WHEREAS, the 1990 Riverfest festival has been scheduled for the city's
Harriet Island Park from July 27, 1990 to August 5, 1990; and
WHEREAS, the sale of wine and 3.2 beer is a part of said festival ; and
WHEREAS, the city's Division of Parks and Recreation holds the on-sale
wine and beer licenses for Harriet Island Park; and
WHEREAS, State of Minnesota Laws, 1990 Chapter 554 gives the City Council
of the City of Saint Paul the right to vest these city held licenses in
people/organizations; and
WHEREAS, Rose Productions will produce the festival .
NOW, THEREFORE, BE IT RESOLVED that the City of Saint Paul shall allow
Rose Productions to sell 3.2 beer and wine at the 1990 Riverfest under the
license held by the Division of Parks and Recreation under the following terms
and conditions:
1. That Rose Productions shall observe all laws and ordinances of the State
of Minnesota and the City of Saint Paul governing the dispensing of such
beverages.
2. That Rose Productions shall obtain and keep in force dram shop (liquor
liability) insurance in the amount of not less than $1,000,000 per
individual injury or death, said insurance shall name the City as an
additional insured. Proof of said insurance in the form of a binder
shall be provided� to the City Attorney by July 15, 1990.
3. That when dispensing 3.2 beer or wine, servers may not sell more than two
servings to any one customer at a time.
4. That at all times when 3.2 beer or wine concession stands are in
operation, easily identifiable people shall be assigned to each stand to
check the age identification of those purchasing 3.2 beer or wine to
insure that these individuals meet legal age requirements, to prevent
sales to obviously intoxicated persons.
5. That 3.2 beer and wine and concessions may be open only between the hours
of 12:00 Noon and 12:00 midnight from the dates of July 27 through August
5, 1990 inclusive.

6. Sales of wine and beer authorized by this resolution shall .only occur
within the fenced area leased to Rose Productions for the production of
Riverfest, and sales will only be allowed to person legally entitled to
purchase and who are guests (patrons, ticket holders) of the event.
7. That Rose Productions shall take steps to ensure that no alcoholic
beverages are brought onto the premises other than those available from
concessionaires.
8. That persons are ejected from the premises who appear to be intoxicated.

In order to serve beer and wine at Riverfest, a license is necessary. The City received
enabling legislation during the last legislative session to vest beer and wine license
held by the Division of Parks and Recreation in event promoters. Therefore, we are
requesting that the Division of Parks and Recreation beer and wine licenses for Harriet
Island be vested in Rose Productions for the 1990 Riverfest, July 27 to August 5.
ADVANTAOES IF APPROVED:
Beer and wine will be sold legally at Riverfest under conditions contained in attached
resolution.

None if conditions in Resolution are followed concerning who beer and wine is sold to,
in what amounts, and if intoxicated individuals are denied further sales and removed
from the festival site.
OISADVANTAQE8IF NOT APPROVED: ,
Riverfest will not be as attractive an eveMt for some people. Event will not be
financially stable without income from wine and beer sales.
