire damage out of the
house. The police arrested him for being in a condemned building and ordered him off the
property. Mr. Henke was trying to resolve getting back into the property when the work was
done by the City. The following damage was done by the City wotkers: the fence was knocked
down, the grass was ripped up, a tree was damaged, cement was ripped up, the entire patio was
ripped up, and the patio furniture was taken. A friend drove by and stopped the workers from
taking the boat and the barbecue griii.
A videotape was viewed showing the property before and after the cleanup.
Gerry Strathman informed Kirby Henke that the damage to the property as a result of the cleanup
cannot be dealt with here. Mr. Strathman told Mr. Henke to fill out a claim at the City
AYtorney's Office for any damages incurred during the cleanup of the property.
Gerry Strathman recommended approval of the assessment.

compliance date of May 3Q 1998. The garage was removed by the City on 3uly 9, 1998.

Thomas LeClair reported he talked to the owner this morning. The owner says he found a sketch
that shows a trench system on his sepuc system. This is compietely different than what is on the
annual inspecuon report. The owner wants six weeks to verify the information that he has. The
report could be sustained or amended depending on what is found. Mr. Dufresne plans to use an
infrared detector sysiem on the ground to substantiate the trench system. Mr. L.eClair is
agreeable to a six week layover.
