RESOLVED, That upon execution and delivery of a release in full to
the City, in a form to be approved by the City Attorney, the proper
City officers are hereby authorized and directed to pay out of the
Tort Liability Fund, 09070-0511, to: Selwin Ortega the sum of
$7,500.00 in full settlement of his claim of damages sustained on
or about October 3, 1986, as more particularly set out in his
notice of claim transmitted by letter dated April 10, 1987 from the
Minnesota State Department of Human Rights.

Mr. Selwin Ortega was involved in a minor traffic accident on October 3, 1986. His vehicle
was parked when struck by another car. The other driver was not cited, but Mr. Ortega was.
The citation was subsequently dismissed by the district court. Police officers, who arrived
at the accident scene, engaged Mr. Ortega in conversation and remarks were made that could
be interpreted as discriminatory based on national origin.
W'hile not admitting liability, the Chief of Police and City Attorney believe that a finder-
of-fact could find the City'2iab�:e for an act of discrimination h� this matter not been
