WHEREAS , the Council of the City of Saint Paul on March 12 ,
1958, approved resolution C.F. 186502 for the condemninq and
taking of an easement for slopes , cuts, and fills in the grading
of Sims Avenue from White Bear Avenue to Flandrau Street; and,
WH�REAS , apartment buildings at 1741 , 1751 , and 1761 Sims
Avenue have been constructed over this easement subsequent to
March, 1958 ; and
WHEREAS , this easement constitutes a defect to the title of
the properties where the apartment buildings are located; and
WHEREAS , the Department of Public Works advises that the
construction of the street has been completed and that the
easement for this purpose is no longer required.
THEREFORE BE IT RESOLVED, that the Council of the City of
Saint Paul hereby authorizes the proper City officials to convey
a Quit Claim to Saint Paul Affordable Housing 1990 Limited
Partnership, which releases this easement recorded as document no.
391541 over the following described property:
Lots 20, 21 , 22 , 23 , 24 , 25, 26 , 27 , and the west 17 feet
of Lot 29, Block l, Birmingham' s Park, Ramsey County,
Minnesota
