RESOLVED, That upon execution and delivery of a release in full to
the City, in a form to be approved by the City Attorney, the proper
City officers are hereby authorized and directed to pay out of the
Tort Liability Fund, 09070-0511, to: DuWayne Duke dba St. Paul
Diamond Taxi and Ehrman and Associates, Inc. the sum of $4,419.48
in full settlement of their claim of property damages sustained on
or about January 3, 1990, as more particularly set out in the
Notice of Claim filed in the City Clerk's office on January 25,
1990.

On January 3 , 1990, a taxi cab owned by DuWayne Duke and driven by
Gregory A. Williams, was involved in a motor vehicle accident with a
Saint Paul police squad car at the intersection of Grotto Street and
University Avenue. The squad car was travelling east on University, respond-
ing to an emergency call , when it struck the taxi cab which had just complete
a "U" turn into east bound University Avenue traffic . The taxi cab sustained
damages totalling $4 ,419 .48 .
