Presented By Referred To Ordinance # Green Sheet # c J��"E�S RESOLUTION CITY OF SAINT PAUL, MINNESOTA l� Committee: Date 1 Resolurion Regarding a Multifaceted Pilot 2 Prevention and Enforcement Program To Reduce Youth 3 Access to Alcohol 4 6 7 8 9 10 11 12 13 14 15 16 17 WHEREAS, far the past 10 yeazs the City of Saint Paul has consistently enforced its licensing laws, which prohibit the sale of alcohol to persons under the age of 21, through the imposition of stringent presumptive civil penalties assessed against licensed liquor establishxnents who fail to check identification and serve persons under the age of 21, and WHEREAS, the main enfarcement tools used by the City's O�ce of License, Inspections and Environmental Protection (LIEP) and the 5aint Paul Police Department to discourage and deter violations of alcohol sales to persons under the age of 21 is alcohol awareness training for license holders and employees, and the use of unannounced compliance checks, and WHEREAS, the City's procedures for compliance checks involve the use of under aged "decoys" or youthful compliance checkers who attempt to parchase alcohol without proper identification, and 18 19 WFIEREAS, a violation of law is verified when a license holder sells alcohol to a"compliance checker" who 20 is under the age of 21, withoutfzrst asking for proper ident�cation of age, and 21 22 WHEREAS, the Saint Paul Hospitality Association and the Minnesota Licensed Beverage Association have 23 asked the City to address the larger problem of youth access to alcohol by targeting the other sources that 24 youth use to obtain alcohol, besides the licensed beverage dealer, and 25 26 WHEREAS, there are opporhznities for the City to work with interested groups and organizations to expand 27 the City's efforts to prevent youth access to alcohol, said groups including the University of Minnesota, the 28 5aint Paul Ramsey Department of Health, and the non-profit organization, Minnesota Join Together, and 29 others, and 30 31 32 33 34 35 S6 �7 8 9 WT�I2EAS, the CiTy Council desires to respond to these opportunities to expand both the approach and the methods used to prevent youth access to alcohol to address 1) the youthful offender, 2) individual servers and sellers of alcohol, 3) the so called social providers, as well as 4) licensed liquor establishments, Now Therefore, Be It RESOLVED, that the Council of the City of Saint Paul does hereby establish a multifaceted one year pilot program to expand efforts to limit the access of youth to alcohol in the City of Saint Paui, said program described in the attached "Program Outline" which shall be deemed part of this Resolution, and Be It i�B �'��'�� E� 4 5 6 7 8 9 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 FURTHER RESOLVED, That the Council requests the Mayor's Office to monitor and oversee the pilot program and the acfivities identified for the impiementation by the Saint Paul Police Department, the Office of LIEP, the Ciry Attorney's Office, and the Saint Paul Ramsey Health Deparlment, and report back to the City Council on the effectiveness of the program by December 1, 1999. ` �y ao QR�G1NAt Requested by Department of: Office of License. Recommendations of the Ad Hoc Advisory Committee on the Pilot Alcohol Prevention Program As you know the Advisory Group has worked closely over the past 16 months to guide and evaluate the various efforts taken as part of the Multifaceted Pilot Prevention Program to Reduce youth access to Aicohol in the City of 5aint Paul. The group is pleased to provide you with the following progress report and recommendations. The group recommends that more emphasis be placed on meting out penalties to the underage violators. Itepresentatives from the Hospitality Association and Saint Paul Potice will meet on a weekday afternoon in eazly February at O'Gara's Bar to review standard protocols for charging underage people who attempt to purchase alcohol illegally. The group will work first with Billy's On Grand, Tiffany's, and the Wild Onion to implement these changes, and will include other estabiishments as time allows. 2. The gtoup recommends that we continue to do compliance checks for all 4501icensed establistunents in 2000. Ai1 establishments that fail in 2Q00 wi11 receive a follow-up check; checks will be done by both Police and LIEP personnel. These comprehensive checks will be done in cooperation with the University ofMinnesota's program. Additional checks (approximately 100 in number) will be conducted by Saint Paul Police using funds provided through the Minnesota Deparhnent of Public Safety and Minnesota Join Together. The group supports the issuance of wamings for first time failures no matter who conducts the check during the duration of the pilot program from January 1, 1999, until December 31, 2000. Only one warning per establishment. After an establishment receives a waming, the next failure will be treated as a first offense for the purposes of the penalty mah 4. The group supports the Police conducting compliance checks outside the University of Minnesota comprehensive program, as noted in number 2 above. The main purpose of these supplemental checks will be to address community complaints. The group will meet with the City Attorney and Ramsey County judges to discuss appropriate penalties for youthful violators and servers. A letter to all licensed establishments outlining the enforcement actions to be taken and the potential consequences to both youthful violators and servers will be mailed to license holders in February, 2000. 5, The group recommends that no civil penalties for servers nor underage violators should be pursued at this time. Criminal penalties aze the preferred method of deterrent as noted in number 4. The extent of the penalties still needs to be clarified in consultation with the City Attorney. � � �. ,2-�' „ City Councilmembers January 25, 2000 Page 2 �t�-��a 6. The group recommends that the 7% liquor license discount for establishments that take alcohol awazeness ttaining should be continued. However, to qualify for the reduced fee, licensed establishments must take alcohol awazeness training from a qualified trainer who also provides investigation services. (Currently only NII,BA training is acceptable and their contraci expired in 1999). The City wiil entertain proposals to bid for the continuation of such training from all interested providers with the intent of designating a single best provider in 2000 and beyond. New legislation will be developed to implement this proposal, and we ask that Council Agenda item number 25 be laid over for 30 days to allow time to develop alternative language. Due to the poor performance of the 32 beer license holders during the first round of compliance checks, and the resulting substantiai increase in enforcement time generated by this group of license holders, the fee for such licenses should be evaluated to make sure that the fees received cover the cost of enforcement. It is expected that such fees will have to be increased substantially. 8. In summary the group recommends that emphasis must be focused on charging, convicting, and sentencing youthful violators with substantial penalties, making especially sure that driving privileges are suspended in accordance with the provisions of State Legislation. The group also recommends that further consideration be given over the next few months to the development of a set of recommendations addressing the issue of penalties for so called social providers. Recommendations of the Ad Hoc Advisory Committee on the Pilot Alcohol Prevention Program As you know the Advisory Group has worked closely over the past 16 months to guide and evaluate the various efforts taken as part of the Multifaceted Pilot Prevention Program to Reduce youth access to Aicohol in the City of 5aint Paul. The group is pleased to provide you with the following progress report and recommendations. The group recommends that more emphasis be placed on meting out penalties to the underage violators. Itepresentatives from the Hospitality Association and Saint Paul Potice will meet on a weekday afternoon in eazly February at O'Gara's Bar to review standard protocols for charging underage people who attempt to purchase alcohol illegally. The group will work first with Billy's On Grand, Tiffany's, and the Wild Onion to implement these changes, and will include other estabiishments as time allows. 2. The gtoup recommends that we continue to do compliance checks for all 4501icensed establistunents in 2000. Ai1 establishments that fail in 2Q00 wi11 receive a follow-up check; checks will be done by both Police and LIEP personnel. These comprehensive checks will be done in cooperation with the University ofMinnesota's program. Additional checks (approximately 100 in number) will be conducted by Saint Paul Police using funds provided through the Minnesota Deparhnent of Public Safety and Minnesota Join Together. The group supports the issuance of wamings for first time failures no matter who conducts the check during the duration of the pilot program from January 1, 1999, until December 31, 2000. Only one warning per establishment. After an establishment receives a waming, the next failure will be treated as a first offense for the purposes of the penalty mah 4. The group supports the Police conducting compliance checks outside the University of Minnesota comprehensive program, as noted in number 2 above. The main purpose of these supplemental checks will be to address community complaints. The group will meet with the City Attorney and Ramsey County judges to discuss appropriate penalties for youthful violators and servers. A letter to all licensed establishments outlining the enforcement actions to be taken and the potential consequences to both youthful violators and servers will be mailed to license holders in February, 2000. 5, The group recommends that no civil penalties for servers nor underage violators should be pursued at this time. Criminal penalties aze the preferred method of deterrent as noted in number 4. The extent of the penalties still needs to be clarified in consultation with the City Attorney. � � �. ,2-�' „ City Councilmembers January 25, 2000 Page 2 �t�-��a 6. The group recommends that the 7% liquor license discount for establishments that take alcohol awazeness ttaining should be continued. However, to qualify for the reduced fee, licensed establishments must take alcohol awazeness training from a qualified trainer who also provides investigation services. (Currently only NII,BA training is acceptable and their contraci expired in 1999). The City wiil entertain proposals to bid for the continuation of such training from all interested providers with the intent of designating a single best provider in 2000 and beyond. New legislation will be developed to implement this proposal, and we ask that Council Agenda item number 25 be laid over for 30 days to allow time to develop alternative language. Due to the poor performance of the 32 beer license holders during the first round of compliance checks, and the resulting substantiai increase in enforcement time generated by this group of license holders, the fee for such licenses should be evaluated to make sure that the fees received cover the cost of enforcement. It is expected that such fees will have to be increased substantially. 8. In summary the group recommends that emphasis must be focused on charging, convicting, and sentencing youthful violators with substantial penalties, making especially sure that driving privileges are suspended in accordance with the provisions of State Legislation. Recommendations of the Ad Hoc Advisory Committee on the Pilot Alcohol Prevention Program As you know the Advisory Group has worked closely over the past 16 months to guide and evaluate the various efforts taken as part of the Multifaceted Pilot Prevention Program to Reduce youth access to Aicohol in the City of 5aint Paul. The group is pleased to provide you with the following progress report and recommendations. The group recommends that more emphasis be placed on meting out penalties to the underage violators. Itepresentatives from the Hospitality Association and Saint Paul Potice will meet on a weekday afternoon in eazly February at O'Gara's Bar to review standard protocols for charging underage people who attempt to purchase alcohol illegally. The group will work first with Billy's On Grand, Tiffany's, and the Wild Onion to implement these changes, and will include other estabiishments as time allows. 2. The gtoup recommends that we continue to do compliance checks for all 4501icensed establistunents in 2000. Ai1 establishments that fail in 2Q00 wi11 receive a follow-up check; checks will be done by both Police and LIEP personnel. These comprehensive checks will be done in cooperation with the University ofMinnesota's program. Additional checks (approximately 100 in number) will be conducted by Saint Paul Police using funds provided through the Minnesota Deparhnent of Public Safety and Minnesota Join Together. The group supports the issuance of wamings for first time failures no matter who conducts the check during the duration of the pilot program from January 1, 1999, until December 31, 2000. Only one warning per establishment. After an establishment receives a waming, the next failure will be treated as a first offense for the purposes of the penalty mah 4. The group supports the Police conducting compliance checks outside the University of Minnesota comprehensive program, as noted in number 2 above. The main purpose of these supplemental checks will be to address community complaints. The group will meet with the City Attorney and Ramsey County judges to discuss appropriate penalties for youthful violators and servers. A letter to all licensed establishments outlining the enforcement actions to be taken and the potential consequences to both youthful violators and servers will be mailed to license holders in February, 2000. 5, The group recommends that no civil penalties for servers nor underage violators should be pursued at this time. Criminal penalties aze the preferred method of deterrent as noted in number 4. The extent of the penalties still needs to be clarified in consultation with the City Attorney. � � �. ,2-�' „ City Councilmembers January 25, 2000 Page 2 �t�-��a 6. The group recommends that the 7% liquor license discount for establishments that take alcohol awazeness ttaining should be continued. However, to qualify for the reduced fee, licensed establishments must take alcohol awazeness training from a qualified trainer who also provides investigation services. (Currently only NII,BA training is acceptable and their contraci expired in 1999). The City wiil entertain proposals to bid for the continuation of such training from all interested providers with the intent of designating a single best provider in 2000 and beyond. New legislation will be developed to implement this proposal, and we ask that Council Agenda item number 25 be laid over for 30 days to allow time to develop alternative language. Due to the poor performance of the 32 beer license holders during the first round of compliance checks, and the resulting substantiai increase in enforcement time generated by this group of license holders, the fee for such licenses should be evaluated to make sure that the fees received cover the cost of enforcement. It is expected that such fees will have to be increased substantially. 8. In summary the group recommends that emphasis must be focused on charging, convicting, and sentencing youthful violators with substantial penalties, making especially sure that driving privileges are suspended in accordance with the provisions of State Legislation. The group also recommends that further consideration be given over the next few months to the development of a set of recommendations addressing the issue of penalties for so called social providers.
