2 WHEREAS, the Council of the City of Saint Paul, in Council File No. 97-1417 approved
3 the acquisifion of a certain tract of vacant land comprising 12 .73 acres located in the Highwood
4 Hills neighborhood and more commonly lrnown as the LaFavor property. The esfimated fair
5 market value of the properry is $310,000.00; and

7 WfIEREAS, Council File No. 97-1417 further directed City staffto apply to the
8 Minnesota Department of Natural Resources's Natural and Scenic Area Grant Program (DNR) in
9 order to obtain additional financial assistance to match the sum of $150,000.00 which had been

granted to the Conservation Fund, a non-profit corporation of the state of Maryland, by North
Star Steel and its pazent company, Cargill, Inc. for the acquisition of the LaFavor property ; and
WHEREAS, pursuant to Council File No. 97-1417 ,City staff made an application to the
DNR's Natural and Scenic Area Grant Program and the DNR subsequently granted the City the
sum of $155,000.00 towards the purchase of the LaFavor property; and
WHEREAS, the Conservarion Fund has now reached an agreement with the H.J. LaFavor
Trust wherein the Conservation Fund will purchase the said property using funds from North
Staz Steel and the City's DNR grant and then deed the property to the City for incorporation into
the City's parklands as a passive park for river bluffpreservarion and for open space access; and
WI-IEREAS, the acquisition of the LaFavor properly for pazk purposes is in keeping with
the Saint Paul Comprehensive Plan and the recommendation of the Saint Paul Parks and
Recreation Commission; NOW, THEREFORE, BE IT
RESOLVED, that the proper City o�cials aze authorized and directed to pay to the
Conservation Fund the sum of $155,000.00 from Activity No. C98-3A025-0881-341�1, to be
used for the acquisition of the said property; AND, BE IT

FURTHER RESOLVED, that the proper City officials are authorized and directed to
accept a warranty deed for the LaFavor properry from the Conservation Fund and to file the deed
with the County Recorder; AND, BE IT

The Conservation Fund has a purchase agreement to purchase the "LaFavor praperty" and has
received grants totalling $150,000 from North Star Steel and Cargill, Inc. toward the purchase of
the property and the Minnesota Department of Natural Resources (DNR) has given the City a
grant of $155,000 toward the purchase of the property. The resolution authorizes the transfer of
the DNR grant funds to The Conservation Fund to allow for the consumation of the purchase.
Once the Conservation Fund has purchased the property and cleared the site they will give the
City the property.
VANTAGES IF APPROVED:
The City wiR acquire 12.73 acres of land along the Highwood Bluff that meets the objective of
river bluff preservation and open space access.
ISADVANTAGES IF APPROVED: �
