Paul hereby certifies and approves the action of the Property
Code Enforcement Board (Saint Paul Board of Appeals & Review)

Chairman Glassman calted the meeting to order at 1 :45 p.m. March
13 , 1990. He welcomed the Appellants and explained the
procedures , stating that what the board does is recomrnends action
to the City Council . He asked that statements be brief, and that
the board was there as fellow citizens to help them in a fair
manner.
1 . Approval of the minutes of the February 13 , 1990 meeting as
submitted in writing.
Motion made by James Laughlin to approve the minutes of the
February 13 , 1990 meeting as submitted in writing. Seconded
by Ron Ankeny. MOTION CARRIED UNANIMOUSLY.

SUBJECT: Appellant is requesting more time to remove accumulated

Charles Votel , an insper.tor from Environmental Health stat.ed that
the place was a mess. This is an on going thing. The place will
be inspectecl again. If the place is not cleaned up, in all
probability the place will be condemned.
BOARD ACTION: Motion macie by William Tilton to deny tt-�e request

roof, could be dangerous, because of the fumes.

PROCEEDINGS: Ms . Nelson requested a variance on baths because
she feels the number of baths are adequate. There are 6 girls
living on the top two floors . There are two and one/half
bathrooms in the house. There are 2 girls living in the
basement. A total o� 8 living in the building.
Don Miller, an inspector from Environmental Health stated that
the number of occupants are one over code on the top two floors ,
rati� is 5 to 1 per bath.
BOARD ACTION: Motion made by William Tilton to grant a variance •
an the number of bathrooms , with a cap of only six occupants on the
second and third floor . Seconded by Ron Ankeny. A friendly
amendment was added stating the variance is in effect only for
the duration of the current owner. MOTION CARRIED UNANIMOUSLY .

of the bathrooms . There is a total of 25 occupants , 12 are on
the second floor. Shower facilities are in the basement and one
on the first floor. This would take major remodeling.
Don Miller, an inspector from Enviromental Health stated that the
only issue is the location of the baths.

the bathroom locations , this variance is in effect for as long as

Pat Fish, an inspector from Fire 8 Safety stated that she spoke
with Mr . Heichel and he requested an extension until the April
meeting. Ms. Fish granted the extension.

SUBJECT: Appellant is requesting an extension of time to do work
pertaining to: paintin� the exterior, provide mechanical
ventilation for one batf�room; also requesting a variance on
having to provide a second exit from the third itoor .
PROCEEDINGS: Mr. King stated that the building was approved for
a Certificate in 1983 . At that time tl�e previous �wner was
preparing to sell the building. There was numerous calls for
inspecting this building, to grandfatfier in the third flooT-
unit. At that time the front fire exit was in place , and was
eccepted as the second exit . When the building was approved,
there was a stairwell going to the kitcl-�en fr�m the third exit,
oui�side, around �the back, and also a ladder device in the front,
wr�i ch was a second ex i t, on th i s bas i s i t. was approved. TI-�e past

BOARD ACTION: Motion made by William Tilton to deny the variance,
until such time that Fire 8 Safety inspect the building and
confirrn its findings , with the nderstanding that if, in fact, a
variance is required, that the Appellant be allowed to return to
this Board for further review. Included in this motion, if no
variance is required, than the Appellant be given an extension of
time until June 30, 1990 to complete the stairway. Also
Appellant was granted an extension of time until June 30, 1990 to
complete exterior painting and providing mechanical ventilation
for one bathroom. Seconded by Ron Ankeny. MOTION CARRIED
UNANIMOUSLY.

APPEARANCE : John Gall
SUBJECT: Appellant is requesting a variance on the requirement
of having to provide one hour fire rated ceilings for laundry
room and furnace room.
PROCEEDINGS: Mr. Gall is requesting approval of the ceilings in
the furnace & laundry room. The property was purchased in 1985.
At the time Mr. Gall purchased the property with a contingency,
that his plans would be approved by the City. At that time, there
was 37 violations against the building. Mr. Gall submitted some
plans and requested that he and the City work very closely with
his plans and the plans were semi approved. During the
construction an inspector would re-inspect. The inspector at
that time noticed there was about 2 1 /2" to 2 3/4" of flooring
above the joist. The Inspector at that time stated that this
would meet the one hour fire rating, therefore, there was no need
for 5/8" sheetrock on the ceiling in the furnace room. The
Certificate of Occupancy is due for renewal . The inspector will
� not approve the ceiling.
Sue Toskey, an inspector from Fire & Safety stated that,
unfortunately, the previous inspector is no longer with the
department and there is no record in the files regarding the
above statement. Ms. Toskey stated that she is not aware, why
this was never cited for.
Ron Ankeny stated that the purpose of requiring the one hour
fire-rated ceiling was for safety. He advised the appellant that
looks was not important. Gypsum board can be installed for a
nominal cost finished with fire tape.
Ms. Toskey stated that there were alternatives, one was the
sheetrocking, if not, then install a sprinkler system.
Mr. Gall stated that the water pipes are only 3/4" , therefore, the
sprinkler system could not be approved.

Mr. Ankeny stated that the sheetrock could be suspended from the
ceiling, but must be 5/8" thick and a Type X. The ceiling must
be at least 7 feet in height. For the guidelines, Mr. Gall would
have to check with the building departme.nt.
Ms. Toskey, stated that if the Water Department would not approve
a permit to install a sprinkler system, because of the pipe size,
the Water Department would then mail a letter to the Fire
Department, stating the water service is to small . The Fire
Department would then allow instdllation of an electrical smoke
detector system, which would have to be inter-connected to all
the floors , so that it is audible to every unit in the building.
BOARD ACTION: Motion made by Ron Ankeny to deny the request for
a variance be denied, instead grant an extension of time for 60
days , until May 1 , 1990 to provide a one hour fire rated ceiling
in the furnace and laundry room. Seconded by William Tilton.
MOTION CARRIED UNANIMOUSLY .

SUBJECT: Appellant is requesting a variance on having to reduce
the number of occupants in apartments #4, #3 & #2. (Overcrowding)
PROCEEDINGS: Mr. Wilcox stated that this is a six unit building.
Apartments 2, 3 , 4, are overcrowded. Unit #3 is a one bedroom
apartment and is occupied by two adults and two children, which
is about 8 sq. ft . short of the required space. Unit #2 has two
bedrooms, which is occupied by two adults and seven children,
short about 100 sq. ft. of the required space. Unit #4, has ten
occupants, the tenant has been notified to vacate.
The board was concerned about the issue of the overcrowding and
suggested to the appellant, that he advice the tenants to contact
the Housing Information Office, trying to find larger quarters
for the tenants in Unit #4.
Bob Langer, a neighbor spoken in opposition of granting the
variance.

BOARD ACTION: Motion made by William Tiltan to grant a variance
on Apartments #2 and #3 for the present tenants, with the
condition, that if the number of occupants increases, the
appellant must notify the tenants to move. A variance was
granted for only six months on Apartment ##4, with the condition,
that the appellant work with the present tenants to try and find
suitable housing for them. Included in the motion, in the future,
when Unit# 4 is rented, it be rented to the appropriate number

SUBJECT: Appellant is requesting a variance to be allowed to
install an egress window at the top of the exterior fire escape
instead of a full door, because of the expense.
PROCEEDINGS: Ms . Meyer would like to be allowed to install the
egress window, rather than the door, as the cost would be
enormous, as it requires cutting throught the roof.
Sue Toskey, from the Department of Fire 8 Safety stated that she
had gone out to the property, and has spoke to John Conway, a
Building Inspector. Ms. Toskey stated that Mr. Conway informed
her, that the project is near completion. Mr. Conway sent a
letter to Ms. Meyer informing her that the window cannot be used
in lieu of a door . Ms . Toskey stated that Fire Prevention has no
objection to the window. It �is up to the board, if they want to
grant a variance.

PROCEEDINGS: Mr. Dech presented some pictures to the board. The
house has four downspouts. The reason a variance is requested
is, the sidewalk on the west side abuts directly against the
house and there is very little room to direct the gutters in a
different direction, thus causing water seepage in the basement.
Rainleaders on the east side of the house could be workable.
Steve Herbert. from the Rainleader Division stated that the
rainleader could be diverted without to much of a problem.
Dounspout A could be routed to the rear or the front; B could be
routed to the front with no problem.
BOARD ACTION: Motion made by Don Weida to deny the request for a
variance on the disconnection of the rainleaders. Seconded by
William Tilton. MOTION CARRIED UNANIMOUSLY.

13 , 1990. He welcomed the Appellants and explained the
procedures, stating that what the board does is recommends action
to the City Council . He asked that statements be brief, and that

bathrooms in the house. There are 2 girts living in the
basement. A total of 8 living in the building.
Dan Miller, an inspector from Environmental Health stated that
the number of occupants are one over code on the top two floors,
ratio is 5 to 1 per bath.
BOARD ACTION: Motion made by William Titton to grant a variance •
on the number of bathrooms , with a cap of only six occupants on the
second and third floor. Seconded by Ron Ankeny. A friendly
amendment was added stating the variance is in effect only for

on the first floor. This would take major remodeling.
Don Miller, an inspector from Enviromental Health stated that the
only issue is the location of the baths.

the bathroom locations, this variance is in effect for as long as
the house remains a faternity house. Seconded by Don Weida.

SUBJECT: Appellant is requesting an extension of time to do work
pertaining to: painting the exterior, provide mechanical
ventilation for one batF�room; also requesting a variance on
having to provide a second exit from the third floor.
PROCEEDINGS: Mr. King stated that the building was approved for
a Certificate in 1983 . At that time the previous owner was
preparing to sell the building. There was numerous cails for
inspecting this building, to grandfather in the third f1ooT-
unit. At that time the front fire exit was in place, and was
accepted as the second exii� . When the building was approvEd,
there was a staiT-weil going to the kitchen from the third exit,
outside, around the back, and also a ladder device in the front,
which was a second exit, on this basis i� was approved. The past
summer-� a deck was designed to be build on the third floor , which
wouid be ano�ther exit, wPiich is near complet.ion. The steps goes

Ron Ankeny requested that 5ue Toskey meet wit,F� Mr . King for�
clarification. Mr. Ankeny stated that the intend of the code
pertaining tc� sec�nd exit from the third floor, is for safety and
the exit should be separatec9 from each other. He also inforrned
Mr. King that a vertir.�l ladder does not meet c:ode for a second
exit.

� until such time that Fire 8 Safety inspect the building and
confirm its findings, with the nderstanding that if, in fact, a
variance is required, that the Appellant be allowed to return to
this Boar.d for further review. Inctuded in this motion, if no
variance is required, than the Appellant be given an extension of
time until June 30, 1990 to complete the stairway. Also
Appellant was granted an extension of time until June 30, 1990 to
complete exterior painting and providing mechanical ventilation

SUBJECT: Appellant is requesting a variance on the requirement
of having to provide one hour fire rated ceilings for laundry
room and furnace room.
PROCEEDINGS: Mr. Gall is requesting approval of the ceilings in
the furnace & laundry room. The property was p�rchased in 1985.
At the time Mr. Gall purchased the property with a contingency,
that his plans would be approved by the City. At that time, there
was 37 violations against the building. Mr. Gall submitted some
plans and requested that he and the City work very closely with
his plans and the plans were semi approved. During the
construction an inspector would re-inspect. The inspector at
that time noticed there was about 2 1/2" to Z 3/4" of flooring
above the joist. The Inspector at that time stated that this
would meet the one hour fire rating, therefore, there was no need
for 5/8" sheetrock on the ceiling in the furnace room. The
Certificate of Occupancy is due for renewal . The inspector will
` not approve the ceiling.
Sue Toskey, an inspector from Fire & Safety stated that,
unfortunately, the previous inspector is no longer with the
department and there is no record in the files regarding the
above statement. Ms. Toskey stated that she is not aware, why
this was never cited for.
Ron Ankeny stated that the purpose of requiring the one hour
fire-rated ceiling was for safety. He advised the appellant that
looks was not important. Gypsum board can be installed for a
nominal cost finished with fire tape.
Ms. Toskey stated that there were alternatives, one was the
sheetrocking, if not, then instatl a sprinkler system.
Mr. Gall stated that the water pipes . are only 3/4" , therefore, the
sprinkler system couid not be approved.

Mr. Ankeny stated that the sheetrock could be suspended from the
ceiling, but must be 5/8" thick and a Type X. The ceiling must
be at least 7 feet in height. For the guidelines, Mr. Gall would
have to check with the building departme.nt.
Ms. Toskey, stated that if the Water Department would not approve
a permit to install a sprinkler system, because of the pipe size,
the Water Department would then mail a letter to the Fire
Department, stating the water service is to small . The Fire
Department would then allow installation of an electrical smoke
detector system, which would have to be inter-connected to all
the floors, so that it is audible to every unit in the building.
BOARD ACTION: Motion made by Ron Ankeny to deny the request for
a variance be denied, instead grant an extension of tirne for 60
days , until May 1 , 1990 to provide a one hour fire rated ceiling
in the furnace and laundry room. Seconded by Witliam Tilton.

SUBJECT: Appellant is requesting a variance on having to reduce
the number of occupants in apartments #4, ##3 & #2. (Overcrowding)
PROCEEDINGS: Mr. W•ilcox stated that this is a six unit building.
Apartments 2, 3 , 4, are overcrowded. Unit #3 is a one bedroom
apartment and is occupied by two adults and two children, which
is about 8 sq. ft. short of the required space. Unit ##2 has two
bedrooms, which is occupied by two adults and seven children,
short about 100 sq. ft. of the required space. Unit #4, has ten
occupants, the tenant has been notified to vacate.
The board was concerned about the issue of the overcrowding and
suggested to the appellant, that he advice the tenants to contact
the Housing Information Office, trying to find larger quarters
for the tenants in Unit #4.

SUBJECT: Appellant is requesting a variance to be allowed to
install an egress window at the top of the exterior fire escape
instead of a full door, because of the expense.
PROCEEDINGS: Ms . Meyer would like to be allowed to install the
egress window, rather than the door, as the cost would be
enormous, as it r-equires cutting throught the roof.
- Sue Toskey, from the Department of Fire 8 Safety stated that she
had gone out to the property, and has spoke to John Conway, a
Building Inspector. Ms. Toskey stated that Mr. Conway informed
her, that the pr�oject is near completion. Mr. Conway sent a
letter to Ms. Meyer informing her that the window cannot be used
in lieu of a door. Ms. Toskey stated that Fire Prevention has no
objection to the window. It is up to the board, if they want to
grant a variance.

BOARD ACTION: Motion made by Wiliiam Tilton to grant a variance
to allow the use of the egress window in place of having to

PROCEEDINGS: Mr. Wolf stated that the gutters were rusty and were
removed, but not replaced waiting th outcome of the boards
decision. He feels there is no place to route the water without
causing water damage to the basement.

Mr. Tancabel stated that the side walk on the west side of the
house had been replaced, and at that time the one gutter was
removed. The request for a variance on downspout #3 & #4 will be
withdrawn. At this time the only downspout #2 (Cities plan shows
No. #1 ) needs a variance.
BOARD ACTION: Motion made by Ron fXnkeny to deny the request for
a variance on the rainleader ##2 (Citie's plan shows #1 ) . Seconded
by Don Weida. MOTION CARRIED UNANIMOUSLY.

APPEARANCE : William M. Dech -
SUBJECT: Appellant is requesting a variance from having to
disconnect the rainleaders from the house as this will cause a
water problem.
PROCEEDINGS: Mr. Dech presented some pictures to the board. The
house has four downspouts. The reason- a variance is requested
is, the sidewalk on the west side abuts directly against the
house and there is very little room to direct the gutters in a
different direction, thus causing water seepage in the basement.
Rainieaders on the east side of the house could be workable.
Steve Herbert. from the Rainleader Division stated that the
rainleader could be diverted without to much of a problem.
Dounspout A could be routed to the rear or the front; B could be
routed to the front with no problem.
BOARD ACTION: Motion made by Don Weida to deny the request for a
variance on the disconnection of the rainleaders. Seconded by
William Tilton. MOTION CARRIED UNANIMOUSLY.
