12 WHEREAS, the Department of Public Works of the City of Saint Paul has proposed to reconstruct
13 sidewalks on Summit Avenue from Selby Avenue to Kent Street; and
14
15 WHEREAS, this portion of Summit Avenue lies within the Historic Hill Heritage Preservation
16 District designated in C.F. 274795, adopted in 1980; and
17
18 WHEREAS, the Saint Paul Historic Preservation Commission is authorized under Chapter 73 of
19 the St. Paul Legislative Code to review and make recommendations concerning all city activity that
20 changes the nature and appearance of Historic Preservation Districts, has previously made
21 recommendations in the Summit Avenue Plan and has established guidelines for the repair or
22 replacement of city sidewalks in HPC Resolution #89-1, adopted February 9, 1989; and
23
24 WHEREAS, Summit Avenue is recognized nationally as historically significant, is a part of Saint
25 Paul's rich heritage and is shared by all citizens of St. Paul; and
26
27 WHEREAS, it has been determined that owners of property located in the City of Saint Paul are
28 required to maintain sidewalks and boulevards and may make minor repairs when necessary; and
29
30 WHEREAS, the City of Saint Paul is requiring a sidewalk width in excess of the standard width;
31 now, therefore, be it
32
33 RESOLVED, that the Council of the City of Saint Paul approves the preliminary order for the
34 repair or replacement of sidewalks along Summit Avenue from Selby Avenue to Kent Street in
35 accordance with HPC Resolution 89-1 under the following conditions:
36
37 (1) The city will replace the existing tile sidewalks with monolithic poured concrete scored in
38 a square pattern u�on a�roval of the final order by the Ci�,y Council, unless the propert,y
39 owner provides written notice of intent to proceed under numbers 2 through 4 below with the
40 work bein� satisfactorily com�leted within 90 days of said final �proval;

42 (2) Property owners may retain the services of a contractor on their own provided the
43 completed work falls within these guidelines and provided the contractor is bonded, insured
44 and licensed to do business in St. Paul;

3 (3) Owners of buildings containing one, two or three family dwellin�s may repair or replace
4 e�sting tiles with tiles of a similar quality and texture, replace with s lv e tiles obtainable
5 from the city and subject to availabilitv or, in limited cases, in-fill with an appropriate
6 concrete mixture resulting in similar quality and texture;
7
8 (4) Owners of buildings containin� one� two or three family dwellings making repairs shall
9 be exempt from licensing and bonding requirements and shall provide proof of insurance
10 coverin� the city during the time sidewalks are being repaired in accordance with Cha�ter 121
11 of the Le,�islative Code as amended;
12
13 (5) Where homesteaded property owners have made repairs themselves the city will inspect
14 �,pon com�letion of the project and may re-inspect every two years to assure that the sidewalk
15 is maintained within standards approved herein by the city council;
16
17 (6) When replacement occurs the city shall save and store tiles and make them available to
18 property owners at no charge for repair of existing city sidewalks in the Historic Hill District;
19
20 (7) Where the city replaces with monolithic poured concrete in a scored pattern owners of
21 buildings containing one, two or three family dwellin�s will be assessed at the rate established
22 for reconstruction of sidewalks for residential properties within a commercial area under
23 Council File No. 84-632 which states that " Residential pro�erties within a commercial area
24 with wider than normal sidewalks will �a,y the standard rate for a normal 5 foot wide
25 sidewalk';

27 (8) The sandstone sidewalk panels on the south side of Summit between 266 Summit and 294
28 Summit will be repaired and preserved where possible and assessed at the rate established
29 under item 7 above;

31 (9) Existing poured concrete sidewalks in good condition shall be replaced with Monolithic
32 poured concrete scored in a 24 inch square pattern when they are of such condition requiring
33 repair or replacement.

37 RESOLVED, that the following minimum standards are hereby approved for the maintenance of
38 sidewalks along Summit Avenue:

40 DEFICIENCIES REQUIRING REMOVAL AND REPLACEMENT

42 STRUCTURAL CRACKS: Those cracks penetrating the entire depth of the slab or tile.

44 MODERATE SCALING: F�posure of the aggregate and/or loss of at least 1/8" of the
45 surface mortar.

47 HEAVY SCALING: Exposure of large aggregate and/or loss of surface mortar in excess of
48 3/8".

50 TREE HEAVED PANELS: Panels or tiles raised in excess of 3/8" per lineal foot caused by
51 tree root growth.

53 ASPHALT PATCHES except as a temporary repair pending removal and replacement of
54 deficient panels or tiles.

requiring repair. Because this is in the Historic Hi11 District it has� been difficult
to reach concensus on how to proceed. This resolution establishes a compromise that allows
the city to proceed with replacement or repair.
