WHEREAS, the Ciry of Saint Paul and the Ciry of Minnetonka, pursuant to the provisions Minnesota Statutes 471.59 are authorized to enter into an agreement to exercise jointly the governmental powers and functions each has individually; and 'WHEREAS, the Ciry of Saint Paul and the Ciry of Minnetonka, desire to combine their purchasing functions for the purchase of equipment, materials, services azd supplies to secure more favorable prices and conditions; NOW THEREPORE, IT IS HEREBY AGREED, by and between the parties hereto as follows: 1. The City of Saint Paul shall, pursuant to the procedures set fourth in the Saint Paul City Charter and applicable State Statutes, make joint purchases for both the City of Minnetonka and the City of Saint Paul of whatever same or similar equipment, materials, services and supplies are authorized and requested by both the City of Saint Paul and the Ciry of Minnetonka. Sunilarly, the City of Minnetonka shall make joint purchases for the two entities in accordance with all applicable Statutes and policies. 2. Each party shall make payment directly to the vendor according to established procedures. 3. Neither party shall assume any responsibiliry for the accountability of funds expended by other or the issuance of a purchase order by the other party. 4. Each parry shall be separately accountabie for it's own expenditures of public funds made hereunder. 5.
