WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in �293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Great Waters Brewing Company, represented by Sean
O'Burne, Vice-President, who has been designated as the
responsible person on the application, has applied for a variance
to allow live music at 426 Saint Peter Street on 7"' Place Plaza,
on October 1, 2 and 3, 1998; and
WHEREAS, applicant is seeking a variance for the hours of
4:30 p.m. to 10:00 p.m. on October 1 and 2, 1998 and for the
hours of 12:00 noon to 10:00 p.m. on October 3, 1998; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Great Waters Brewing Company, subject to the
£ollowing conditions:
1) The variance shall be for the hours of 4:30
p.m to 10:00 p.m. on October 1 and 2, 1998
and between the hours of noon to 10:00 p.m.
on October 3, 1948.
2) A11 electronically powered equipment used in
conjunction with the event shall not exceed
90 dBA as measured at the closer of the sound
mix or at a distance of 100 feet from the
front of the stage.
3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 4:30 p.m. and 10:00
p.m. on October 1 and 2, 1995 and between / A
noon and 10:00 p.m. on October 3, 1998 to �p ��y 1
ensure compliance with Condition #2. 0
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
sha11 be turned off no later than 10:00 p_m.
on all three dates.
FURTAER RESOLVED, that any violation of the conditions set
forth above during the October 1, 1998 date may result in
revocation of the grant of a variance for the October 2 and 3,
1998 dates, and any violation of the conditions set forth above
during the October 2, 1998 date may also result in revocation of
the grant of a variance for the October 3, 1998 date, in addition
to any criminal citation which might issue.

Great Waters Brewing Company, represented by Sean O'Byrne, has requested a
sound level variance for live music in an outdoor tent at 426 St. Peter Street
on 7th Place Plaza. The variance is requested from 4:3fl p.m. to 10:00 p.m. on
October 1 and 2, 1998, and for i2:00 noon to 10:00 p.m. on October 3, 1998.
DVANTAGES IF APPROVED:

residential and commercial areas.
DISADVANTAGES IF APPROVED:
Persons living or working near Great Waters Brewing Company, 426 St. Peter
Street and 7th Place Plaza will be able to hear the sounds from the event that

Great Waters Brewing Company, represented by Sean O'Byrne, has requested a
sound level variance for live music in an outdoor tent at 426 St. Peter Street
on 7th Place Plaza. The variance is requested from 4:3fl p.m. to 10:00 p.m. on
October 1 and 2, 1998, and for i2:00 noon to 10:00 p.m. on October 3, 1998.
DVANTAGES IF APPROVED:
ill place conditions that will limit the sound impact in surrounding
residential and commercial areas.
DISADVANTAGES IF APPROVED:
Persons living or working near Great Waters Brewing Company, 426 St. Peter
Street and 7th Place Plaza will be able to hear the sounds from the event that
ay be louder than when there is no event. May require staff time to monitor
compliance with the variance if approved.
DISADVANTAGES IF NOT APPROVED:
The sound level impact on surrounding residential and commercial areas could
e greater with no conditions. Applicant may not be able to present the event
