RESOLVED, that the proper City officials are hereby
authorized and directed to execute an Agreement granting
$2, 000. 00 to PHALEN AREA COMMUNITY COUNCIL for the purpose of
helping to fund the Thursday Nite Live festival; to be held
June 28, 1990 and conducted in accordance with Council approved
guidelines dated August 12, 1987; a copy of said Agreement to be
kept on file and of record in the Department of Finance and
Management Services.

THIS AGREEMENT, made and entered into this day of
, 1990 by and between the CITY OF SAINT PAUL, a
municipal corporation of the State of Minnesota (hereinafter
referred to as "City") , and the PHALEN AREA COMMUNITY COUNCIL
(hereinafter referred to as "PACC") .
WHEREAS, on January 5, 198? the Lt. Paul City Council
established a Community Festival Loan Fund and
Grant Program, administered by the Division of
Parks and Recreation, for the purpose of assisting
neighborhood festivals with expenses, startup
costs and insurance coverage; and
WHEREAS, the St. Paul City Council has approved rules and
regulations to ensure the fair and equitable
distribution of the funds; and
WHEREAS, the PACC has applied for a grant in accordance
with these rules and regulations.
NOW THEREFORE, the parties agree as follows:
1. That the City shall grant to PACC the sum of Two Thousand
Dollars ($2, 000.00) for the purpose of helping to fund the
Thursday Night Live Festival to be held on June 28, 1990 as
more particularly outlined in PACC's application attached
hereto as Exhibit A and made a part of this Agreement.
2 . That PACC will prepare and submit to the City a report
outlining all expenses and revenues derived from tne
Festival and specifically detailing how the grant money was
spent within 90 days after the completion of the festival
noted above. PACC further will permit the Division of
Parks and Recreation staff full access to its books and
records concerning the festival.
3 . That PACC shall submit to the City a copy of the PACC's
liability insurance policy naming the City as an additional
insured, said policy shall be forwarded to City by June 18 ,
1990.

4 . That PACC understands this agreement is not binding until
the City Council approves of it by resolution.
