VJHEREAS, Department of Fire and Safery Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisability and necessity of
ordering the repair or wrecking and removal of a two-story, wood frame dwelling located on
properry hereinafter refened to as the "Subject Property" and commonly known as 970 3rd Street
East. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before April 11, 1998, the following
are the now known interested or responsible parties for the Snbject Property: Maxine Krech, 1000
Edgerton Street Apt 807, St. Paul, MN 55101; MinnesoCa Housing Finance Agency, 400 Sibley

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identi�ed as an "Order to Abate Nuisance
Building(s)" dated May 15, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by June 15, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to consutute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the Ciry Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the 5aint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, September i, 199& to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the pubiic peace, health,
safety and welfaze and remove its blighting influence on the community by rehabIlitating this
structure in accordance with all applicable codes and ordinances, or in the altemative hy
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolirion of the strucriue to be completed within fifreen (15) days after the
date of the Council Hearing; and
WFiEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 9, 1998 and the testimony and evidence including the action taken by ihe Legislafive
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 970 3rd Street East:
i. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s}.
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Pire and Safety
Services, Division of Code Enforcement, VacantlNuisance Buildings.
8. 'That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
siructure in accordance with all applicable codes and ordinances. The rehabilitation or
demolifion and removal of the siructure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above conective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property gursuant to ffie provisions of Chapter 45 of the Saint Paul
I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, ail
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislarive Code.

Gerry Strathman called the meeting to order at 10:02 a.m.
Resolution ordering the owner to repair or remove the buildin� located at 503 St. Albans
Street North. If the owner fails to comnlv with the resolution, Public Health is ordered to
remove the building.
Kristine Kujala, Ramsey County Ta�c Forfeited Lands, appeared and stated the property was
forfeited to the State of Minnesota for non payment of back ta�ces. Ms. Kujala represents Ramsey
County as an agent to manage the property. She has been in contact with Toua C. Yang and
Choua Yang who are prior owners to the property. Mr. Yang has entered into a re-purchase
agreement with Ms. Kujala's office to buy back the property. The mortgage company is willing
to pay the taxes once the loan is approved by the Ramsey County Boazd of Commissioners. Ms.
Kujala's office cannot go to the Board of Commissioners until Mr. Yang understands that the
bond has to be posted. Ms. Kujala has tried to tell this to Mr. Yang and the mortgage company,
however it is uaclear how much Mr. Yang understands. Mr. Yang thought he was only re-
purchasing 507 St. Albans, but there are two houses on this one lot. 507 St. Albans has been
brought up to code. Mr. Yang was informed of the meeting today.
Chuck Votel reported Harold Robinsoci is the inspector handling this address. Mr. Robertson has
expressed frustration that Mr. Yang was concerned about re-occupying 507 St. Albans for rent
money and does not seem to want to deal with 503 St. Albans. The City has had to issue six
abatement notices on 503 St. Albans for cutting tall grass and to remove refuse. Ramsey County
Taxation has placed an estimated market value on the property at $29,700. The inspector feels
the estimated cost to repair would be $45,000.
Gerry Strathman stated there are IS judgement creditors listed, some of which are from the State
of Minnesota. Chuck Votel responded the ones against the 5tate of Minnesota are recorded as
having a lien against the State and property owned by the State. Code Enforcement is duty
bound to notify them. It will take work to clear the title on this property.
Gerry Strathman recommended Mr. Yang be allowed six months to complete rehabilitation on
condition that a$2,000 bond is posted, a code compliance inspection is completed, and the
vacant building fee is paid by noon of September 9, 1998. If Mr. Yang does not do these things,
Code Enforcement should proceed with the order [o remove or repair within 15 days.

intention to repair the building. Real estate taxes of $8,082.75 are due. Ramsey County
Tar+ation has placed an estimated market value of the property at $38,900. Code Enforcement
estimates the cost to repair at $45,000. The City has issued three summary abatement notices to
remove garbage, refuse, and cut tall grass.

Gerry Strathman called the meeting to order at 10:02 a.m.
Resolution ordering the owner to repair or remove the buildin� located at 503 St. Albans
Street North. If the owner fails to comnlv with the resolution, Public Health is ordered to
remove the building.
Kristine Kujala, Ramsey County Ta�c Forfeited Lands, appeared and stated the property was
forfeited to the State of Minnesota for non payment of back ta�ces. Ms. Kujala represents Ramsey
County as an agent to manage the property. She has been in contact with Toua C. Yang and
Choua Yang who are prior owners to the property. Mr. Yang has entered into a re-purchase
agreement with Ms. Kujala's office to buy back the property. The mortgage company is willing
to pay the taxes once the loan is approved by the Ramsey County Boazd of Commissioners. Ms.
Kujala's office cannot go to the Board of Commissioners until Mr. Yang understands that the
bond has to be posted. Ms. Kujala has tried to tell this to Mr. Yang and the mortgage company,
however it is uaclear how much Mr. Yang understands. Mr. Yang thought he was only re-
purchasing 507 St. Albans, but there are two houses on this one lot. 507 St. Albans has been
brought up to code. Mr. Yang was informed of the meeting today.
Chuck Votel reported Harold Robinsoci is the inspector handling this address. Mr. Robertson has
expressed frustration that Mr. Yang was concerned about re-occupying 507 St. Albans for rent
money and does not seem to want to deal with 503 St. Albans. The City has had to issue six
abatement notices on 503 St. Albans for cutting tall grass and to remove refuse. Ramsey County
Taxation has placed an estimated market value on the property at $29,700. The inspector feels
the estimated cost to repair would be $45,000.
Gerry Strathman stated there are IS judgement creditors listed, some of which are from the State
of Minnesota. Chuck Votel responded the ones against the 5tate of Minnesota are recorded as
having a lien against the State and property owned by the State. Code Enforcement is duty
bound to notify them. It will take work to clear the title on this property.
Gerry Strathman recommended Mr. Yang be allowed six months to complete rehabilitation on
condition that a$2,000 bond is posted, a code compliance inspection is completed, and the
vacant building fee is paid by noon of September 9, 1998. If Mr. Yang does not do these things,
Code Enforcement should proceed with the order [o remove or repair within 15 days.

WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by June 15, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to consutute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the Ciry Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the 5aint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, September i, 199& to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the pubiic peace, health,
safety and welfaze and remove its blighting influence on the community by rehabIlitating this
structure in accordance with all applicable codes and ordinances, or in the altemative hy
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolirion of the strucriue to be completed within fifreen (15) days after the
date of the Council Hearing; and
WFiEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 9, 1998 and the testimony and evidence including the action taken by ihe Legislafive
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 970 3rd Street East:
i. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s}.
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Pire and Safety
Services, Division of Code Enforcement, VacantlNuisance Buildings.
8. 'That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
siructure in accordance with all applicable codes and ordinances. The rehabilitation or
demolifion and removal of the siructure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above conective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property gursuant to ffie provisions of Chapter 45 of the Saint Paul
I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, ail
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.

expressed frustration that Mr. Yang was concerned about re-occupying 507 St. Albans for rent
money and does not seem to want to deal with 503 St. Albans. The City has had to issue six
abatement notices on 503 St. Albans for cutting tall grass and to remove refuse. Ramsey County
Taxation has placed an estimated market value on the property at $29,700. The inspector feels
the estimated cost to repair would be $45,000.
Gerry Strathman stated there are IS judgement creditors listed, some of which are from the State
of Minnesota. Chuck Votel responded the ones against the 5tate of Minnesota are recorded as
having a lien against the State and property owned by the State. Code Enforcement is duty
bound to notify them. It will take work to clear the title on this property.
Gerry Strathman recommended Mr. Yang be allowed six months to complete rehabilitation on
condition that a$2,000 bond is posted, a code compliance inspection is completed, and the
vacant building fee is paid by noon of September 9, 1998. If Mr. Yang does not do these things,
Code Enforcement should proceed with the order [o remove or repair within 15 days.

estimates the cost to repair at $45,000. The City has issued three summary abatement notices to
remove garbage, refuse, and cut tall grass.
