I-1 to RT-2 for the purpose of permitting the reuse of :tlie p�operty�'^a�;,;a e�ementary school, the petition having been certified by the Planning Division on March 14, 1990 as having been consented to by at least 67� of the owners of the area of the property to be rezoned, and further having been consented to by at least two-thirds of the owners of the property situated within 100 feet of the total contiguous property within one year proceeding the date of the petition; and WHEREAS, The Zoning Committee of the Planning Commission on April 5, 1990, held a public hearing for the purpose of considering the rezoning petition, and pursuant to 5107.03 of the Administrative Code, submitted its recommendation to the Planning Commission that the petition be granted; and WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on April 13, 1990 and recommended that the City Council approve the petition; and WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly published in the official newspaper of the City on April 21, 1990 and notices were duly mailed to eacH owner of affected property and property situated wholly or partly withiri 350 feet of the property sought to be rezoned; and WHEREAS, a public hearing before the City Council having been conducted on May l, 1990, where all interested parties were heard, the Council having considered all the facts and recommendations concerning the petition; now, therefore � - ., , �y�-� THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. The petitioner testified. At the close of the public hearing, the Committee voted 4-0 to approve the rezoning based on staff findings. On April 13, 1990, the Planning Commission upheld the Zoning Committee's recommendation on a voice vote. Two people abstained (Mr. Parks and Ms. Wencl) because they are employed by the petitioner. This rezoning is scheduled to be heard by the City Council on May 1, 1990. Mr. Neid stated the land was previously zoned RT-2 and this � should be stated in the findings. i Mike Gallivan, Jr. , Attorney with Briggs and Morgan acting as . counsel to the school district, spoke to the committee, Bill Lang � � who is a director of long range facilities, planning coordinator for the school district also spoke. i Mr. Bill Larson of 232 Rivercrest Drive, Hudson, Wisconsin, who � is an employee of the school district, also spoke to the ` committee. Mr. Larson stated the property will be primarily flat with a gradual slope to the northeast toward Concordia for : drainage. Some of the asphalt will be removed and replaced with qrass. Current planning is for 260 parking spaces. Mr. Vaught E asked if the site will be fenced. Mr. Larson stated yes. There k will be no windows added to the south side of the building. Two : of the truck bays on the north side would remain to service the � school, the rest will be converted to entries to the school. Ms. ;. Hirte asked about the current heating and cooling system in the school. Mr. Larson stated it is gas fired, perimeter heat with - air conditioning. ; Mr. Vaught asked about District Eight's comments. Sigvertsen Saint Paul Public Schools 360 Colborne Street St. Paul, Minnesota 55102 Re: Rezoning of Control Data Site Our File No. 7368.60 Gentlemen: This is a follow up to our telephone conversations concerning the status of the School District's rezoning request. As you know, on April 12th, the Planning Commission approved the rezoning request. In discussions with Chuck McGuire in March, he indicated that if everything went along without a hitch, it might be possible to have the rezoning request on the City Council Agenda for the April 19th meeting. I have now checked with Chuck and he indicated that the matter will not be on the April 19th Agenda but rather on the City Council 's Agenda for May lst. Chuck indicated that it was just not possible to get the various documents together in time to meet the required submittal date and give the proper notices. Assuming the matter is on the Agenda on May lst, the first reading of the Ordinance would be May 3rd, the second reading of the Ordinance would be May lOth, the third reading of the Ordinance would be May 15th, and the fourth reading and final adoption of the . Ordinance would be on May 22nd. Sigvertsen Saint Paul Public Schools April 18, 1990 Page 2 At this time no one is expecting any opposition and no one sees any problems in getting the Ordinance finally passed. Chuck McGuire said that in his 17 years of working in St. Paul Zoning he has only seen one successful "recall" of an Ordinance after it has been finally adopted by the City Council. At the May lst City Council meeting, the Staff Report and Recom;nendations will he presented and someone from the SchooZ District should be present to answer any questions that might come up. Finally anyone in opposition will be allowed to speak. The vote should be taken immediately and we should then be able to adhere to the above mentioned schedule. No ground water is used in this system. Relative to Member Mark Vaught's question about the participation of the District #8 Planning Councit,we have had two meetings with the Council and, in addition, we have met separately with two groups of neighbors. If you have any further questions, either Jene Sigvertsen, Leon Hakkila, or I will be pleased to respond. PURPOSE: To consider a petition to rezone property from I-1 Light Industrial to RT-2 to permit reuse of the existing structure as an elementary school. B. PARCEL SIZE: The site has 1,240 feet of frontage on Concordia, 460 feet of frontage on Dale Street, and 470 feet of frontage on Mackubin. The area of the site is 571,600 square feet or 13.12 acres. C. EXISTING LAND USE: The site is occupied by a large industrial structure that was built as a central distribution facility for Control Data Corporation. D. SUR.ROUNDING LAND USE: North: Interstate Highway 94 runs along the northerly edge of the site across the Concordia Avenue right-of-way. North of I-94 there are mixed density residential uses and a B-2 commercial use near Dale Street. East: The Minnesota Chapter of the American Lung Association in an OS-1 zone occupies the northerly site to the east. The area to the southeast is occupied by mixed density residential uses on properties zoned RM-3 and RT-1. South: The Martin Luther King Center occupies the property to the south at the eastern end of the site, between Kent and Mackubin. A parking area, four single family homes and two duplexes back up to the south side of the site west of Kent Street. West: Uses across Dale Street to the west of the site are a church and a nursing home, on RM-3 and RM-1 zoned property. �� ��� File #10609 Page Two. E. ZONING CODE CITATION: Section 64.400. (a) states in part that "the council may, from time to time, amend, supplement or change the district boundaries or the regulations herein, or subsequently established herein pursuant to the provisions of Minnesota Statutes Section 462.357 and amendments thereto as may be made from time to time. . ." . Section 64.400. (b) states in part that " . . .an amendment to the zoning code may be initiated by the council, the planning commission or by petition of the owners of sixty-seven (67) percent of the area property to be rezoned. . ." Minnesota Statutes §462.357. subd. 5, requires that consent signatures of 2/3 of the owners of property within 100 feet of the property to be rezoned are needed to initiate a rezoning in cities of the first class. F. FINDINGS: 1. A consent petition meeting the requirements of §64.400. (b) of the Saint Paul Legislative Code and §462.357. subd. 5, was filed in the Planning Division Zoning Office on March 5, 1990. The petition contained 18 property owners' signatures. 2. In accordance with the requirements of §64.400. (c) , the petition was determined to be sufficient on March 14, 1990 following the mandatory seven working day waiting period. 3. The proposed reuse of the site is consistent with the surrounding mixture of land uses. The available open space on the site and the existing structure which will be converted for school use serve to buffer uses further to the south from the adverse impacts of the interstate freeway. 4. The proposed reuse of the site is consistent with the comprehensive plan for this area of the city. In the event the use of the site for a public school is discontinued at some point in the future, redevelopment with low density residential uses is appropriate. 5. Elementary schools are a permitted use in the RT-2 zoning district. G. STAFF RECONIl�SENDATION: Based on the above suggested findings, the staff recommends approval of the rezoning as requested.
