1 WHEREAS, the City of Saint Paul has a long history of policies intended to oppose and dismantle
2 discrimination based on race, color, religion, sex, and national origin, and disability; and
3
4 WHEREAS, among those policies was a long standing ordinance requiring that a portion of City
5 contracting awards be set aside for businesses owned by minqrities, women, and disabled persons;
6 and
7
8 WHEREAS, set aside programs are both an effective and appropriate means of redressing past
9 discrimination, both public and private; and
10
11 WHEREAS, the U.S. Supreme Court has, in the case of City of Richmond vs. Croson. 109 S.C. 706
12 (1989), struck down a municipal set aside program, and has established a daunting evidentiary
13 burden for state and local jurisdictions who desire to adopt such programs; and
14
15 WHEREAS, the City of Saint Paul's set aside program has been suspended as a result of this
16 decision; and
17
18 WHEREAS, on May 9, 1990, the U.S. Congress will hold the first in a series of Congressional
19 Hearings concerning proposed legislation to offset the U.S. Supreme Court's decision in Richmond
20 vs. Croson: and
21
22 NOW, THEREFORE, BE IT RESOLVED, that the City of Saint Paul supports such legislation
23 including, but not limited to a bill introduced by Senator Paul Simon on June 22, 1989, known by
24 reference number 5.1235; and
25
26 FURTHER, that the City of Saint Paul hereby authorizes its lobbyist to represent this position to
27 Congress and directs that a co�v of this resolution be delivered to the a,�,pro�riate members of
28 Con reg ss requesting their support for such legislation.
