Gi� Committee: Date WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in �293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the community; and WHEREAS, Great Waters Brewing Company, represented by Sean O'Burne, Vice-President, who has been designated as the responsible person on the application, has applied for a variance to allow live music at 426 Saint Peter Street on 7"' Place Plaza, on October 1, 2 and 3, 1998; and WHEREAS, applicant is seeking a variance for the hours of 4:30 p.m. to 10:00 p.m. on October 1 and 2, 1998 and for the hours of 12:00 noon to 10:00 p.m. on October 3, 1998; and WHEREAS, if applicant is not granted a variance it will not be able to present the live music; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Great Waters Brewing Company, subject to the £ollowing conditions: 1) The variance shall be for the hours of 4:30 p.m to 10:00 p.m. on October 1 and 2, 1998 and between the hours of noon to 10:00 p.m. on October 3, 1948. 2) A11 electronically powered equipment used in conjunction with the event shall not exceed 90 dBA as measured at the closer of the sound mix or at a distance of 100 feet from the front of the stage. 3) The applicant shall provide personnel and equipment who shall provide continuous sound level monitoring between 4:30 p.m. and 10:00 p.m. on October 1 and 2, 1995 and between / A noon and 10:00 p.m. on October 3, 1998 to �p ��y 1 ensure compliance with Condition #2. 0 4) All electronically powered equipment, PA systems, loudspeakers or similar devices sha11 be turned off no later than 10:00 p_m. on all three dates.
