An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps thereof
WHEREAS, Pursuant to Minnesota Statutes, §462.357 and §64.400 of the
Legislative Code, White Hat Restaurant (Ed Gorman) duly petitioned to rezone
1484 White Bear Avenue, being legally described as Lots 32-38, Block 3; Hayden
Heights Addition from B-2 to B-3 for the purpose of permitting reuse of the
property to establish a drive through service window, the petition having been
certified by the Planning Division on April 18, 1990 as having been consented
to by at least 67� of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous property within one
year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on May 17, 1990, held
a public hearing for the purpose of considering the rezoning petition, and
pursuant to §107.03 of the Administrative Code, submitted its recommendation to
the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on May 25, 1990 and recommended that the City Council approve the
petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning
petition was duly published in the official newspaper of the City on June 9,
1990 and notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on June
28, 1990, where all interested parties were heard, the Council having
considered all the facts and recommendations concerning the petition;
now, therefore

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
� That the zoning map of the City of Saint Paul, Sheet Number 7, as
incorporated by reference in §60.301 of the Saint Paul Legislative Code,
as amended, is hereby further amended as follows:
That property with the address listed as 1484 White Bear Avenue, being
more particularly described as:
Lots 32-38, Block 3; Hayden Heights Addition
be and is hereby rezoned from B-2 to B-3
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

A. PURPOSE: To consider a petition to rezone the property from B-2 to B-3, and an
application for a Special Condition Use Permit to operate a drive-through window
in an existing restaurant.
B. PARCEL SIZE: The parcel has 267.96 feet of frontage along the east side of
White Bear Avenue, and frontages of 130 feet each along Nebraska and Nevada.
The area of the parcel is 34, 840 square feet.
C. EXISTING LAND USE: The site was originally developed as a national chain
sit-down restaurant. The site is well landscaped and has 57 off-street parking
spaces. Access driveways to the site are provided on White Bear Avenue, on both
sides of the restaurant structure. There is a utility shed and enclosed trash
containment facility at the northeast corner of the site. The site is separated
from the adjoining residential uses to the east by an alley. There is no
vehicular access from the alley to the site.
D. SURROUNDING LAND USE:
North: Commercial uses on land zoned B-2.
East: Single family homes on R-4 zoned land.
South: A branch Public Library on land zoned OS-1.
West: A mortuary and other commercial use on B-3 zoned land.

On May 17, 1990 the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted four to one to approve the rezoning based
on staff findings.
On May 25, 1990 the Planning Commission upheld the Zoning Committee's
recommendation on a vote of 15 to one.
This rezoning is scheduled to be heard by the City Council on June 28, 1990.

Dear Ms. Morton:
After its Physical Committee had met with Mr. Gorman and approximately 20
neighbors and after the Board of Directors had heard from Mr. Gorman and
about 15 neighbors at its regular meeting on May 16, 1990, the Board of
Directors of the District 2 Community Council adopted a motion supporting
the rezoning of property at 1484 White Bear Avenue from B-2 to B-3 (Z.F.
10630) only if the applicant is willing to place a restriction on the
deed to said property which would limit future uses of the property to
uses legal in a 6-2 zoning district and a drive through restaurant.
Mr. Gorman was asked at the Physical Committee meeting of May 9, 1990, if
he would consider such a deed restriction. So far he has given no
indication that he would place such a restriction on his property.

WHEREAS, White Hat Restaurant (Ed Gorman) , zoning file #10630, has petitioned to
rezone 1484 White Bear Avenue situated on the east side of White Bear between Nevada
and Nebraska streets from B-2 to B-3 for the purpose of adding a drive through
window to an existing restaurant; and
WHEREAS, the Zoning Committee of the Planning Commission on May 17, 1990, held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
l. A petition containing owners signatures for 15 of the 15 parcels eligible
for consent to the rezoning, was received in the zoning office on April 18,
1990.
2. Following the waiting period mandated by §64.400. (c) of the zoning code, the
petition was declared sufficient by the zoning staff on April 27, 1990.
3. The proposed change in the use of the property does not appear to adversely
impact adjoining property in the vicinity by the generation of unreasonable
traffic. Flow of traffic through the site will be facilitated by changes in
the design which will result in a one-way traffic pattern.
4. The site is sufficient size to accommodate the change in use, and the minor
loss of off-street parking space which will be caused by the addition of the
drive-through window. The off-street parking which will remain following
the change if permitted will exceed the required off-street parking for the
use on the site.
5. The property is presently in a commercial zone, and is surrounded on three
sides by other commercial property. Land to the west is currently zoned and
used as B-3 commercial, the classification requested for this parcel.

WHEREAS, the Zoning Committee of the Planning Commission on May 17, 1990, held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.300

commission, which obligates the restaurant operator to keep the area
surrounding said restaurant free of restaurant Zitter for a reasonable
specified distance.
A litter collection plan must be filed with the zoning section, prior to
initiating operation of the drive-through window.
g. Speaker box sounds from drive-through lanes sha11 not be plainly audible so
as to cznreasonably disturb the peace, quiet and comfort of abutting
residential property.
The volume of sound from the speaker boxes can be controlled by the operator
from inside the structure.
h. A Zandscaped area not less than fifteen (15) percent of the impervious
surface area of the 1ot sha11 be provided and maintained.
The current landscaped area of the site exceeds the fifteen (15) percent
required by the ordinance.
i. Impact on adjoining property by use of the site may not resulC in the
following:
1. Loud boisterous and disturbing noise Zevels.
2. Hazardous traffic conditions.
3. Offensive, obnoxious and disturbing odors.
4. Excessive Zitter.
5. Excessive artificial Zighting.
6. Subs[antial decrease in adjoining property values.

With proper operational management of the site, impacts such as those noted
above on adjoining property can be prevented. The current operation does
not pose these problems, and the only change in operations is the addition
of a drive-through service window for customer convenience.
Further the Commission makes the following general findings pursuant to the
requested special condition use:
1. The extent, location and intensity of the use is in substantial compliance
with the Saint Paul Comprehensive Plan and applicable subarea plans which
have been approved by the city council.
2. Ingress and egress to the site will minimize traffic congestion in the
public streets.
3. The use will not be detrimental to the existing character of the development
in the immediate neighborhood or endanger the public health, safety and
general welfare.
4. The use will not impede the normal and orderly development and improvement
of the surrounding property for uses permitted in the district.
5. The use shall, in all other respects conform to the applicable regulations
of the district in which it is located.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission, that under
the authority of the City's Legislative Code, the application for a Special
Condition Use Permit to allow the addition of a drive through service window to an
existing restaurant at 1484 White Bear Avenue is hereby approved, subject to
rezoning of the site from B-2 to B-3, by the City Council, and further subject to
the following conditions:
1. That the drive through service window shall remain closed between the hours
of 10:00 p.m. and 6:00 a.rn, on Sunday through Thursday, and between the
hours of 11:00 p.m. and 6:00 a.m. on Fridays and Saturdays; and,
2. That the access and egress driveways shall be designated for one-way
vehicular traffic through the site. .

To consider a petition to rezone the property from B-2 to B-3, and an
application for a Special Condition Use Permit to operate a drive-through
window in an existing restaurant.
Mr. McGuire gave the slide presentation and staff report.
Applicant Ed Gorman addressed the committee in support. Mr. Gorman stated the
restaurant was built in 1972 and he is the seventh owner. The restaurant is
open from 6:00 a.m, to 11:00 p.m. There are two, two-way entrance-exit
driveways which he would improve. He has 100 percent support from the owners
of 15 parcels within 100 feet of his property. He stated there are over 30
restaurants within one mile of his property and he needs this drive-through
window to remain competitive. Mr. Gorman stated he also owns another White
Hat Restaurant in Lake Elmo. He is in agreement with the stipulations listed
in the staff report.
Mr. McGuire stated there was an allowable usage change in the code with
respect to drive-through windows.
Neighbors presented a petition in opposition to the proposal.
Ms. Lois Gilman of 1826 E. Nebraska, a neighborhood resident of 60 years,
spoke in opposition. Her main concern was future B-3 businesses that would
not be conducive to the neighborhood. Ms. Marion Schadegg, neighborhood
resident spoke in opposition to the rezoning. A letter of conditional support
from the District Two Council was presented to the committee. Mr. Ray
Sammons, District Two Community Organizer spoke in opposition to the rezoning.
Mr. Sammons stated six out of eight members of the council voted opposition to
the permit. Mr. Tony DeRosa, neighborhood resident, also spoke in opposition
to the rezoning.
, Applicant Ed Gorman spoke in rebuttal stating his local customers commented on
the ill-informed, confused group of petitioners. The property taxes of
$18,000 per year have motivated him to explore the options of increasing
business. His drive-through window will not create more traffic, but will
serve the traffic from the Maplewood Mall and other businesses currently north
of his business. He picks up the trash on a daily basis and has never had
complaints from the neighbors. His food items are made to order. Mr. Gorman
stated there are seven blocks of B-3 property near his location. Mr. Gorman
stated he would be willing to make one driveway an entrance and one driveway
an exit, if he obtained the rezoning. Ms. Tracy closed the public hearing.

Mr. McGuire stated the addition of a drive-through window, under the existing
code, through definition becomes a fast food restaurant, whether or not it
serves fast food. Mr. McGuire proceeded to read the code definitions of
restaurants, carry-out, and restaurant fast food.
Ms. Hirte moved to recommend approval of the rezoning from B-2 to B-3. Mr.
Vaught seconded the motion. On a vote of four in favor, one opposed, the
Zoning Committee will recommend approval of the rezoning to the Planning
Commission on May 25, 1990.
Ms. Hirte moved to approve the Special Condition Use Permit contingent upon
city council approval of rezoning to B-3. Mr. Vaught seconded the motion. On
a vote of four in favor and one opposed, the Zoning Committee will recommend
approval of the Special Condition Use Permit to the Planning Commission. The
drive-through window is to be closed from 11:00 p.m. to 6:00 a.m. The
driveways are to be one-way entrance and exits. The window is to be on the
north side of the building and a site plan is to be part of the SCUP.

Section 64.400. (b) states in part that " . . .an amendment to the zoning code may
be initiated by the council, the planning commission or by petition of the
owners of sixty-seven (67) percent of the area property to be rezoned. . ."
Fast-food restaurants are uses permitted subject to special conditions in the
B-3 zoning district under the provisions of §60.544. (4) of the zoning code. The
listed conditions and the ability of the proposal to meet them, are as follows:
a. Points of vehicular ingress and egress sha11 not be onto a street which is
used primarily for access to abutting residential property.
All vehicular access to the parcel is via White Bear Avenue
b. Points of vehicular ingress and egress sha11 be Iocated at least sixty (60)
feet from any abutting residentially zoned property.
The nearest residentially zoned property is in excess of 150 feet from the
entry drives.
c. When the site abuts an a11ey which also serves residentially zoned land, no
access from the site to the a11ey sha11 be permitted.
There is no vehicular access to the alley from the property.
d. Site sha11 have a minimum of one hundred (100) feet of street frontage on
its principal access street.
The site has 267.96 feet of frontage on White Bear Ave. the principal
access street.
e. Trash receptacles sha11 be housed in a three-side masonry enclosure, six (6)
feet high or equal in height to the dumpster, whichever is greater, and have
an entrance gate constructed of durable, opaque material.
The trash receptacle is or can be so enclosed.
f. A litter collection plan sha11 be developed and submitted to the planning
corrtmission, which obligates the restaurant operator to keep the area
surrounding said restaurant free of restaurant litter for a reasonable
specified distance.
A litter collection plan must be filed with the zoning section, prior to
initiating operation of the drive-through window.
g. Speaker box sounds from drive-through Ianes sha11 not be plainly audible so
as to unreasonably disturb the peace, quiet and comfort of abutting
residential property.
The volume of sound from the speaker boxes can be controlled by the operator
from inside the structure.

h. A Iandscaped area not Iess than fifteen (15) percent of the impervious
surface area of the Iot sha11 be provided and maintained.
The current landscaped area of the site exceeds the fifteen (15) percent
required by the ordinance.
i. Impact on adjoining property by use of the site may not result in the
folZowing:
1. Loud boisterous and disturbing noise Ievels.
2. Hazardous traffic conditions.
3. Offensive, obnoxious and disturbing odors.
4. Excessive Zitter
5. Excessive artificial lighting.
6. Substantial decrease in adjoining property values.
With proper operational management of the site, impacts such as those noted
above on adjoining property can be prevented. The current operation does
not pose these problems, and the only change in operations is the addition
of a drive-through service window for customer convenience.
F. ZONING HISTORY: In 1972, the property was rezoned from "A" Residence to
Commercial to permit the development of a sit-down restaurant. The property has
been operated as a restaurant under different ownerships since that time.
G. FINDINGS:
REZONING: The staff recommends the following findings with respect to the
requested zoning change;
1. A petition containing owners signatures for 15 of the 15 parcels eligible
for consent to the rezoning, was received in the zoning office on April 18,
1990.
2. Following the waiting period mandated by §64.400. (c) of the zoning code, the
petition was declared sufficient by the zoning staff on April 27, 1990.
3. The proposed change in the use of the property does not appear to adversely
impact adjoining property in the vicinity by the generation of unreasonable
traffic. Flow of traffic through the site will be facilitated by changes in
the design which will result in a one-way traffic pattern.
4. The site is sufficient size to accommodate the change in use, and the minor
loss of off-street parking space which will be caused by the addition of the
drive-through window. The off-street parking which will remain following
the change if permitted will exceed the required off-street parking for the
use on the site.
5. The property is presently�n a commercial zone, and is surrounded on three
sides by other commercial. property. Land to the west is currently zoned and
used as B-3 commercial, the classification requested for this parcel.

SPECIAL CONDITION USE PERMIT: In addition to the conditions noted above,
and the applicants ability to meet those conditions, the planning commission
must also make the findings under the provisions of §64.300. (c) . The staff
suggests the following findings for consideration by the zoning committee
and the planning commission:
1. The extent, location and intensity of the use is in substantial compliance
with the Saint Paul Comprehensive Plan and applicable subarea plans which
have been approved by the city council.
2. Ingress and egress to the site will minimize traffic congestion in the
public streets.
3. The use will not be detrimental to the existing character of the development
in the immediate neighborhood or endanger the public health, safety and
general welfare.
4. The use will not impede the normal and orderly development and improvement
of the surrounding property for uses permitted in the district.
5. The use shall, in all other respects conform to the applicable regulations
of the district in which it is located.
G. STAFF RECOMMENDATION: Based on the above suggested findings, the staff
recommends approval of the proposed rezoning, and the requested Special
Condition Use Permit as petitioned and requested.

An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps thereof
WHEREAS, Pursuant to Minnesota Statutes, §462.357 and §64.400 of the
Legislative Code, White Hat Restaurant (Ed Gorman) duly petitioned to rezone
1484 White Bear Avenue, being legally described as Lots 32-38, Block 3; Hayden
Heights Addition from B-2 to B-3 for the purpose of permitting reuse of the
property to establish a drive through service window, the petition having been
certified by the Planning Division on Apri1 18, 1990 as having been consented
to by at least 67� of the: owners of the'area of: the property to be rezoned, and
further having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous property within one
year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on May 17, 1990, held
a public hearing for the purpose of considering the rezoning petition, and
pursuant to §107.03 of the Administrative Code, submitted its recommendation to
the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on May 25, 1990 and recommended that the City Council approve the
petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning
petition was duly published in the official newspaper of the City on June 9,
1990 and notices were duly mailed to each owner of affected property and
� property situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on June
28, 1990, where all interested parties were heard, the Council having
considered all the facts and recommendations concerning the petition;

Section 1.
' That the zoning map of the City of Saint Paul, Sheet Number 7, as
incorporated by reference in §60.301 of the Saint Paul Legislative Code,
as amended, is hereby further amended as follows: .
That property with the address listed as 1484 White Bear Avenue, being
more particularly described as:
Lots 32-38, Block 3; Hayden Heights Addition
be and is hereby rezoned from B-2 to B-3
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
