WHEREAS, on April 10, 1990, the Division of Public Health fogged or dye tested a rodent
hole on or near the property at 685 E. Orange Avenue, Saint Paul, Minnesota, and discovered that
the sewer line connecting the property to the City sewer system was broken; and
WHEREAS, a broken sewer line allows rats to tunnel to the surface of the ground and also
causes unsanitary conditions by allowing raw sewage to escape which the Division of Public Health
has determined to be a public nuisance; and
WHEREAS, on April 16, 1990, said Division sent written orders to Robert and Sharon Klein,
the fee owner of said property, ordering them to repair the sewer line that connects their property
to the City sewer system;
WHEREAS, said order required said owners to abate the nuisance within thirty (30) days and
they filed a timely appeal of said order with the City Clerk; and
WHEREAS, the City Council on May 15, 1990 conducted a public hearing on said appeal and
affirmed the Division's order to repair and determined that the condition of the property which is
the subject of the said written order be corrected within thirty (30) days; now therefore, be it
RESOLVED, that the order of the Division is hereby affirmed except as modified herein; and
be it
FURTHER RESOLVED, that in the event the work is not completed within the thirty (30)
days after the publication of this resolution, the City may proceed to perform or complete the
necessary work to abate the said nuisance with the costs incurred therefrom, to be collected in the
manner as provided by law.

Dear Mr. Olson:
Enclosed is the resolution you had requested that this office
prepare in your May 16, 1990 memo.
The resolution is in regard to the public hearing held by the City
Council on May 15, 1990. The Council at that time denied th�e
appeal of Robert and Sharon Klein from the Summary Abatement Order
for the property located at 685 E. Orange Avenue.
