WHEREAS, Table of Contents, Inc. DBA Table of Contents at 1648
Grand Avenue has applied for a Modification of Parking
Requirements for a liquor license to reduce the required
off-street parking from 19 spaces to 7 spaces; and
AHEREAS, notice of a public hearing before the City Council was
duly mailed to each owner of affected property within 350 feet of
the property for which the modification of parking requirements
was sought; and
WHEREAB, the City Council based on evidence presented at the
public hearing as substantially reflected in the minutes make the
following findings of fact:
1. The Table of Contents. Restaurant has 32 seats in its main
dining area and 12 more seats in the walkway close to the
entrance to the bookstore and to the basket shop. The
applicant has indicated that the restaurant operates until
11: 30 P.M. on Friday and Saturday nights, but only until
10: 30 P.M. Monday through Thursday. The restaurant has been
in operation since mid-April 1990 and occupies the commercial
space previously occupied by the Phoenix Restaurant.
2. The 1983 Grand Avenue Task Force Report on parking and zoning
indicated that the Grand & Cambridge commercial cluster,
which includes this location, had a surplus of 51 parking
spaces during the evening, but had a shortfall of 137 parking
spaces during the day. The report pointed out that this
parking shortage "is not due to any single business; rather
it is the combination of many small individual shortages. " It
is expected that the addition of Kinkos to this commercial
area since then may have added to the daytime parking
shortfall and diminished the evening parking surplus.
3 . The applicant has indicated that none of the other businesses �
on Grand between Macalester St. and Cambridge St. have any
additional parking spaces which could potentially be used to
meet this liquor license parking requirement. Actually, many
of these businesses do not have any off-street parking spaces
for their businesses. The applicant has indicated that
adjacent businesses seem to accept the existing shortage of
parking in the area as one of the conditions of doing
business there.

4. The applicant has indicated that a liquor license will not
increase the number of customers who already are served by
the restaurant, particularly over the lunch hour, the period
of highest parking demand. He also indicated that some
customers have requested wine or beer with their meals and
that he is concerned about the possibility of losing this
business if a liquor license is not granted. The applicant
has also expressed concern about being "held hostage" on the
liquor license issue for the overall off-street parking
shortage in this commercial area which has existed for many
years.
5. The applicant has submitted a petition of support signed by
the business owners of ten businesses on this block of Grand
Avenue. These businesses support the efforts of the applicant
because they believe that the success of the Table of
Contents Restaurant will have a favorable impact on
attracting additional clientele to their own businesses. The
applicant has also received letters of support from two local
churches and from Macalester College.
NOW, THEREFORE, BE IT RESOLVED, by the City Council that the

Dear Sir:
Attached is the staff report for the request by the Table of
Contents Restaurant for a reduction in the amount of parking
required for a beer and wine license.
The Table of Contents Restaurant wishes to provide beer and wine
to their restaurant customers, but does not have sufficient land
to accommodate the required additional parking. In calculating
the additional parking required for this requested liquor
license, the Table of Contents is 12 parking spaces short.
The Table of Contents currently shares the 28 existing off-street
parking spaces in the parking lot across the street with three
other businesses. It is likely that this restaurant with a
liquor license will not serve any more customers than it
currently serves without a liquor license. In addition, most of
the clientele at the Table of Contents seeking such beverages are
likely to frequent the restaurant in the evening when there are
sufficient off-street parking spaces available in the immediate
area.

3. LOCATION: 1648 Grand Avenue (South side of Grand between Cambridge & Macalester)

5. STAFF INVESTIGATION AND REPORT: DATE: July 17, 1990 BY: Marv Bunnell
A. PURPOSE: The applicant is requesting a modification of parking requirements for
an on-sale beer and wine liquor license. The modification would permit the
applicant to serve liquor within the existing establishment. Based on the size
of the establishment and the patron area within the building, staff calculated
that to meet the licensing parking requirement the applicant would have to
provide 12 additional parking spaces.
B. LEGISLATIVE CODE CITATION:
Parking: Section 410.04 of the Legislative Code requires that establishments
with on sale liquor licenses provide one off-street parking space for every 45
square feet of patron area. However, it provides for modifications of this
requirement:
"The council may modify the off-street parking requirements contained in this
section. . .upon findings made by the council that granting of such modification
would not have a substantial detrimental impact on the surrounding neighborhood.
Modification, if granted, shall be by resolution adopted by at least five (5)
affirmative votes."
"In granting any modification, the council may attach reasonable conditions
regarding the location, design, character and other features of the licensed
structure and parking area deemed necessary for the protection of the adjacent
neighborhood."
C. SITE AND AREA CONDITIONS: This establishment is located in a commercial
building shared with the Hungry Mind Bookstore and the Basket Shoppe. These
establishments share with Kinkos the 28 off-street parking spaces in the parking
lot located across Grand Avenue. This parking lot is zoned R-3 and is controlled
by the operator of the Hungry Mind Bookstore. There is no off-street parking on
the site. This property and the parking lot across the street are owned by
Macalester College.
D. BACKGROUND:
The Table of Contents Restaurant has 1,095 square feet of commercial space and
875 square feet of patron area requiring 19 off-street spaces to meet the liquor
license requirements as calculated by BIDD staff. BIDD staff have indicated that
the restaurant is legally non-conforming for 7 parking spaces based on the
previous use, the Phoenix Restaurant. They have further stated that they will

not count any of the spaces in the parking lot across the street for meeting
these liquor license needs or for any future expansion needs of the Table of
Contents.
The District 14 Community Council has taken a position in opposition to granting
the requested parking modification for the liquor license at the Table of
Contents. One concern is that there are not enough off-street parking spaces in
this area for the existing businesses. In addition, this Council is concerned
about the duration of a parking modification for a liquor license and potential
changes to the business that could further aggravate the difficult parking
situation currently there.
E. FINDINGS:

F. STAFF ANALYSIS AND RECOMMENDATION: Staff notes that the parking lot across the
street used by these businesses should be rezoned B-2 or P-1 to be in
conformance with the Zoning Code. However, a recommendation of the Planning
Commission to the City Council recommends that the Zoning Code be changed to
allow the shared use of institutional parking spaces in residential zones with
nearby businesses. If and when this particular recommendation of the Planning
Commission (Ordinance #90-1135) is adopted, staff strongly recommends that the
Table of Contents and the other businesses currently using this parking lot in
the R-3 district strive to meet all of the required conditions to legally use
this lot. This issue should be revisited when the requested license is renewed.
Therefore, based on findings 1 through 5, staff recommends approval of the
modification of parking requirements from 19 to 7 off-street parking spaces.

Section 62. 103(d) of the Saint Paul Zoning Ordinance exempts certain uses from
the off-street parking requirements, when a new use results in an increase of
five (5) or fewer spaces. The difference between the off-street parking
required for the existing restaurant floor area and the proposed expanded
floor area is four (4) spaces. Additional off-street parking is therefore not
required.
The above statement is made with the understanding that you do not intend to
serve intoxicating beverages on the premises. The parking requirement for a
restaurant serving beer or wine is one space for every 45 square feet of the
patron area. Additional off-street space will be necessary in this case. In
our conversations you stated that Macalester College owns an existing parking
lot in the vicinity of the restaurant and the parking spaces are leased to the
businesses in this area. It is the determination of this office that the
vehicle spaces in this lot are already designated for these commercial uses
and will not be counted toward meeting any future needs for parking in this
area.
You are advised that this is a decision of the Zoning Administrator's office
and is appealable by anyone for a period of 30 days from the date of this
letter.

Thank you for taking an interest in our problem -- we
sincerely a�preciate your time anci effort . This letter details
much of the p�rtinent information concerniny our variance, and,
except for this addendum, is identical to those I 'm sending off to
the other Councilmembers . I hope it ' s somewhat persuasive . IF you

I 'm writing you conc�rnirig th� July 31st hearing on a parking
variance and beer & wine license for Table of Contents restaurant ,
We thought you might wi�ki to see our view of the situation as well
as obtain �ome background on us to aid your assessment of our
request . I 'm seriding off similar letters to all of the City
Councilmembers in the Yiope that this can save some time and
repetition during ttze the hearing process . Thanks for taking tne
time to read through tkiis . We feel that we ' re cnaking a fair
proposal and we hope you can support us in our quest for a parking
variance .
First off , I ' ll reiterate the essentials , Code requires us
to have 12 off-street spots for a be�r & wine license, additional
to our restaurant-use requirement . On March 15th we appeared
before the monthly meeting of the District 14 Council . At this
meeting w� presented a petition signed by ten businesses on our
block of Grand, photos of the low density of parking or� Granci at
5 : 30 p.m. , anci shots of the various pieces of undeveloped potential
parking belonging to other businesses on our block . We brought
these items as supplements to our primary line of reasoning, that
in this particular case the coc�e is inappropriate and should be set
aside. The Council ' s vote was split, the majority against our
proposal . The issue which seemed to affect several of the members
concerned the lasting nature of the variance : what would prevent,
as with the recent Tower Tap decision, a full liquor license coming
into our space later? The veto of the landlord, likely
disagreement of tYie church, anc3 the infrequency with which a full
license becomes available did not seem to affect their view of the
situation. After some debate and calling of the question before
we could present our full argument, we were voted down. As our
next recourse, we ' ve come to your body to make our case .
Our argument is relatively simple . The increased parking
allotment required for a beverage license is hinged upon the
concept of " intensifieci use" -- that beverage service will create

a boom of excess cars in the neighborhood. Our justifications in
seeking a variance from this allotment are, we believe, very
reasonable :
1 . We are not a bar and will not draw crowds of single-
passenger cars as a bar would. We cannot serve beverages to
a nunlber of people greater than to which we can serve food;
hence, we have no greater density of use with a licetlse than
. without .
2 . The effect of a license upon our lunch trade will be
minimal if apparent at all . People simply do not drink much
at lunch. And, in any event , the vast majority of our
business at lunch comes from surrounding businesspeople ,
students , shoppers , etc . , as people generally remain near
their jobs given the limited time available for the average
lunch hour .
3 . Similarly , our dinner hours will be the time when
customers arrive by car, and the time when nearly all of our
beverage service will occur . After 5 : 30 , most of the
businesses on our block close and parking is readily
available . The Grand Avenue Business Association is
supporting evening hours (until 8 p.m. ) for the shops on our
block, and some regularly conduct longer summer hours .
However, there is still a lower density of traffic in the
evening -- fewer people are out and about than during the
business day . And one of the main reasons people do go out
in the evening is to dine ,
4 . The businesses on our block support our request for
a parking variance because our success will boost their
businesses . GABA' s proposed evening hours could become a
worthwhile investment for businesses because of our dinner-
c3raw onto the block . Also, a point we find very important :
our "extra" customers , those people who are on the wait list
for a table, do not loiter in our space, eating up the parking
for the other businesses . People with a twenty or thirty
minute wait browse the bookstore anci sample the other shops
on our street . Our " intensity" of use does not infringe
upon tkie business of our neighbors , it actively enhances
their tra�3e .
S . We want wine to serve with our food because our
cuisine is fine dining; we are presentinq a menu that merits
wine as an accompanyment -- we are not simply looking to serve
alcohol . Our type of food preparation treats wirLe as a fooc� -
- which it is -- arid wine is used in the preparation of some
dishes ; ideally, the same wine used in preparation should be
served with the dish in order to fully r.omplete sensual
aesthetics involved. Out of <�eferrence to anci apreciation of
this situation we received letters from both Macalester and
the Macalester-Plymouth United Ch.urch not only permitting
beverage service near them, but advocating it .
6 . We prepare our food in an extrernely labor intensive
manner . IVothing enters our kitchen pre-prepared: we cut
chicken breasts from .fresh cages rather than getting trays of
frozen, pre-cut meat because the quality is so much better.
We make every item from raw, fresh ingredients -- which is

expensive . From a business standpoint, beer and wine makes
a great difference in the final balance for a restaurant .
7 . Customers want beer and wine with our food. People
walk in, look at the menu, ask if we have alcohol, and often
leave when informed that we don' t .
8 . Finally, our food takes highly skilled and extremely
knowledgable wait staff . It is difficult to retain highly
qualified personnel without large enough tips , and in the
absence of beer and wine many of our patrons drink nothing
besides water -- which is well enough, but does nothing for
the servers ' incomes .
We want beverage to match the food. Davanni 's, near St .
Thomas , received a variance somewhat similar to ours , for similar
reasons -- though we 'd argue our food is even more predisposed to
wine than theirs . We concede the necessity of proving our
viability as a business , but our viability in the long term may
well hinge upon offering wine -- fine dining demands it . And if
our business suffers from this lack, our reduced patronage also
detracts from a potentially elevated evening trade in our area .
Having studied the Grand Avenue Plan and its advocacy for
development on our block, we feel that regardless of the current
membership of the District 14 Council we are a.cting in accord with
neighborhood interests .
We feel we 're being reasonable in our request . While we can �
understand that some community members might have reservations
concerning this matter -- especially those expressed before we
opened, when it was perhaps unclear to some persons precisely what
sort of dining we offer -- on the whole, this license isn' t going
to significantly affect the neighborhood at all . We 're a small ,
busy restaurant . With your approval, we ' ll become a small busy
restaurant offering wine and beer . The difference will be a
wonderful thing for our patrons and staff . For the neighborhood
as a whole it will be unnoticable, save for those who dine with us .
We deeply value your time and attention in this matter --
thank you. We hope you will be able to support us at our hearing
on July 31st , As a commentary on our type of cuisine, I have
enclosed copies of the reviews we 've received to date ; hopefully
they will serve to justify our position somewhat more objectively .
