RE: Zoning File #10609 - Independent School District #625
City Council Hearing: May 1, 1990
PURPOSE: To consider a petition to rezone property from I-1 Light Industrial
to RT-2 to permit reuse of the existing structure as an elementary school.
PLANNING COMMISSION DECISION: Approve
ZONING COMMITTEE DECISION: Approve
STAFF RECOMMENDATION: Approve
SUPPORT: None
OPPOSITION: None
Dear Sir:
On April 5, 1990, the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted 4-0 to approve the rezoning based on staff
findings.
On April 13, 1990, the Planning Commission upheld the Zoning Committee's
recommendation on a voice vote. Two people abstained (Mr. Parks and Ms. Wencl)
because they are employed by the petitioner.
This rezoning is scheduled to be heard by the City Council on May 1, 1990.
Please notify me by April 27, 1990, if any member of the City Council wishes to
have slides of the site presented at the public hearing.

L.'FIEREAS, Independent School District = 625, file #10609, has petitioned to rezone
403 North Dale Street, being the block bounded by Dale Street, Concordia Ave. ,
:ackubin Street and the alley line bet-:een Caroll and Iglehart Avenues, from I-1 to
RT-2 for the purpose of redeveloping the property as a school site; and
iv'HEREAS, the Zoning Committee of the Planning Commission on April 5, 1990 held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accorda.r.ce with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
G'IiEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minues,
made the following findings of fact:
1. A consent petition meeting the requirements of §64.400. (b) of the Sair. Paul
Legislative Code and §462.357. subd. 5, was filed in the Planning Diision
Zoning Office on March 5, 1990. The petition contained 18 property o:cr.ers'
signatures.
2. In accordance with the requireents of §64.400. (c) , the petition was
determined to be sufficient on `!arch 14, 1990 following the mandatorti seven
working day waiting period.
3. The proposed reuse of the site is consistent with the surrounding mikure of
land uses. The available open space on the site and the existing strscture
which will be converted for school use serve to buffer uses further to the
south from the adverse impacts of the interstate freeway.
4. The proposed reuse of the site is consistent with the comprehensive pan for
this area of the city. In the event the use of the site for a public school
is discontinued at some point in the future, redevelopment with low density
residential uses is appropriate.
5. Elementary schools are a permitted use in the RT-2 zoning district.
:OW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Independent School Distric = 625 to rezone property at 304 Nortr Dale

Re: Rezoning of Control Data Site
Our File No. 7368.60
Gentlemen:
This is a follow up to our telephone conversations concerning
the status of the School District's rezoning request.
As you know, on April 12th, the Planning Commission approved
the rezoning request. In discussions with Chuck McGuire in March,
he indicated that if everything went along without a hitch, it
might be possible to have the rezoning request on the City Council
Agenda for the April 19th meeting. I have now checked with Chuck
and he indicated that the matter will not be on the April 19th
Agenda but rather on the City Council 's Agenda for May lst. Chuck
indicated that it was just not possible to get the various
documents together in time to meet the required submittal date and
give the proper notices.
Assuming the matter is on the Agenda on May lst, the first
reading of the Ordinance would be May 3rd, the second reading of
the Ordinance would be May lOth, the third reading of the Ordinance
would be May 15th, and the fourth reading and final adoption of the .
Ordinance would be on May 22nd. The Ordinance would then be
published within three or four days and 30 days after publication
the Ordinance would automatically become law.

At this time no one is expecting any opposition and no one
sees any problems in getting the Ordinance finally passed. Chuck
McGuire said that in his 17 years of working in St. Paul Zoning he
has only seen one successful "recall" of an Ordinance after it has
been finally adopted by the City Council.
At the May lst City Council meeting, the Staff Report and
Recom;nendations will he presented and someone from the SchooZ
District should be present to answer any questions that might come
up. Finally anyone in opposition will be allowed to speak. The
vote should be taken immediately and we should then be able to
adhere to the above mentioned schedule.
I will be in contact with Jene prior to the hearing to discuss
attendance and related matters.
Sincerely yours,

Dear Mr.McGuire:
The enclosed site ptans represent the cureM stage of planning for the subject site. Final drawings are

In response to the issue raised by Member Linda Herte conceming the source of cooling water, I have
investigated this system and learned that the c:ooling system recycles the cooling water through the use
of a cooling tower. No ground water is used in this system.
Relative to Member Mark Vaught's question about the participation of the District #8 Planning Councit,we
have had two meetings with the Council and, in addition, we have met separately with two groups of
neighbors.
If you have any further questions, either Jene Sigvertsen, Leon Hakkila, or I will be pleased to respond. I
will be present at the Planning Commission meeting at 10:30 a.m. Friday, April 13, 1990 and will be
prepared to respond to any further questions.
Thank you for your assistance.

E. ZONING CODE CITATION: Section 64.400. (a) states in part that "the council may,
from time to time, amend, supplement or change the district boundaries or the
regulations herein, or subsequently established herein pursuant to the
provisions of Minnesota Statutes Section 462.357 and amendments thereto as may
be made from time to time. . ." .
Section 64.400. (b) states in part that " . . .an amendment to the zoning code may
be initiated by the council, the planning commission or by petition of the
owners of sixty-seven (67) percent of the area property to be rezoned. . ."
Minnesota Statutes §462.357. subd. 5, requires that consent signatures of 2/3 of
the owners of property within 100 feet of the property to be rezoned are needed
to initiate a rezoning in cities of the first class.
F. FINDINGS:
1. A consent petition meeting the requirements of §64.400. (b) of the Saint Paul
Legislative Code and §462.357. subd. 5, was filed in the Planning Division
Zoning Office on March 5, 1990. The petition contained 18 property owners'
signatures.
2. In accordance with the requirements of §64.400. (c) , the petition was
determined to be sufficient on March 14, 1990 following the mandatory seven
working day waiting period.
3. The proposed reuse of the site is consistent with the surrounding mixture of
land uses. The available open space on the site and the existing structure
which will be converted for school use serve to buffer uses further to the
south from the adverse impacts of the interstate freeway.
4. The proposed reuse of the site is consistent with the comprehensive plan for
this area of the city. In the event the use of the site for a public school
is discontinued at some point in the future, redevelopment with low density
residential uses is appropriate.
5. Elementary schools are a permitted use in the RT-2 zoning district.
G. STAFF RECONIlSENDATION: Based on the above suggested findings, the staff
recommends approval of the rezoning as requested. A site plan showing final
configuration of the site should be submitted for administrative review and
approval at the earliest possible date.

Re: Rezoninq of Control Data Site
Our File No. 7368.60
Dear Mr. McGuire:
This is to confirm our telephone conversation of Monday, March
19th, concerning the above matter.
The hearing on the School District's request to rezone the CDC
Site is on the agenda of the Zoning Committee for its April 5, 1990
meeting. It is my understanding that by this coming Friday your
office will :nzil ntice cf te iieariy Lo property owners within
350 feet of the CDC Site and that you will provide us with a copy
of the notice when it is sent out. You will be heading up the
staff investigation of the School District's request for rezoning
and, at this time, you feel that the staff's report and
recommendation will be available in written form by March 30th.
We would also appreciate receiving a copy of that document in
advance of the hearing.
At the hearing before the Zoning Committee, the School
District will be prepared to make a brief presentation after the
zoning staff makes its presentation and recommendation and
representatives of the School District will also be available to
answer any questions that the Committee might have.

Dear Mr. MaGuire:
This is to aonfirm our telephone oonversation of Deaember 21, 1989
regarding the Control Data Corporation (CDC) facility located at
304 North Dale Street, St . Paul, Minnesota.
My understanding from that oonversation is that your offiae vill

presently zoned I-1 to an elementary school housing approximately
3, 000 students . I further understand that our planning may proceed
and aotual conversion and occupancy of the building may occur
ithout rezoning but that rezoning vould take place at a future
date.
Please respond to this letter ith your oonaurance or any further
clarification of the Planning and Economic Development' s position
regarding this project .

Mr. William A. Larson
Long Range Facilities Planning Coordinator
Saint Paul Public Schools
360 Colborne Street
Saint Paul, Minnesota 55102-3299
Dear Mr. Larson:
This letter is written in response to your letter of December 27, 1989
concerning reuse of the Control Data Corporation facility at 304 North Dale
Street in Saint Paul.
The Zoning Staff of the Department of Planning and Economic Development and
that of the Building Inspection and Design Division of the Department of
Community Services support the reuse of this facility as an elementary school
for approximately 3,000 students. Conversion and occupancy of the structure
can begin immediately.
To make zoning consistent with other properties held by Saint Paul Public
Schools, the property should be rezoned to the R-4 residential category as
soon as possible. To that end, we are sending copies of the necessary
petition forms with this letter. We stand ready to assist you through the
rezoning process once you obtain the necessary consent signatures and file the
petition with our office.
Please let me know if our office can be of further assistance to you
concerning this matter.
Sincerely,
 fl
