RESOLVED, that upon the petition of Kim Long Development,
Inc. , per Finance Department File No. 4-1990, part of the alley
in Block 1 , Mackubin and Marshall ' s Addition to Saint Paul ,
bounded by University, Arundel, Aurora, and Western Avenue,
hereinafter described, be and the same is hereby vacated and
discontinued as public property.
The vacated area is described as follows:
All that part of the north 0. 3 feet of the alley in
Block l , lying between the southerly extended west
line of lot 12 and the southerly extended east
line of lot 6 in said Block 1 , Mackubin and
Marshall ' s Addition to Saint Paul
The vacation shall be subject to the following conditions :
1 . That this vacation shall be subject to the
terms and conditions of Chapter 13P1 , codified
March 1 , 1981, of the Saint Paul Legislative
Code, as amended.
2 . That the petitioner , its successors , and
assigns shall pay a $500. 00 administrative
fee for this vacation which is due and
payable within 60 days of the publication
date of this resolution.
3. That the land described above is being
vacated to accommodate building encroachments
and that upon removal, reconstruction,
alteration, demolition, or otherwise non-
existence of the encroaching building, the
vacated land shall revert to the City of
Saint Paul as alley right-of-way without cost
or charges to the city.
4. That the petitioner, its successors, and
assigns by acceptance of the terms and
conditions of this vacation, agree to
� indemnify, defend, and save harmless the City
of Saint Paul, its officers, and employees
from all suits , actions , or claims of any
character brought as a result of injuries or
damages received or sustained by any person,
persons, or property on account of this

vacation, or petitioner ' s use of this
property, including but not lim�ted to a
claim brought because of any act of omission,
neglect or misconduct of said petitioner or
because of any claims or liability arising
from any violation of any law or regulation
made in accordance with the law whether by
the petitioner of any of its agents or
employees .
5. That the petitioner , its successors , and
assigns, shall within 60 days of the
publication date of this resolution, file
with the city clerk, an acceptance in writing
of the conditions of this resolution and
shall within the period (s) specified in the
terms and conditions of this resolution,
comply in all respects with these terms and
conditions .
