RESOLVED , that the Council of the City of Saint Paul does
hereby accept the dedication of a permanent sewer easement made
by Minikahda Ministorage III Limited Partnership on, under , and
across part of the Southwest Quarter of the Northwest Quarter of
Section 2H and the proper city officials be and are hereby
directed to file the deed of dedication, a copy of which is
attached hereto and incorporated herein by reference, in the
office of the Registrar of Deeds.

DEED OF DEDICATION OF EASEMENT
FOR SEWER PURPOSES
Minikahda Ministorage III Limited Partnership, Grantor, a
limited partnership under the laws of Minnesota, in consideration
of the sum of One Dollar and other good and valuable
consideration, to them in hand paid and the receipt of which is
hereby acknowledged, do hereby grant, bargain, sell, and convey
to the CITY OF SAINT PAUL, a municipal corporation of the State
of Minnesota , its successors, and assigns, as Grantee, a
permanent easement for sewer purposes, subject to existing
structures and easements of record, on, under, and across that
part of the Southwest Quarter of the Northwest Quarter of Section
20, Township 29, Range 23, described as follows:
Commencing at a point on the south line of the Southwest
Quarter of the Northwest Quarter of said Section 20, at the
intersection of said south line with the west line of State
Trunk Highway 280, which point is 485.95 feet west of the
Southeast corner of said Southwest Quarter of the Northwest
Quarter of said Section 20; thence west along said south
line to the easterly line of the right of way of the
Minnesota Belt Line Railway and Transfer Company; thence
north along said right of way 40 feet; thence north on a
curve to the left with a radius of 11,509.2 feet and along
the easterly line of said right of way 251.44 feet (more or
less) to a point on the easterly line of the right of way of
the Minnesota Belt Line Railway and Transfer Company, which
point is 291.42 feet north of the south line of the
Southwest Quarter of the Northwest Quarter of said Section
20; thence east along a line 291.42 feet north of and
parallel with the south line of the Southwest Quarter of the
Northwest Quarter of said Section 20, 248.55 feet to the
west line of State Trunk Highway 280; thence south 291.42
feet along said west line of State Trunk Highway 280 to the
point of beginning, including- That part of vacated Buford
Avenue lying within the Southwest Quarter of the Northwest
Quarter of Section 20, Township 29, Range 23, and westerly
of State Trunk Highway 28�, according ta the plat thereof on
file and of record in the office of the Register of Deeds in
and for Ramsey County, Minnesota.

Said easement being a strip of land 11 feet in width
westerly of and adjoining the existinq Minnesota Transfer
Railway sewer easement as described in Book 59 of Plans,
Page 15, on file and of record in the office of the Register
of Deeds, Ramsey County, Minnesota; said 11 foot strip
described as beginning from a line 291.42 feet north of and
parallel with the south line of said Southwest Quarter of
the Northwest Quarter of Section 20 extending southerly to
the south line of said Southwest Quarter of the Northwest
Quarter of Section 20.
Also, a strip of land 1 foot in width easterly of and
adjoining said existing Minnesota Transfer Railway sewer
easement and said 1 foot strip desczibed as beginning from a
line 291.42 feet north of and parallel with the south line
of said Southwest Quarter of the Northwest Quarter of
Section 20 extending southerly to the south line of said
Southwest Quarter of the Northwest Quarter of Section 20.
To have and to hold the same forever. The Grantors do covenant
that they are well seized in fee of the land and premises
aforesaid, and have good right to sell and convey the same free
of all encumbrances.
The Grantors also covenant that the above granted easement
is in the quiet and peaceable possession of the Grantee. The
Grantors will warrant and defend against all persons lawfully
claiming the whole or any part thereof.
It is intended and agreed that this agreement shall be a
covenant running with the land and shall be binding to the
fullest extent of law and equity for the benefit of the public.
It is further intended and agreed that this agreement and
covenant shall remain in effect without limitation as to time.
